Terms and Conditions - By participating in this Auction each bidder agrees to the following. This auction is open to Ontario residents only. A valid credit or debt card is required to register. REGISTRATION: At the time of registration, we ask you to kindly provide a bit of personal information along with a credit/debit card so we can verify your identity to ensure you are a qualified buyer. All bidders must be of legal age to bid. If you intend to pay for your order by E-Transfer, a credit/debit card must still be on file. If E-Transfer is not received by 3pm the day following the auction, the credit/debit card on file will be charged. By registering for this auction you agree to receive emails sent to registered bidders for the auction you register as well as any future auctions. PAYMENT: There is no cost to register for our auction (Up to $1 may be charged to validate your card by Auctionflex the first time you register). We accept all major credit cards and E-Transfer payments. Invoices will be sent out and payment will be processed the morning after the auction closes. Winning bids will be charged to the card posted following the auction sale unless E-Transfer was mentioned at registration. E-Transfer payments must be received no later than 3:00pm EDT the day following the auction otherwise the credit card on file will automatically be charged. In the event Payment is not received for a winning bid during the allotted time, we will charge a 25% restocking fee (or $25, whichever is greater) and your account will be suspended. All restocking fees along with a $20 admin fee must be paid in full to reinstate your account. Items will be considered abandoned and placed back on the auction block for sale. By registering, you give Stuff 4 My Life permission to charge these fees to the credit card you have registered with. If we are unable to charge the restocking fee the amount will be reported to the Credit Bureau. BUYERS PREMIUM AND HST: ALL winning bids will be charged a 7% Buyer's Premium and 13% HST REGARDLESS of the item. If an item is in any part tax exempt, bidders may keep their invoice and claim the exemption on their income tax. Full buyer's premium and full HST will be charged on all items. Bidders should factor this into their bid price. REVIEW YOUR BIDS: During an auction you can check the status of your bids at anytime. Note that no bids can be withdrawn after they are placed for any reason including accidental bids and bidding on the wrong item. Be careful when bidding, ensure you have selected the correct item before clicking "bid". All items are sold as is, where is, with all faults with no guarantees that any item is fit for a particular use. All bids are legally binding and enforceable in Ontario, Canada. BIDDING NOTIFICATIONS: You can choose to be notified by e-mail during the auction if you have been outbid. Please note that outbid notifications are NOT sent out during the last two hours of the sale. WINNING NOTIFICATION & INVOICING: All winning bidders will be sent an e-mail invoice the day following the auction. If you do not receive an invoice please check your junk mail or contact us at “email here”. Even if you do not receive an invoice, you are still responsible for payment as stated in the auction. You can verify winning bids by logging into your account after the auction closes and checking each lot you placed bids on. If the lot says "Status", you have won. If it says "Outbid" you have not won. Shipping/Delivery: This Auction is “Shipping Only”. A $10 flat rate Shipping fee will be applied to each invoice with a delivery address within the list of GTHA postal codes listed below. Any winning bids outside this delivery area will be charged the $10 flat rate delivery fee plus $0.29/km from our Burlington facility to your door and will be listed on your final invoice. All shipping fees are the full responsibility of the winning bidder and are non negotiable. All items will be delivered to winning bidders address on file within 7 days of auction closing through our local courier partner. Although winning bids will usually ship within 2-3 business days once payment is received. Email update will be sent out once shipments are prepared updating the buyer on estimated date and time of arrival. We ask that you have someone available at your delivery location to sign for items at time of delivery to ensure a safe and secure delivery. If delivering to an apartment/condo building you will need to provide access code contact and apartment numbers so courier can contact you to deliver to your door upon arrival. In the event NO ONE is available during delivery, please provide a safe secure alternative location to leave items as we do not offer delivery insurance and Stuff 4 My Life or it’s associates can not be held accountable for what happens to items once they are dropped off and delivered. CONDITIONS OF ITEMS SOLD: Our best efforts are made to represent all items accurately in descriptions and photographs; however, all items are ultimately sold on an 'as is, where is' basis, with all faults. We strongly encourage all bidders to personally verify the condition of each item through careful observation of all pictures and descriptions or by contacting us with any questions. No responsibility is assumed by the auctioneer or the seller for any errors or omissions. Any prices referenced are MSRP (Manufacturers Suggested Retail Prices). CREDIT: By allowing you to bid we are extending you credit with the condition that you agree to pay for your items during the times posted using the payment terms specified. Failure to do so is a breach of the credit terms we have entered and can result in negative credit reporting and collections. By registering, you give Stuff 4 My Life permission to charge the credit card on file as per the payment terms stated within the auction. Bids are not revocable and are legally binding agreements between the seller and the buyer. MISSING LOT: Unfortunately with large online sales, items can go missing or be damaged from time to time. In the event that an item you had a successful bid on can't be located, your sole remedy is a refund of that item. No additional costs or expenses whether direct or indirect can be claimed for that item. No other items from your bill may be canceled as a result of the missing or damaged item. SITE OUTAGE: In the event of an outage that affects bidding at any time during the closing of a sale, Stuff 4 My Life at our discretion may extend the auction in it's entirety or in part (including lots that may have already closed) for a period of up to 24 hours. This decision will be made based on the severity of the outage. Previously closed items may be extended as there is no 100% way to determine that they closed prior to the outage and that all bidders who intended to bid were able to bid . This is an extremely rare occurrence but in the event that it happens we need to be fair to all bidders (including those who may not have been able to bid). CLAIMS/RETURNS: All items are FINAL SALE and sold AS IS, however Stuff 4 My Life may accept returns at our discretion if we have made an error in the listing. To be considered for a return, customers must email stuff4mylife@gmail.com WITHIN 24 HRS of receiving the item. A detailed description of the reason for requesting the return including any pictures will be required. If approved, the item MUST be returned to our Burlington facility at the buyers expense by mail or in person by appointment only. A bidding credit will be placed on your account to be used in future auctions. (No cash refunds will be given in any circumstance). Stuff 4 My Life WILL NOT accept any returns after the 24 HR window required to report any issues, defects or errors. There will be NO EXCEPTION to this. Customers are recommended to inspect their items THOROUGHLY upon receiving them even if they are a gift for someone else or plan on being used at a later date. Bidders are reminded that all goods are sold on an 'as is, where is' basis, with all faults, so check all pictures and descriptions carefully and bid accordingly. PERSONAL & PROPERTY RISKS: Stuff 4 My Life, the Seller and their associates will not be liable for damage or injury to individuals or their property. ADDITIONS & DELETIONS: We reserve the right to remove and/or add lots and/or items to the sale at any point during the auction. BUYERS: All bidders/buyers must be of legal age and a resident of Southern Ontario. The BUYER expressly agrees to indemnify and save Stuff 4 My Life, the Seller and their associates harmless from and against all claims, losses, expenses, damage or liability, directly or indirectly caused by or resulting from an act, including the negligent acts or omissions of the seller, or anyone acting in his/her behalf in connection with or arising out of the auction. RESERVE: Seldom are items sold with Reserve. If an item is being sold with a reserve, it will be clearly marked and identified. For items sold with a 'reserve', you will be required to pay a minimum amount in order to win the item. AUCTION RECORDS: In the unlikely event of a dispute, you agree to accept as true the information that we have in our records. SOFT CLOSE: Items close at regular intervals. To prevent a bidder from 'sniping', all bids made in the last minute of the auction will force an item to stay open for an additional 2 minutes. This will continue until all bidding has ceased. STRATEGY: Bidding is similar to Ebay type auctions, we recommend that ALL BIDDERS put in their maximum bid when placing a bid online. This does not mean you will have to pay the amount you bid; you only pay one bid more than the next highest bid, and only up to your maximum bid. The software system will play out the bids as you would at a live auction and only uses the funds required to beat out the under-bidder at the prescribed bid increment. CATALOG ERRORS & OMISSIONS: If a description does not match a picture in a lot, the description takes precedence. All items are sold on an 'as is, where is' basis, with all faults. In the event an item was listed in error or an item can't be located during pick up for any reason, the bidder agrees that their maximum recourse is a full refund of the item in question and that all other items bid on remain payable. Items approved for a refund are returned at the buyers expense. IT IS THE BUYERS RESPONSIBILITY TO CHECK THEIR ITEMS UPON RECEIVING THEM! LIMITATION OF LIABILITY: You expressly understand and agree that Stuff 4 My Life and it's associated shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses, resulting from: (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; or (v) any other matter relating to the service.
