Bidder Contract Terms & Conditions:
-Upon registering to bid, all bidders check the box that acknowledges that they have read and accepted all the following terms and conditions.
-All bidders agree to be bound by this contract in order to bid
-Bidders and buyers agree to all the following:
1) SALES TAX:
---Sales tax will be added to invoice unless you have provided us with both of the following on a yearly basis
---“Texas Sales and Use Tax Resale CERTIFICATE FORM” found here (https://tinyurl.com/588jh7tt)
---A copy of your “TExas Sale and Use Tax PERMIT”
2) TERMS OF SALE:
---All items are sold as is-where is, no warranty or guarantee of any kind.
---All sales are FINAL! No charge backs are allowed.
---All descriptions are believed to be accurate, however, all bidding and buying is based solely on the bidder's personal inspection and/or opinion of the items.
3) TERMS OF BIDS:
---All bids are a binding contract. Bidder agrees that by placing a bid on any item they are bound by this bidder's contract & agreement for auction terms and conditions.
---Bidder acknowledges that once a bid is offered, the bidder shall be bound by the bid amounts.
---Bids cannot be withdrawn or retracted.
---Verify your information entered (ie: bid amount) before submitting your bids.
---Bidders agree that by placing a bid on any item they are bound by this bidder's contract and agreement for auction terms and conditions.
---LL Auctions reserves the rights to relist items that were abandoned
4) BIDDERS RESPONSIBILITY:
---Perform all inspections of the items and to be satisfied as to its description, condition and/or authenticity prior to bidding.
---Independently verify any information they deem important including information available.
---Inspect all items prior to bidding. Failure to inspect the property does not relieve the bidder of responsibility for payment and removal as stated in these terms.
---Verify all information contained in the item description and all promotional materials, including, but not limited to, photographs, dimensions, conditions, etc. These were provided by or on behalf of the seller and are believed to be correct; however, neither the seller or the auction company makes any promise, representation, guarantee, or warranty as to the accuracy or completeness of such information.
5) PICK UP TERMS:
---Buyer is responsible for providing the supplies (boxes, packing material, tools & equipment, etc.) necessary to pick up their items won
---Buyer is responsible for the physical labor for dismantling, rigging, crating, loading, hauling, carrying and lifting of any items that they have purchased at their own expense and risk.
---LL Auctions is NOT responsible for any damage during loading, packing, removal or transport.
---Auction staff DOES NOT provide load out help on pick up and removal date.
---Any items not picked up on pick-up dates listed (Friday and Saturday following the close of the Auction) will be considered abandoned and resold or donated.
---If items are held they will incur a storage fee.
---Pick up and removal is strictly enforced by the Saturday after the Auction closes. If you cannot pick up and pay for your items by these terms, please DO NOT bid!
---Aany items remaining after pick up day (either paid or unpaid), will be considered abandoned and forfeited, but the buyer is still under contract to pay.
---If you are not able to pick up your item by the Saturday after the Auction closes, please request shipping or delivery (fees apply for both). We cannot ship large items. Please see the “shipping” tab for more detailed information.
---You may designate someone else to pick up their items for them. They will need to bring a paid copy of the buyer’s invoice with them.
-The earliest day to pick up items is Friday at 10 am
6) BIDDING SOFTWARE/PLATFORM TERMS:
---Items are subject to additions/deletions prior to sale time/closing at the discretion of the auctioneer.
---In case of any errors or malfunctions of hardware or software, LL Auctions reserves the right to cancel any transaction, even if you have received confirmation of the transaction by email.
---We, at LL Auctions, strive to make this system and your experience bidding on this site as stable as possible, however errors and equipment malfunctions are possible and may happen without notice.
---We cannot and will not guarantee uninterrupted access to this site or its services.
---LL Auctions makes no warranty that (a)your use of this site will be uninterrupted, timely, secure or error-free, (b) the results that may be obtained from the use of the site will be accurate or reliable, (c) the quality of any information or other material obtained by you through the site will meet your expectations, (d) the use or the inability to use the site, unauthorized access to, or alteration of, your transmissions or data; statements or conduct of any third party on this site; or any other matter relating to this site.
7) PREVIEW TERMS:
---Individuals previewing items are personally responsible for any breakage/damage to items they are handling and will be charged an appraised value for item(s) you break.
---All previewers assume all responsibility for their own safety.
---Auctioneer and seller ARE NOT responsible for accidents.
---Preview at your own risk.
8) FIREARM TERMS:
---Firearms can only be previewed BY APPOINTMENT ONLY at the FFL dealer’s location, not at LL Auction’s Warehouse
---Legally, the name of the registered bidder will be the name that the gun has to be registered under.
---After the close of the auction and within 7 day, please schedule a time BY APPOINTMENT ONLY to pick up/ship the firearm at the FFL Dealer location listed in your item's description [Either 3RD COAST ORDNANCE, LLC. (12002 TX-146, San Leon, TX 77539) or BAY AREA FIREARMS (410 Schilling Ave A, Baytown, TX 77520)].
---After 7 days, the firearm will be considered abandoned. All local, state & federal gun laws apply.
---The winning bidder must bring valid driver's license that matches the name on the invoice to complete the FFL Paperwork & background check
---The winning bidder must pay a $25 FFL transfer fee upon pick up to cover any handling, transfer feeds or background check
---Shipping available; must be directly to another FFL dealer; arrangements & details determined directly with the FFL Dealer
---Firearms are not checked or certified by a gunsmith. Buyer must inspect firearm prior to use; LL Auctions is not liable
---If you are not supposed to own/possess a firearm or for any reason cannot pass any required background check, please do not bid.
---There is no refund if you are unable to meet these requirements.
9) JEWELRY TERMS:
---Unless noted as appraised:diamonds and or gemstone ct weights are approx. or per info on receipts/tags/markings etc.
---Unless jewelry is specifically listed as tested, we did not test.
---As always we recommend that you preview to form your own independent opinion.
---Markings on jewelry do not guarantee authenticity, it is the bidders responsibility to form their own opinion as to authenticity.
---Please request shipping through replying to the email that your invoice is sent
---LL Auctions is not responsible for shipping damage.
---If insurance is added, it is the responsibility of the buyer to file damage claims
---If shipping is requested, all shipping costs under $50 will automatically be shipped the most economical way possible. Shipping cost above $ 50 will be confirmed prior to shipping.
--Buyer is aware that we cannot combine invoices for different auctions.
--Buyer is aware that we will process your payment unless you notify us that you will be paying with cash.
--MasterCard, Visa, American Express, or Discover are accepted.
---Buyer is aware of the 2.5% processing fee that is added to purchases over $500
