1. REGISTRATION: In order to participate in Atlanta Bid Auction Company, LLC auctions you must first register. Upon registration, we will validate your credit card by placing a $1.00 (one dollar) hold. The $1.00 (one dollar) is not charged, while it may appear as a pending transaction on your account it is released at the conclusion of the auction. It will not be applied toward your purchases, nor will you be penalized if you do not make any purchases.
2. This is an ONLINE ONLY AUCTION. You may inspect items in person during the scheduled onsite inspection dates however all bidding must be placed online.
3. All items are sold AS IS, WHERE IS, with NO WARRANTY expressed or implied. Descriptions are made in good faith and believed to be accurate, but not guaranteed. All dimensions and quantity counts are approximate. Personal Onsite Inspection is ALWAYS recommended. It is the buyer's sole responsibility to determine condition and suitability prior to bidding. When you are not certain of the condition or use of an item please do not bid.
4. ONSITE INSPECTION DATES: Monday, February 12 between the hours of 11:00 A.M. - 2:00 P.M
5. BUYERS PREMIUM: A 15% buyer's premium will be added to each purchase, Example: For a high bid of $100, a 15% buyer’s premium of $15 will be added making the purchase price $115.
4. SALES TAX: Applicable sales tax will be charged for total amount on items purchased.
5. RESELLERS: If you are buying for the purpose of resell a copy of your sales tax certificate and a completed ST-5 form must be provided 48 hours prior to the auction closing NO EXCEPTIONS. Email documents to Robinhuffauctions@gmail.com
6. PAYMENT: Your credit card on file will be automatically charged for your full invoice amount shortly after the conclusion of the auction. A paid invoice will be sent to your email on file. NOTE: Purchases over $2,000 may require a cash payment or bank wire transfer at the sole discretion of auctioneer.
7. NO SHIPPING: WE DO NOT SHIP! Local pick up only. It is the buyers responsible to remove all purchases in the timeframes specified.
If a buyer chooses to make an arrangement for a moving or shipping company to pick up their purchases, you must notify the auction company in advance and ensure the moving / shipping company has a copy of your paid invoice upon arrival.
8. SOFT CLOSING: The online auction will close 1 item per minute in numerical order. This feature, in concert with the Bid Extension feature, closely emulates a 'live' auction.
9. BID EXTENSION: The closing time of an item is automatically extended an additional 3 minutes whenever a bid is placed within 3 minute of the item's closing time. FOR EXAMPLE: if an item is set to close at 2:00pm, and a bidder places a bid on the item at 1:59 pm, the item's closing time will be extended to 2:03 pm. If another bid is placed at 2:01pm, the item's closing time will be extended to 2:04 pm, and so on. It is therefore important to monitor items you’re bidding on as the auction is closing to ensure you remain the high bidder.
10. WINNING BIDDER NOTIFICATION: Winning bidders will be sent an electronic PAID invoice by email ONLY shortly after the conclusion of the auction. This email comes from HiBid, the online bidding software, please remember to check your email including spam / junk folders for your paid invoice.
11. CLAIMS AND RECOVERY: In the rare event an item is not available for pickup a refund of the purchase price will be given. Auction Company's liability is limited to the amount of the purchase price paid.
12. PURCHASE REMOVAL DATE: Friday, February 16 10:00 A.M. - 3:00 P.M.
IT IS THE BUYERS SOLE RESPONSIBILITY TO BRING ALL LABOR, TOOLS AND MATERIALS NECESSARY TO REMOVE THEIR ITEMS. After the scheduled removal, items will be considered abandoned, and you will be charged a removal fee for disposal of your items. The Auctioneer will have the option of reselling, removing, storing or abandoning, at the expense and risk of the purchaser, items not paid for and/or removed within the specific time. The buyer agrees to pay all deficiencies, legal, collection; transportation and storage expenses associated with delinquent accounts or abandoned items.
RISK AND LIABILITY: Buyers assume all risk and liability of any and all accidents, injuries or claims incurred on the premises where the auction is held and agrees to hold Atlanta Bid Auction Company harmless against any and all accidents, injuries or claims.
15. CHOOSE WISELY: We want everyone to get a good deal, and most will. However, when you bid on the wrong item or decide an item is not suited for your intended use, our clients are not willing to assume the cost of your mistakes. When in doubt about condition, completeness or suitability for intended use, please bid accordingly.
16. CERTAIN RIGHTS RESERVED: The Auctioneer reserves the right to add or remove items from the auction, cancel, suspend, extend or reschedule an individual item and/or auction event, make changes to the auction closing times or inspection or removal times.
17. ARBITRATION: Any controversy or claim arising out of or relating to this contract and/or agreement, or breach thereof, shall be settled by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, and judgments upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Venue will be Gwinnett County Georgia.
18. LIABILITY: Auctioneer’s and Seller’s liability shall be limited to the refund of bidder’s purchase price. By registering and participating in this auction, you specifically disclaim any other claim available at law or in equity.
19. LIMITATIONS: The above stated Terms cannot be altered except in writing by the Auctioneer.
