A buyer's premium and tax will be added to the bid price of each asset. Washoe County's Sales Tax is 8.265% Buyer's premium is as follows:
-10% on sales from $1 to $12,500
-7.5% on sales from $12,501 - $25,000
-5% on sales from $25,001 - $75,000
$3,750 flat rate on sales over $75,001
- note, 3% will be added if paying by debit or credit card.

Terms and Conditions
Payment Methods:
-Business Check, Cashier Check, Money Order, Wire Transfer, or Credit Card.
-Sales tax will be applied to titled and non-titled items in accordance with state regulations. The applicable tax rate is determined by the physical location of the item(s).
Buyer's Premium:
A Buyer's Premium will be added to the final sale price, of each lot, according to the following sliding scale:
-10% on sales from $1 to $12,500
-7.5% on sales from $12,501 - $25,000
-5% on sales from $25,001 - $75,000
$3,750 flat rate on sales over $75,001
For payments made by credit or debit card, an additional 3% fee will be added to the invoice total. The buyer's premium is taxable on items that are subject to sales tax.
Titled Vehicles:
-Nevada residents may incur a $28.25 title fee for some or all vehicles sold at auction. Additional fees may apply due to changes in DMV regulations or other governing laws. Any such changes will be communicated at the time of auction and/or reflected in the online or onsite terms.
-Items owned by the State of Nevada, its subdivisions, or the Federal Government are exempt from sales tax. Non-government items will be taxed according to the local tax rate, unless the buyer holds a resale or dealer's license that exempts them from tax. Non-taxable items will be clearly marked.
-Vehicles will be processed in compliance with Nevada DMV laws. Buyers in other states may face different requirements, including additional title processing or branding requirements. Buyers are responsible for ensuring compliance with their state's title regulations. The auctioneer is not responsible for providing documentation for other states. Buyers are advised to conduct necessary checks (e.g., Carfax, NMVTIS reports) before bidding.
Emissions Testing:
-Stremmel Auctions is exempt from conducting emissions tests or inspections for vehicles sold at consignment auctions, per NRS 445B.770. Buyers in areas requiring emissions testing are responsible for obtaining emissions certificates prior to registering their vehicle. Any necessary repairs to meet emissions standards are also the responsibility of the buyer.
Temporary Drive-Away Permits:
-Temporary permits are available for non-Nevada residents for a fee. Nevada residents must obtain a 30-day placard or license plates from the DMV. Contact staff for more details.
Dealer-Only Items:
-Retail buyers, both in-state and out-of-state, are prohibited from purchasing dealer-only items. All dealer licenses will be verified with the appropriate governing agency. If a state requires a salesperson license, the dealer must provide the license for the individual listed on the invoice.
Payment Terms:
-Purchasers will receive a notification of their winning bid on the auction day. Invoices will be sent within one business day.
-Full payment is due within 3 business days after the sale, in guaranteed funds (traveler's checks, money orders, or certified bank checks). International buyers must wire full payment directly from their bank account to the auctioneer's account. International checks will not be accepted.
-If payment is not made within 3 business days, the buyer remains responsible for the full purchase price and applicable buyer's fee. The auctioneer may, at its discretion, apply a 2% late fee and interest at 2% per month on overdue payments. Alternatively, the auctioneer may declare the item a "No Sale" and charge a 20% restocking fee (minimum $250).
-If the Default Interest Rate is found to be excessive, the maximum rate allowed by law will apply. The buyer will also be responsible for any storage, towing, legal fees, and other costs incurred by the auctioneer due to enforcement actions.
Storage & Gate Fees:
-A $25 per item, per day storage fee will begin accruing 10 calendar days after the sale date. Additional gate fees may apply at certain locations. Removal must be scheduled at least 24 hours in advance, and storage fees must be paid prior to removal. Items will be considered abandoned after 30 calendar days.
Online Auction Terms and Conditions:
These terms apply to all bidding at any Stremmel Auctions event, including live, timed, or online auctions. By participating, you agree to abide by these terms. Bidding is prohibited for anyone under the age of 18. The highest accepted bid at a live or online auction constitutes a binding purchase agreement.
Auctioneer:
-The auctioneer for items located at certain sites will be "Associates" and for other sites, "Exchange" will be the auctioneer. Associates may engage third-party services for online platforms, invoicing, and other necessary operations.
No Warranty; AS-IS/WHERE-IS Sales:
-All auction items are sold "AS-IS, WHERE-IS," without any warranties or representations, including those related to merchantability or fitness for a particular purpose. Descriptions are for identification purposes only and do not guarantee item condition or functionality.
Inspections:
-The auctioneer and seller are not responsible for any pre- or post-sale inspections. The conditions of auction items are based on visible observations made at the time of inspection and are subject to change. The buyer is solely responsible for inspecting items, especially equipment with complex mechanical systems, before bidding.
Fees and Taxes:
-Transaction fees may apply to each item purchased, as outlined in the auction details. California residents will be charged sales tax and transfer fees for titled items, while out-of-state buyers may qualify for tax refunds with appropriate documentation. Sales tax for non-titled items will be collected according to local regulations. Buyers must provide necessary exemption documents within 10 business days to process a refund.
Vehicle Titles:
-Auctioneer guarantees free and clear title for each vehicle after full payment. Any delays in title transfer will not hold the auctioneer liable for damages. The auctioneer acts solely as an agent for the seller and does not assume ownership of auction items.
Title Request:
-To receive a title, the buyer must complete a Title Request Form within 3 days of the auction's close. If no form is submitted, the title will be issued in the buyer's registered name and address.
Online Bidding:
-Online auctions will be powered by HiBid. All bidders must register with HiBid before participating. Purchasers are bound to the same terms as in a live auction, with the binding agreement established when the auctioneer accepts the winning bid.
Live Auctions:
-The Auctioneer shall designate the Purchaser after each item of merchanides is auctioned. If a dispute arises between two or more bidders, the Auctioneer reserves the right to re-open bidding. The Auctioneer's designation of a buyer shall be final.
Bidding Terms:
-Winning bids create a binding purchase agreement between the buyer and seller. The auctioneer reserves the right to void or reject bids made in bad faith or due to errors. The auctioneer also reserves the right to cancel or postpone any auction without liability.
REMOVAL, LOADING, SECURING, AND TRANSPORTING OF AUCTION ITEMS
a. Removal of Auction Items
The Purchaser is solely responsible for the removal of Auction Items from the auction site. The Auctioneer is not liable for any damages, losses, or claims arising from the Purchaser's removal of Auction Items, regardless of whether the Auctioneer owns the auction site. All Auction Items must be removed within ten (10) calendar days of the Binding Obligation's completion. Failure to do so will result in a storage fee of $25.00 per day, per item. The storage fees must be paid in full before removal. A "paid in full" receipt is required for item pickup, and in some cases, the Purchaser will need to sign a Delivery and Acceptance Certificate, indicating that the Purchaser has accepted delivery of the Auction Items. Upon signing the Certificate, the Purchaser is considered to have taken possession, regardless of whether the items are picked up in one or multiple trips. Additional gate fees may apply at specific locations. If the Auction Item is not removed within thirty (30) calendar days of the Binding Obligation's completion, the Auctioneer will consider the item abandoned. The Auctioneer will assume ownership and determine the appropriate course of action, which may include:
-Moving and disposing of the Auction Item,
-Scrapping the Auction Item, or
-Re-listing the Auction Item for resale on the Auctioneer's platform, where the Auctioneer retains all resale proceeds.
b. Loading, Securing, and Transporting Auction Items
1. The Purchaser is responsible for the loading, securing, and transporting of Auction Items. The Auctioneer is not liable for any damages, losses, or claims arising from these actions. The Purchaser agrees to indemnify the Auctioneer for any related damages. The Purchaser must comply with all applicable laws, regulations, and requirements regarding licensure, vehicle operation, load securement, and transportation.
2. The Purchaser is responsible for ensuring that all individuals transporting the Auction Items possess the necessary qualifications, licenses, and permits to do so. If a Commercial Driver's License (CDL) is required, the Purchaser must ensure the transporter holds the appropriate CDL and endorsements. The Purchaser is also responsible for inspecting the vehicle and load combination in compliance with 49 C.F.R. § 392.7.
3. These responsibilities cannot be transferred to a third party. If the Purchaser uses subcontractors to assist with removal, they must ensure that these subcontractors are qualified, licensed, and comply with all requirements stated herein. The Purchaser remains fully responsible for the actions and omissions of subcontractors.
4. At some locations, the Auctioneer may offer assistance with loading, but this does not reduce the Purchaser's obligations to ensure proper loading, securing, and transportation in compliance with applicable laws.
5. For the purposes of this section, "Auctioneer" refers to Associates, Exchange, Seller, the Site Owner, and their respective officers, directors, employees, and affiliates.
ATTENDANCE AT AUCTION SITE
Attendees at the auction site acknowledge the inherent risks associated with being on the premises, including the presence of hazardous materials and heavy equipment. The Purchaser and their agents are at the site at their own risk, and the Auctioneer is not liable for injuries or property damage occurring at the site.
ADDITIONAL TERMS
Auction Items may be added or changed during an Auction. The Auctioneer does not guarantee the accuracy of descriptions, which are only provided as a guideline. To access an auction site and/or remove Auction Items, all agents, representatives, or contractors of the Purchaser must sign the Stremmel Auctions Site Access Release and Waiver of Liability, Assumption of Risk, and Indemnity Agreement. Any individual refusing to sign this agreement will be denied access to the auction site. The Auctioneer is not responsible for delays or costs incurred due to failure to sign the required agreement.
AVAILABILITY OF ONLINE MARKETPLACE
Purchasers participating in Online Auctions acknowledge that the Auctioneer cannot guarantee the continuous operation of its online marketplace. The Auctioneer is not liable for any issues resulting from outages, failures, or delays on its platform.
COMMUNICATION AND INFORMATION SHARING
The Purchaser authorizes the Auctioneer to contact them via phone, email, or text and share information with the original equipment manufacturer (OEM) regarding the Auction Items purchased. The Auctioneer is not liable for any claims arising from such disclosures.
ASSUMPTION OF RISK; WAIVER; INDEMNITY
Risk of loss or damage to an Auction Item transfers to the Purchaser immediately after a Binding Obligation is established. Purchasers are responsible for insuring their items and assume all liability for damage, loss, or theft. The Auctioneer and Site Owner are not liable for such incidents, except in cases of gross negligence or willful misconduct. The Purchaser agrees to indemnify and hold harmless the Auctioneer, Site Owner, and related parties from any claims or damages arising from the Purchaser's actions.
CLASS ACTION/JURY TRIAL WAIVER
The Purchaser agrees to resolve all claims individually and not as part of a class or collective action. Both the Purchaser and Auctioneer waive their right to a jury trial and agree to bring claims only in the appropriate courts in Alabama.
GOVERNING LAW AND JURISDICTION
These terms are governed by Nevada law, and any disputes will be resolved exclusively in the courts located in Washoe County.
