Terms and Conditions
Auction Rights Reserved
JL Auctions reserves the right, at any time and at its sole discretion, without notice or obligation to any party, to:
(a) withdraw or cancel the offering of any asset(s) prior to bid acceptance;
(b) deny any individual a bidder number;
(c) suspend or permanently revoke bidding privileges at this or future auctions;
(d) reject any bid that is not submitted in good faith or does not represent a reasonable increase over a prior bid;
(e) disregard bids from disqualified participants;
(f) group items for sale in bulk or by lot; and
(g) announce additional terms during the auction. In the event of a tied bid, the earliest received bid will take precedence.
Minimum Age Requirement
All participants must be at least 18 years old to bid.
Binding Bids and Final Sale
By placing a bid, the bidder acknowledges acceptance of the item. The highest accepted bid will be declared the winning bid, and the bidder will be considered the buyer. Bids cannot be withdrawn once accepted. All sales are final.
Dispute Resolution
In the event of any dispute concerning a bid, the resolution will be made solely at the discretion of JL Auctions, including reoffering the item if necessary.
Buyer’s Premium
A Buyer’s Premium will be applied to all final invoice totals.
Deposit Requirement
Following the conclusion of a successful bid, JL Auctions may collect a deposit toward the purchase price and applicable premiums at its sole discretion.
Soft Close Bidding Format
All online auctions utilize a soft close format. If a bid is placed near the end of the timer, the bidding period for that lot will be extended by several minutes to allow for additional bids. In the case of identical bids, priority is given to the earliest one submitted.
Final Payment Due
The full balance of the purchase price and premium must be paid within 24 hours of auction close. No items may be removed from the premises until payment has been received in full.
Accepted Payment Methods
Payments must be made in U.S. currency by cash, cashier’s check, or wire transfer payable to JL Auctions. Credit card payments via Visa, MasterCard, and Discover are also accepted.
Agreement to Terms
By registering and/or bidding, each participant agrees to be bound by these Terms and Conditions.
Asset Inspection
Assets may or may not be available for preview prior to bidding. Any available inspection times will be noted in the lot description or auction listing.
Non-Payment Consequences
If the buyer fails to make payment or fulfill any auction terms, the deposit may be forfeited. JL Auctions reserves the right to retain or resell any such asset on behalf of the seller. The seller may reject any bid at their discretion.
Transfer of Possession
Ownership of all purchased items transfers to the buyer immediately upon acceptance of the bid. It is the buyer’s sole responsibility to insure assets once possession and title have been transferred. JL Auctions and the seller are not responsible for items in transit.
Removal of Assets
All items must be removed within the timeframe specified. The buyer bears all responsibility, risk, and expense associated with removal.
Safety and Compliance
Buyers are responsible for ensuring their own compliance with safety laws during asset removal and for the conduct and safety of all personnel they bring to the site.
Insurance Requirements
JL Auctions may require the buyer or any contracted third party assisting in asset removal to provide proof of insurance, including general liability (minimum $1,000,000) and workers’ compensation coverage. Buyers agree to indemnify JL Auctions and the seller for any damages or injuries related to removal activities.
No Guarantees on Asset Descriptions
Assets are described based on information believed to be accurate, but JL Auctions offers no guarantees, express or implied. Buyers are responsible for verifying all details and assume full responsibility for their own due diligence.
As-Is, Where-Is Condition
All items are sold strictly "AS IS, WHERE IS" with no warranties of condition, merchantability, fitness for purpose, or compliance with regulations. Buyers accept full responsibility for asset condition and inspection.
Release of Claims
By completing a purchase, the buyer releases JL Auctions, its staff, and agents from any and all claims related to the purchase, possession, or use of assets.
Unavailable Assets
If, for any reason, JL Auctions is unable to deliver purchased assets or relevant documentation, the buyer’s sole remedy is a refund of any monies paid, contingent upon return of the asset if already delivered.
Documentation
Any available documentation, manuals, or paperwork related to assets will be provided at the time of payment or delivery, or sent afterward if not immediately available.
Auction Time Extensions
JL Auctions reserves the right to modify auction end times at its discretion.
Partial Invalidity
If any part of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
Governing Law
These Terms and Conditions are governed by and shall be interpreted in accordance with the laws of the State of New Hampshire, regardless of the location of the auction.
