Terms and Conditions - Welcome to our auction! These Terms and Conditions govern your use of our auction services, including bidding on and purchasing items through our auction. By using our auction services, you agree to be bound by these Terms and Conditions.
Registration - To participate in our auction, you must register and create an account with HiBid.com. During registration, you will be required to provide accurate and complete information. *All Bidders are required to be ID verified to bid by registering with a valid credit or debit card. By registering for our auction, you represent and warrant that all information provided by you is accurate and complete.
Bidding - All bids are final and binding. By placing a bid, you agree to pay the full amount of your bid, plus any applicable buyer's premium and other fees. All items will be sold "as is - where is" with no physical warranty express or implied. The auction company makes every effort to take multiple pictures, note defects, note dimensions of items, and provide as much information as possible to ensure confidence in bidding. Please call the Seller with any questions or concerns before bidding on any items. The auction company is not responsible for items with defects, confusion of the size of an item, or any other characteristics of the items offered for auction. NC Taxes will be added to all sales unless you have a valid TAX ID# on file with us. We reserve the right to reject any bid at any time, for any reason. ALL SALES ARE CONSIDERED FINAL. ALL SALES ARE 'AS IS, WHERE IS'. NO REFUNDS. NO EXCHANGES.
Payment - Upon close of auction you will be invoiced via the email address you registered with. Payment with cash, card, or certified check must be made within 48 hours of receiving invoice. Any declined credit card payment will have 2 days to contact our office at 828-855-4285 to pay with Cash. A $30.00 decline fee will be enforced, no matter what reason card was declined. If payment is not successfully received within 2 business days, your item(s) will be forfeited, you will no longer be authorized to bid at McGee’s Market and Auction, and negative feedback will be applied to your account.
Buyer's Premium - A buyer's premium of 10% will be added to the final bid price of all items sold, unless otherwise specified by lot. The buyer's premium is non-refundable and is subject to change at any time.
Pickup - Local pickup is available by appointment during business hours Monday through Friday, and half of Saturday, at our location in West Jefferson, NC 28694. We cannot guarantee availability of staff at any other time besides pick up times. Late pickup will be charged $10 per lot / per day for storage. You are required to make contact with staff via phone and email provided by lot, If you are unavailable to pick up on appointed day and need to request an alternate day. Alternate day/time will be based upon availability of staff. We do not have space to store items, so we must move them around, which uses labor and increases chances for loss and breakage. Failure to pick up items within 14 days after the auction closing time will result in items being considered abandoned. Abandoned items will become property of the auction company to be resold for storage fees without a refund. Failure to pick up items in a timely manner will result in restricted bidding privileges. Buyers purchasing large or heavy items, MUST bring appropriate vehicles and sufficient help to load.
Delivery – Certain items can be considered for delivery to certain locations. If you would like to be considered for delivery, you are required to make contact via email. We are not responsible for any damage or loss incurred during delivery.
Disputes - In the event of any dispute between the buyer and seller, we will act as a neutral third party and will make a final determination on the dispute. Our decision will be final and binding.
Liability - We are not liable for any damage or injury incurred during the pickup process. By participating in our auction, you assume all risks and liabilities associated with these processes.
Modification - We reserve the right to modify these Terms and Conditions at any time, without notice. Your continued use of our auction services after any modification constitutes your acceptance of the modified Terms and Conditions.
Governing Law - These Terms and Conditions shall be governed by and construed in accordance with the laws of North Carolina. Any legal action arising out of or in connection with these Terms and Conditions or our auction services shall be brought in the courts of Wilkes County (NC)
