All processing fees are non-refundable and are due and payable upon the acceptance of the winning bid within 24 hours of Notice of the winning bid. • The winning Bidder/Buyer will be contacted by BIDITHOMES and will give Notice to the Bidder/Buyer to agree to sign a copy of the Agreement of Purchase and Sale (APS) by the Seller and Buyer. All bids must have an irrevocable date of 27 MARCH 2023 to be considered. The (APS) is to be signed &returned within 24 hours of receiving Notice of the winning bid. • It is also agreed and acknowledged by the Bidder/Buyer to pay a 4% processing fee from BIDITHOMES stated in the ‘Schedule A’ of the (APS) to include funds drawn on a lawyer’s trust account in the form of a bank draft, certified cheque or wire transfer using the Large Value Transfer System payable to Action Auctions Inc within 12 hours of submitting their signed and executed (APS). • As a condition of registration, all prospective bidders agree that they have the capacity to independently enter a bidding contract with Bidithomes on any purchases made. We require each registrant to have reached the age of majority and acknowledge that they are at least eighteen years of age. Remember that when you register for a Bidithomes Soft Close Sale that your registration name will appear on the invoice when or if you make a purchase. NO INVOICE DETAILS or BIDDER REGISTRATION INFORMATION will be changed or altered after the fact, in any way, period. Once your online bidder registration e-form has been completed online in full and submitted, and you have been approved to bid. BIDITHOMES (Auctioneers) reserve the right to accept; approve any registration, refuse any registration for placing a bid and/or revoke at any time without any written or verbal reasons. This includes the right to pause/stop/end the sale before the posted soft close date and time for any reason without notice. 3. The bidders/buyers password, along with an email address or user name will allow you to log into our BIDITHOMES sale and place your bid amount. The Bidder/Buyer are 100% responsible, BIDITHOMES does not have access to any of this information. 4. A four percent (4%) processing fee is in effect on all item(s) at every sale. Please note that the processing fee a taxable service and a cost of the processing of the online sale. 5. The winning Bidder/Buyer will be contacted by BIDITHOMES and will give Notice to the Bidder/Buyer to sign a copy of the Agreement of Purchase and Sale (APS) by the Seller and Buyer. The (APS) is to be signed and returned within 24 hours of receiving Notice of the winning bid. 6. It is also agreed and acknowledged by the Bidder/Buyer to pay a non-refundable 4% processing fee plus HST payable to BIDITHOMES stated in the ‘Schedule A’ of the (APS) to include funds drawn on a lawyer’s trust account in the form of a bank draft, certified cheque or wire transfer using the Large Value Transfer System payable to Action Auctions Inc within 12 hours of submitting their signed and executed (APS). 7. BIDITHOMES will accept e-transfers, wire transfer, or bank drafts only. No debit cards or credit card payments will be accepted. 8. All registered bidders/buyers will be held personally liable and financially responsible for any and all bids placed with their respective "Bidding Number". By you the Bidder/Buyer of accepting and acknowledging BIDITHOMES Terms and Conditions of Sale, you have agreed to pay the bid amount, in addition to the processing fee plus HST, within the timeline dictated by BIDITHOMES. Bidders/Buyers may be exempt from certain taxes, if so they must provide appropriate proof to BIDITHOMES that they have an exception status for that item(s). 9. Any cataloguing or any description of any asset and/or lot(s) is merely a guide and may contain errors or incorrect information. The Auctioneer; Action Auctions Inc, BIDITHOMES makes NO representation whatsoever with respect to any degree of accuracy as it pertains to the year; odometer and/or hour meters that may be indicated on any lot. NO sale shall be invalidated by reason of any defect or inaccuracy in any of the lots. BIDITHOMES maintains the right to add or delete any lots during the sale. 10. When you place a bid on an item(s) in the sale, and becoming the high (or winning) Bidder/Buyer, you have agreed and acknowledged that you have entered into a legal binding contract with BIDITHOMES for the purchase of the specific lot(s). 11. Any asset in this online sale has a specific time when the bidding will soft close. You must ensure that you check the soft closing times on the item(s) you wish to bid/buy on. 12. This is a soft close auction which makes the bidding process fair and fully transparent. If the reserve has not been met by the soft close date and time, the date/time will be extended for 14 days. The Auctioneer will announce the winning bidder at the end of the sale. This is referred to as a "soft close" or bid extension. 13. All sales are final. All purchased assets and/or lot(s) must be paid in full. The Bidder/Buyer agrees and acknowledges that all item(s) offered are strictly sold on an "AS IS" basis. BIDITHOMES will not warranty or guarantee any item(s) in the sale. All item(s) purchased must be removed by the date and time stated by BIDITHOMES. No item(s) will be removed by the Bidder/Buyer without full payment being made and an appropriate release is obtained by the Bidder/Buyer. 14. Any Vehicles are sold "As Is, Where Is". An "As Is" vehicle is by definition not in a roadworthy condition, mechanically sound or maintained at any guaranteed level of quality. The vehicle may not be fit for use as a means of transportation and may require repairs at the buyer's expense. It may not be possible to register the vehicle to be driven in its current condition. All bidders/buyers must inspect the vehicles and equipment to their own satisfaction before bidding. All vehicles are sold without warranty or guarantee and with all defects as presented to the Bidder/Buyer. All risk associated with the purchase lies with the Bidder/Buyer. BIDITHOMES will not be held accountable for any discovered defect. BIDITHOMES will be guided by the rules and governance of the Ontario Motor Vehicle Industry Council (OMVIC). 15. All item(s) purchased by the Bidder/Buyer are the responsibility of the Bidder/Buyer and must be removed by the Bidder/Buyer. BIDITHOMES will not assist with the loading of any items. No machinery is available to be used for loading purchases. If you do not bring adequate assistance for loading your purchases you will be required to reschedule your pick-up appointment. 16. No person shall bid/buy on any lot for which they are the consignor or an agent or associate of the consignor, period. 17. This catalogue is purely a guide. It is based on information from sources believed to be reliable and from the consignor; however, its accuracy cannot be guaranteed. No refunds or returns will be offered. All purchases are as is, and final sale. 18. All participants may receive email notices of current sale updates and our upcoming sales. Our emails are sent through the auction software and if you receive duplicates, this is due to you have participated; selected to follow/watch our sales, registered to bid or favoured in more than one of our sales.
