Terms and Conditions of Sale
The lots listed in this catalogue will be offered by Anchor Auction LLC as owner or as agent for consignor(s) and/or seller(s) subject to the following terms and conditions. By bidding at auction you agree to be bound by these Conditions of Sale.
Please read and review the terms and conditions thoroughly prior to bidding. If you have not read and/or do not understand these terms, please do not bid. By registering and bidding on this auction the buyer agrees to all terms and conditions set forth and enters into a contractual agreement to purchase the item(s) under the following terms and conditions. Buyers are also subject to the terms and conditions of hibid.com.
You must be 18 years of age or older to bid, as bids are a legal offer to purchase an item. An accepted bid creates a binding contract to purchase. Please do not bid if you are unable to fulfill your contract to purchase.
The rights and obligations of the parties with respect to these Terms and Conditions of Sale, the conduct of the auction and any matters connected with any of the foregoing shall be governed and interpreted by the laws of the jurisdiction in Indiana. If any part of these Terms and Conditions of Sale is found by any court to be invalid, illegal or unenforceable, that part shall be discounted and the rest of the conditions shall continue to be valid to the fullest extent permitted by law.
Buyer/Bidder agrees to hold harmless and indemnify Anchor Auction LLC and its agents, owners, employees and its representatives from any and all claims, damages or suits including but not limited to awards, judgements, costs, fees, etc..
General Terms of the Auction
Information is subject to change. All lots are sold as is, where is, with all faults, imperfections and errors of description. Due diligence is the responsibility of the bidder/buyer. All sales are final. No credit card charge backs will be allowed. Purchases may be removed upon receipt of payment in full. Buyers assume complete responsibility for care of each purchase at time of sale. We reserve the right to refuse service to anyone. All statements made prior to the sale of any item take precedence over written material and any prior verbal statements. The auction company is not responsible for accidents, thefts, errors or omissions.
Anchor Auction LLC has put forth every effort in preparing the catalog for this auction to provide accurate descriptions of all items. All property is sold as is and it is the bidder’s responsibility to determine the exact condition of each item. Printed statements or descriptions by staff are provided in good faith and are matters of opinion. Bidders are encouraged to inspect items prior to bidding at the public preview (if any) or at a time arranged with Anchor Auction LLC.
Anchor Auction LLC reserves the right to cancel this auction, or remove any item/lot from this auction prior to the close of bidding.
One or more items may sell with a reserve price above the minimum starting bid. Please be sure to check for this. Items not receiving a bid reaching this reserve price will not sell. Reserves are set by either Anchor Auction LLC or the item’s consignor(s) or seller(s). The reserve price is confidential and will not be revealed to any bidder before or during the auction. By law, Anchor Auction LLC may bid on behalf of the consignor(s) or seller(s) up to their reserve price. The consignor(s) or seller(s) are also legally permitted to bid on their own items up to the reserve price.
Buyers agree to a 15% buyer’s premium that will be charged in addition to the hammer price of each lot. Please factor this into your bidding decisions.
Indiana state law requires 7% sales tax be charged on ALL internet-only auction sales. The taxable amount is the hammer price plus buyer’s premium. As such, Anchor Auction LLC will charge sales tax on all purchases and remit this to the state taxing authority. If you are tax exempt, we must have a copy of your Indiana ST-105 sales tax exemption certificate prior to (or at the time of) payment and removal of your item(s) in order to waive sales tax.
US currency and coins, and certain high-purity bullion are exempt from sales tax. Please see the Indiana Administrative Rules and Policies for full details.
Firearms and Ammunition
All local, state, and federal firearms laws will be observed. You must be 18 years of age or older to purchase long guns (rifles and shotguns), and 21 years of age or older to purchase handguns. If you are legally prohibited from purchasing, possessing, or owning firearms, DO NOT BID. Bidding is considered an offer/attempt to purchase, and so it is illegal for prohibited persons to bid on them.
If you are an out-of-state buyer of a handgun, it must be sent to an FFL licensee in your state of residence for legal transfer. Under no circumstances will handguns be transferred directly to out-of-state buyers. As the buyer, it is your responsibility to arrange for a local FFL licensee to receive the firearm on your behalf. A copy of their license must be sent to the auctioneer by the FFL licensee before the firearm will be shipped.
Federal law prohibits straw purchases of firearms. A straw purchase is the illegal buying of a gun by an individual, a “straw buyer,” on behalf of a person who is legally prohibited from purchasing, owning, or possessing a firearm, such as convicted felons. The ATF aggressively pursues those engaged in straw purchasing, and any such activity will be reported.
Due to the straw purchase laws, the name of the bidder/buyer of a firearm (as shown on the auction receipt and auction records) MUST match the ID of the person picking up the firearm. In other words, if you are the buyer, you and you alone are the only person legally authorized to receive the firearm.
You must be 18 years of age or older to purchase long gun ammunition, and 21 years of age or older to purchase handgun ammunition. If an ammunition type can be used in both long guns and handguns, it is considered handgun ammunition under the law.

This includes, but is not limited to, the genuineness/authenticity of any and all collectibles, such as sports cards, figurines, art, autographs, etc. The buyer is responsible for doing their own due diligence and making their own determination regarding these conditions.
The absence of any reference to the condition of a lot does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging. No statement, whether written or oral, and whether made in the catalogue, or in supplements to the catalogue, an advertisement, a bill of sale, a salesroom posting or announcement, the remarks of an auctioneer, or otherwise, shall be deemed to create any warranty, representation or assumption of liability.
Anchor Auction LLC and its consignor(s) and/or seller(s) make no warranty or representation, express or implied, that the purchaser will acquire any copyright or reproduction rights to any lot sold. Anchor Auction LLC expressly reserves the right to reproduce any image of the lots sold in the catalogue.
Registration and Bidding
In order to better serve our customers, all bidders must register and provide their name, address, daytime phone number, and email address at which they can be contacted. This is to assure good communication between Anchor Auction LLC and the bidder throughout any transactions. By registering for this auction you allow Anchor Auction LLC to send out email notices of future auctions and upcoming details. Anchor Auction LLC will never send you spam or emails not directed towards future auctions of their own.
For online bidding, we require you to register with a credit/debit card. The card information is kept confidential and is automatically charged when you are a successful bidder unless you notify us at least 24 hours prior to the close of the auction. If you are sales tax exempt, you must submit your Indiana ST-105 sale tax exemption certificate at least 24 hours in advance of the close of the auction. Anchor Auction LLC reserves the right to preclude any person from bidding if there is any question as to the person’s credentials, mental fitness, etc. If the registered bidder’s user name is offensive to Anchor Auction LLC or, in their sole opinion, offensive to the general public and/or detrimental to bidding activity, then Anchor Auction LLC reserves the right to delete the bidder from bidding or unilaterally change the username with notification to the bidder. When using the website you must obey any and all local state and federal laws. Violations will result in termination of website use privileges.
Anchor Auction LLC reserves the right to reject any and all bids for any reason. An accepted bid is a legal binding contract. Anchor Auction LLC reserves the right to bid on behalf of the Seller and the Buyer. Anchor Auction LLC, their auctioneers, and employees reserve the right to bid on any item on their own behalf.
The identity of all bidders will be verified. Anchor Auction LLC reserves the right to reject the bidder's registration if there is any question as to the person's credentials.
Bidder responsibilities include, but are not limited to: Bidders agree to keep their username and password confidential, as they are responsible for ANY and ALL activity involving their account. When using the web site you must obey any and all local state and federal laws. Violations will result in termination of web site use privileges.
By submitting a bid in the name of a business entity or corporation, the individual submitting the bid enters into a guaranty agreement whereby he or she personally guarantees payment to Anchor Auction LLC of any bid amount not paid when due by the business entity or corporation, for any reason, together with all collection expenses incurred to enforce collection, including a reasonable attorney's fee.
If, for any reason, Anchor Auction LLC is unable to make available or deliver any purchase, or portion thereof, or documentation required in respect to any purchase at time of pickup, the sole liability of Anchor Auction LLC., if any, shall be the return of any paid monies in respect of such purchase upon its return by purchaser.
By bidding on any item, buyer agrees to all terms and conditions set forth.
Anchor Auction online auctions are timed events and all bidding will close at specified time. However, our auctions also have what is called an Auto Extend feature, also known as a soft close. Any bid placed within the final 3 minutes of an auction results in the auction automatically extending 3 additional minutes. The bidding will extend in 3 minute increments from the time the last bid is placed until there are no more bids, and the lot sits idle for 3 minutes. Therefore, the auction will not close until all bidding parties are satisfied and no one can be outbid in the last seconds without having another opportunity to bid again.
Phone and absentee bids are not accepted for online auctions. If you wish to bid up to a predetermined maximum in advance of the close of the auction, you will need to use the “maximum bid” functionality provided by the auction software. When you bid your maximum bid, the current bid price does not automatically advance to your maximum bid. Another bidder has to bid to increase the current price and the computer will automatically bid up to your maximum in the increments specified.
In the event that there are technical difficulties related to the server, software, any other online auction-related technologies, or the bidder’s internet connectivity, etc., Anchor Auction LLC reserves the right to extend bidding, continue the bidding, or close the bidding. Neither the company providing the software nor Anchor Auction LLC shall be held responsible for a missed bid or the failure of the software to function properly for any reason.
Payments
All payments must be paid in full before any item may be removed. In addition, any electronic payments must clear before any item may be removed. No exceptions.
If you are a successful bidder, you will receive an email detailing the date(s) and location where you may pick up your items or have them shipped, if shipping is available. At that time you may choose to pay for your purchase using the credit/debit card we have on file, or pay by cash or other debit/credit card at pickup. Checks are not accepted. Charge backs are not accepted. ACH and/or wire transfers may be available for large purchases, solely at the discretion of Anchor Auction LLC. Items will be held until wire or ACH transfers are confirmed and completed.
If online payment is made, the person picking up items must present a valid government-issued ID that matches the buyer information submitted during registration. If buyer requires a third party to pick up items, buyer needs to notify Anchor Auction LLC prior to pickup.
After the pick-up time, if Anchor Auction LLC has not been contacted by the buyer to make pickup or shipping arrangements, the buyer’s credit/debit card on file will be charged for your purchases, plus buyer’s premiums, and sales tax. Each transaction necessary to collect insufficient funds will have a $25 fee imposed. In addition, buyers will be responsible for moving costs incurred by Anchor Auction LLC (which vary depending upon the item) and a minimum daily storage fee of $25 per item per day. Moving and storage fees will be charged to the card on file daily. Any item(s) not picked up after 10 days will be considered abandoned and you will forfeit them. You will not receive a refund for the purchase price, buyer’s premium, sales tax, or any moving and storage fees,.
Unpaid Balances
Successful bidder not paying for items within 3 days of the date of the auction will be considered in default. Such default by the successful bidder will result in that bidder’s liability to both the seller and Anchor Auction LLC. Seller shall have the right to (a) declare this contractual agreement cancelled and recover full damage for its breach, (b) to elect to affirm this contractual agreement and enforce its specific performance or (c) seller can resell the items either publicly or privately with Anchor Auction LLC and in such an event, the buyer shall be liable for payment of any deficiency realized from the second sale plus all costs, including, but not limited to the holding/transporting/storage costs of the items, the expenses of both sales, legal and incidental damages of both the seller and Anchor Auction LLC.
In addition, Anchor Auction LLC also reserves the right to recover any damages separately from the breach of the buyer. The purchaser agrees to pay all reasonable attorney fees and costs incurred by Anchor Auction LLC in the collection of funds. The purchaser also agrees that they will be responsible for moving costs incurred by Anchor Auction LLC (which vary depending upon the item), a minimum daily storage fee of $25 per item per day, and any other costs or losses incurred by the buyer's failure to adhere to these terms. Any debt collection or dispute proceedings will be litigated or arbitrated in Harrison County, Indiana at the option of both the seller and Anchor Auction LLC.
Both the successful bidder and seller shall indemnify Anchor Auction LLC for and hold harmless Anchor Auction LLC from any costs, losses, liabilities, or expenses, including attorney fees resulting from Anchor Auction LLC being named as a party to any legal action resulting from either bidders or sellers failure to fulfill any obligations and undertakings as set forth in this contractual agreement.
Pickup and Shipping
Pickup dates and times will be listed in the auction announcement. Location MAY be listed in the auction announcement. However, due to privacy or security considerations, sometimes the location will not be announced publicly. Winning bidders will receive this information with their invoice.
Buyers are fully responsible for the pickup, packing, and loading of their items. Bring your own help, tools, and equipment necessary to do so. Anchor Auction LLC is not responsible for any damage to items or facilities caused during the removal of said items. Buyer is wholly responsible for such damages and will hold Anchor Auction LLC harmless.
Shipping may be available on certain items at buyer’s expense. Items that are available to be shipped will be marked as “shipping available”. All shipments will be sent with insurance equivalent to the hammer price. Shipping charges will be the total of USPS postage, any additional shipping insurance required above that already included with postage, plus a $15 fee per box for packing labor and supplies. If you purchase more than one lot, we will combine items in one or more boxes in a manner that best protects them, using as few boxes as necessary.
This amount will be charged to the credit or debit card on file. Please allow 7-14 days lead time from auction close for shipments to be sent out. You will receive a tracking number as soon as the item ships.
Anchor Auction LLC will document the contents of each package. Please notify us within 2 business days of receiving the package if you think something is not included. If our documentation shows it was not packed, we will forward it immediately at our cost. We are not responsible for boxes opened by anyone other than the owner or for damage caused during shipping by the carrier. Please check the entire box and packaging for contents. DO NOT discard the original shipping box and packaging if you think something is missing or damaged. Buyer is responsible for filing damage and missing contents claims with USPS.
