TERMS & CONDITIONS (FULL COVERAGE)
ACCEPTANCE OF TERMS
By registering and/or placing a bid, you agree to these Terms & Conditions. All bids are final, legally binding offers to purchase. Failure to read or understand these terms does not exempt you from them.
SELLER RIGHTS / AUCTION CHANGES
MIDWEST ODDS & ENDS reserves the right to approve or reject any bidder, cancel bids, reopen bidding, extend closing times, correct descriptions, and add/remove/reorder lots at any time, including after bidding begins, due to errors, disputes, non-compliance, or technical issues.
BIDDING RULES
All bids are final. No retractions.
Soft Close: Any bid placed within the final 2 minutes extends closing by 2 minutes until bidding stops.
ITEM CONDITION, DESCRIPTION, AND BUYER DUE DILIGENCE
ALL ITEMS ARE SOLD “AS IS, WHERE IS,” WITH ALL FAULTS. NO WARRANTIES OR GUARANTEES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR CONDITION.
Photos, descriptions, measurements, and brand/maker attributions are provided as a courtesy and are not guarantees. Colors may appear different on different screens. Measurements may be approximate. Condition statements are subjective opinions.
Buyers are solely responsible for reviewing all photos and descriptions before bidding and for asking questions prior to bidding. By bidding, you confirm you have inspected the listing info to your satisfaction and accept the item exactly as-is.
AUTHENTICITY / MAKER / AGE / MATERIAL DISCLAIMER
Any references to maker, signature, era, gemstone, metal purity, designer, origin, or authenticity are best-effort identifications and are not guarantees unless explicitly stated as guaranteed in writing. Buyer assumes all risk regarding authenticity and valuation.
ELECTRONICS / WATCHES / MECHANICAL / TESTING
Unless explicitly stated as tested and working, all electronics, watches, and mechanical items are sold untested and may require repair, parts, batteries, or service. No refunds for non-functionality.
MISSING PARTS / SET COMPLETENESS
Lots may be missing pieces, hardware, or parts unless specifically stated complete. Buyer accepts risk of incomplete sets and hidden defects.
NO RETURNS / NO REFUNDS / NO ADJUSTMENTS
NO RETURNS. NO REFUNDS. NO EXCHANGES. NO CREDITS. NO PRICE ADJUSTMENTS.
Buyer dissatisfaction, buyer’s remorse, “not what I expected,” failure to read, failure to zoom photos, incorrect assumptions, or subjective grading differences are not valid reasons for any reversal.
BUYER’S PREMIUM / TAXES / FEES
A 15% Buyer’s Premium applies to all lots.
Any applicable sales tax will be charged unless valid exemption documentation is on file with HiBid per their rules. Buyers are responsible for all taxes, fees, and compliance in their jurisdiction.
PAYMENTS (48-HOUR PROCESSING + DECLINES)
Payments will be processed within 48 hours of auction closing using the payment method on file.
If payment is declined, a secure payment link will be emailed. Buyer has 24 hours from the time that email is sent to complete payment manually.
Buyers are responsible for maintaining a valid, monitored email address on their HiBid account and checking email immediately after auction close. “I didn’t see it” is not an excuse.
NON-PAYMENT ENFORCEMENT
Non-paying customers will be permanently banned and the bidder’s account will be notated. Unpaid items may be forfeited, relisted, and/or awarded to underbidders at seller discretion. MIDWEST ODDS & ENDS may pursue recovery of fees, losses, and administrative costs as permitted.
ADDRESS / CONTACT ACCURACY
All shipping is sent ONLY to the address on the bidder’s HiBid account. No address changes after auction close. Any costs due to wrong/old address are the buyer’s responsibility.
SHIPPING ELIGIBILITY / METHODS / HANDLING
Shipping is available only on select items at seller discretion. Not all lots qualify.
Buyer pays all shipping and handling. A $3 handling fee per lot applies in addition to carrier charges. Combined shipping is offered when feasible, but not guaranteed.
Shipping timing: Items ship within 48 hours of cleared payment, excluding weekends and federal holidays.
PACKING STANDARDS / FRAGILE ITEMS
MIDWEST ODDS & ENDS will pack items using reasonable care. However, fragile/vintage items carry inherent shipping risk and may shift or break in transit.
TRANSFER OF RISK
Responsibility transfers to the buyer the moment the item leaves MIDWEST ODDS & ENDS possession.
For shipped orders: transfer occurs when the package is handed to the carrier.
For pickup orders: transfer occurs when the item is released to the buyer or the buyer’s agent.
MIDWEST ODDS & ENDS IS NOT RESPONSIBLE FOR LOSS, DAMAGE, THEFT, MISDELIVERY, CARRIER DELAYS, WEATHER EVENTS, OR OTHER SHIPPING ISSUES AFTER TRANSFER.
INSURANCE / CLAIMS
If shipping insurance is available/added, the buyer is responsible for cooperating with claim requirements (photos, packaging retention, carrier paperwork). Failure to cooperate may void any claim.
LOCAL PICKUP
Pickup is by appointment only during the stated pickup window. Buyer must bring adequate help, tools, and transportation. Staff will not load, disassemble, move heavy items, or provide packing materials.
ABANDONMENT / FORFEITURE
Items not picked up within the scheduled pickup period are considered abandoned and forfeited with no refund. Seller may resell or dispose of abandoned items at its sole discretion.
CHARGEBACKS / PAYMENT DISPUTES
By bidding and paying, buyers agree not to file chargebacks or disputes for reasons including but not limited to: item condition, authenticity disputes, subjective expectations, shipping delays, damage after transfer, failure to read descriptions, or buyer’s remorse.
Any chargeback/dispute on a valid transaction may result in permanent banning, account notation, collection/recovery efforts, and referral to counsel as permitted.
LIMITATION OF LIABILITY
To the maximum extent allowed by law, MIDWEST ODDS & ENDS’ liability is limited to the purchase price of the specific lot(s) at issue, excluding buyer’s premium, shipping, handling, taxes, and any indirect or consequential damages.
COMMUNICATION
Email is the primary communication method. Buyers are responsible for all missed invoices, pickup instructions, payment links, or updates due to spam filters, inbox neglect, or incorrect account information.
FORCE MAJEURE
MIDWEST ODDS & ENDS is not liable for delays or non-performance caused by events beyond reasonable control (weather, power/internet outages, carrier disruptions, illness, emergencies, etc.).
GOVERNING LAW / VENUE
All transactions are governed by Iowa law. Any legal action must be filed in Henry County, Iowa.
SEVERABILITY
If any part of these Terms & Conditions is deemed unenforceable, the remaining provisions remain in full effect.
