On-Line Only Auction: Online from 12:01 p.m. CDT, Wednesday, August 14, 2024 to 7:00 p.m. CDT, Thursday, August 29, 2024. Please note: with online bidding, we will be utilizing a soft close which means if anyone bids with a minute or less remaining, the auction will continue until no more bids are received. SELLERS RESERVE THE RIGHT TO ACCEPT OR REJECT ANY AND ALL BIDS.

Registering to Bid: Prospective Buyers register to bid by going to Menke-Auction.hibid.com and when successfully registered, they agree to all the Terms and Conditions of the Auction. Prospective Buyers must be registered online by no later than 5:00 PM CDTon Wednesday, August 28, 2024 to ensure bidding approval.
Opening Bid: The opening bid is $250,000.
Purchase Agreement: Successful bidder will enter into a purchase agreement immediately after being declared the winning bidder by the Auctioneer. PLEASE NOTE: The purchase agreement will offer NO CONTINGENCIES for financing, property condition, or any other alterations to the agreement. Property is being sold "AS IS". Prospective Buyers are urged to inspect the property prior to the auction date to their own satisfaction. SELLERS RESERVE THE RIGHT TO ACCEPT OR REJECT ANY OR ALL BIDS.
Earnest Deposit: Successful bidder will provide a $50,000 Earnest Deposit on the day of the auction with the balance due at closing. Earnest deposit will be held in the Trust Account of Ambassador Title Services.
Future Subdividing: Any future subdividing of this property is subject to Pottawattamie County and City of Council Bluffs guidelines and discretion. BUYERS ARE URGED TO CONTACT BOTH OF THESE ENTITIES TO DETERMINE FUTURE DEVELOPMENT REQUIREMENTS TO THEIR OWN SATISFACTION.
Title Insurance: Title Insurance provided through Ambassador Title will be used to provide Free & Clear title to the property with the cost of the Title Insurance to be split 50/50 between the Buyer and Seller.

Closing: Closing to be on or before September 30, 2024. Closing to be conducted by Ambassador Title Services with the cost to be split 50/50 between the Buyer and the Seller.
Possession: Possession will be conveyed at Closing.

Easements: Sale is subject to all Easements and Right of Ways of record.
