Auction Terms & Conditions: Bidder agrees to comply with these Terms & Conditions as a prerequisite for the Grand Acres Inc (“Auctioneer”) to accept the Bidder's Registration and to issue a Bidder Number. The Payment Due will be the final 'hammer' price plus the buyer’s premium posted on auction item and a $695.00 documentation/processing fee per auction lot won. Payment Due in full within 48 hours from the conclusion of the auction. Invoices over $5000 must be paid by wire transfer unless previous authorization is granted by the auctioneer. If Auctioneer agrees to accept a payment via credit card, a 3% credit card fee (3.5% for AMEX) will be assessed. Bidder agrees that insufficient available funds to pay the full Payment Due shall not be a valid defense for non-payment.
At the conclusion of the auction, the winning bidder unconditionally authorizes the Auctioneer to charge any credit card on file to pay for non-refundable deposit in the amount of $300.00/lot or 1/3 of the last bid amount whichever is higher or maximum amount of $1,000.00. If winning bid is less than $300.00, the full bid amount will be charged from the credit card on file. Winning Bidder must settle the balance in full (Invoice amount minus Deposit paid) within 48 hours of receiving the invoice. Please refer to “Payment Information” posted on each lot.
IF A WINNING BIDDER FAILS TO MAKE THE PAYMENT DUE IN THE STIPULATED TIME FRAME AND UPON REASONABLE ATTEMPTS BY THE AUCTIONEER TO CONTACT THE BIDDER TO COLLECT THE BALANCE DUE, BIDDER AGREES AND FULLY UNDERSTAND THAT DEPOSIT COLLECTED BY THE AUCTIONEER WILL NOT REFUNDED AND WILL BE KEPT BY AUCTIONEER AS PAYMENT FOR LIQUIDATED DAMAGES OR SPECIFIC ENFORCEMENT, AUCTIONEER’S LEGAL AND COLLECTION COSTS.
UNLESS OTHERWISE SPECIFIED, PRIOR PROPERTY TAXES OR FEES WHICH MAY BE OWED ON ANY PROPERTY IN THE AUCTION ARE THE RESPONSIBILITY OF THE BUYER. ALL PROPERTIES ARE SOLD IN 'AS IS' CONDITION WITH ALL FAULTS AND DEFECTS WITHOUT WARRANTY OR GUARANTEE OF ANY KIND. AUCTIONEER MAKES NO REPRESENTATION AS TO THE FITNESS OF ANY PARCEL FOR A PARTICULAR USE. PRIOR TO BIDDING, EACH BIDDER IS RESPONSIBLE TO CONDUCT AN INDEPENDENT INVESTIGATION TO ASCERTAIN CHARACTERISTICS AND ATTRIBUTES OF THE PROPERTIES, INCLUDING BUT NOT LIMITED TO, SUITABILITY FOR ANY INTENDED USE, LOCATION, TAXES OR FEES OWED, ENCUMBRANCES, ACCESS, MINERAL RIGHTS AND WATER RIGHTS. FAILURE TO VISIT THE PROPERTIES SHALL CONSTITUTE A WAIVER. ALL BUYERS ARE ENCOURAGED TO CONSULT AN ATTORNEY PRIOR TO BIDDING. SOME PHOTOS MAY BE OF GENERAL AREA BUT NOT EXACT PROPERTY BEING SOLD.
Bidder authorizes the Auctioneer to send communications to Bidder’s mobile phone and emails regarding other land buying opportunities.
TRANSFER OF OWNERSHIP. Conveyance of properties is not completed via title insured closing. Bidder agrees and authorizes Auctioneer to act as Bidder’s agent to complete any closing documents, or any corrective documents thereafter to process the transfer. For each Lot, Bidder must provide the Deed Information: the name of the grantee and the address for the grantee. If Bidder fails to specify Deed Information within 19 days after payment of the Payment Due, Bidder authorizes Auctioneer to convey each Lot via Grant deed using the Bidder’s name and address as registered in the auction.
NO CREDIT CARD CHARGEBACKS: Each Bidder agrees to NOT, under any circumstances, initiate a credit card chargeback with respect to any charges. Bidder further agrees that if Bidder initiates a credit card chargeback, upon Auctioneer’s demand (1) Bidder shall withdraw such credit card chargeback and request the credit card issuer to re-credit all amounts to the account of the Auctioneer; and (2) Bidder shall be responsible for all costs and expenses, including but not limited to any attorney fees incurred by or on behalf of the Auctioneer, in challenging the credit card chargeback.
BIDDER’S RESPONSIBILITY: Each bid is an irrevocable offer to purchase the assets included in the Auction Lot. Bidders are responsible for all bids made using the Bidder’s account and Bidder Number. If Bidder believes that an unauthorized person has placed a bid on the Bidder’s account, Bidder must notify the Auctioneer immediately by sending an e-mail to ricopatolot@gmail.com. Bidders must also promptly report the incident to the relevant law enforcement authorities and send the Auctioneer a copy of any resulting police report; otherwise, Bidder will be held personally responsible for all purchases. BIDDER CONSENTS TO EXCLUSIVE JURISDICTION IN THE STATE COURTS OF LOS ANGELES, CALIFORNIA OR BINDING ARBITRATION AT AUCTIONEER’S OPTION AND AT BIDDER'S EXPENSE. BIDDER WAIVES ANY JURISDICTIONAL DEFENSES TO ANY SUIT FILED IN THE STATE OF CALIFORNIA. BIDDER CONSENTS TO ACCEPT SERVICE OF PROCESS VIA EMAIL OR CERTIFIED MAIL.
