Luther Bros Auction Co. LLC - Terms and Conditions
Welcome to our auction. These Terms and Conditions govern your use of our auction services, including bidding on and purchasing items through our auction. By using our auction services, you agree to be bound by these Terms and Conditions.
Registration
To participate in our auction, you must register and create an account on our auction platform. During registration, you will be required to provide accurate and complete information. By registering for our auction, you represent and warrant that all information provided by you is accurate and complete.
Bidding
All bids are final and binding. By placing a bid, you agree to pay the full amount of your bid, plus any applicable buyer's premium and other fees. NC Taxes will be added to all sales unless you have a valid TAX ID# on file with us. We reserve the right to reject any bid at any time, for any reason.
Payment
Payments will be collected through the HiBid platform via credit card after the close of the auction unless otherwise agreed upon in writing prior to bidding. If card is declined, a $10 reprocessing fee will be added to settlement, you will receive an email with link to make payment. Payments not received by 5pm EST the day after auction closes, items will be forfeited and bidder blocked from bidding with us in the future. Settlements over $1000 must be paid via cashier's check or wire transfer.
Buyer's Premium
A buyer's premium of 15% will be added to the final bid price of all items sold, unless otherwise specified. The buyer's premium is non-refundable and is subject to change at any time.
Shipping and Pickup
You will receive an automated text message after the close of the auction to choose local pick-up or shipping. You will also be available to choose your own destinated pick up time slot. This is going to reduce the waiting times for our customers and hopefully streamline the pick-up process.
PICK UP IS ON PICK UP DAY, so unless you are having items shipped, please be prepared to come at the designated time. We cannot guarantee availability of staff at any other time besides pick up times. Late pickup will be charged $5 per lot/per day for storage ($10 PER ITEM PER DAY for furniture). You are required to make contact with staff via email at Auctions@LutherBros.com if you are unavailable to pick up on pickup day and request an alternate day. We do not have space to store items, so we must move them around which uses labor and increases chances for loss and breakage. Failure to pick up items within 7 days after the auction closing time will result in items being considered abandoned. Abandoned items will become property of the auction company to be resold for storage fees without a refund. Failure to pick up items in a timely manner will result in restricted bidding privileges.
We do not provide packing material; please bring your own paper and boxes to pack up your treasures. If you purchase a larger/heavy item, please bring help to load those items as staff will not be able to assist with loading into vehicles or trailers.
Shipping
If you are requesting shipping, we use a third-party shipper for most items unless easily packaged by us. If we package and ship, a $10 handling fee will be added to each lot shipped; we will attempt to consolidate lots into as few boxes as reasonable to reduce handing fee. If lot is made up of multiple items, you will be charged $10 per box required. You will receive a text/email with link to pay shipping invoice. For lots that are taken to third-party shipper you will be charged a $10 handling fee for each lot to the credit card on file. You will be contacted by Mailbox Express with shipping invoice.
Any shipping invoice not paid within 7 days, your items will be forfeited and resold for storage fees.
Please realize that shipping can get expensive depending on item size, weight, destination, employee time to package and packing materials required.
We are not responsible for any damage or loss incurred during shipping.
Disputes
In the event of any dispute between the buyer and seller, we will act as a neutral third party and will make a final determination on the dispute. Our decision will be final and binding.
Liability
We are not liable for any damage or injury incurred during the preview, bidding, or pickup process. By participating in our auction, you assume all risks and liabilities associated with these processes.
Modification
We reserve the right to modify these Terms and Conditions at any time, without notice. Your continued use of our auction services after any modification constitutes your acceptance of the modified Terms and Conditions.
Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of North Carolina. Any legal action arising out of or in connection with these Terms and Conditions or our auction services shall be brought in the courts of New Hanover County (NC).
