BY REGISTERING TO BID OR SUBMITTING ANY BID IN THIS AUCTION, YOU (“BIDDER,” “BUYER,” OR “PARTICIPANT”) ACKNOWLEDGE AND AGREE TO BE BOUND BY ALL TERMS AND CONDITIONS HEREIN. THESE TERMS ARE A LEGALLY BINDING CONTRACT. IF YOU DO NOT AGREE, DO NOT BID.
1. Communications
All communications regarding the auction, including but not limited to registration, bidding, invoicing, payment, and notifications, shall be conducted via the email address provided during HiBid account registration.
The Buyer is solely responsible for the accuracy and monitoring of this email address.
KC Treasures LLC shall bear no liability for missed communications, notices, or deadlines arising from incorrect, inactive, or unmonitored email accounts.
2. Bidder Registration, Approval, and Conduct
KC Treasures LLC reserves the right, in its sole and absolute discretion, to approve or deny any registrant’s participation or bids, and to remove or reinstate any lot, at any time, with or without notice.
Bidding on any lot constitutes full acceptance of these Terms & Conditions, including all rules and policies contained herein.
All bids placed are final, irrevocable, and binding as a matter of law.
Bids cannot be withdrawn, canceled, or modified under any circumstances, including claims of error or technical malfunction.
Any bidder found attempting to manipulate the bidding process, collude with others, shill bid, or otherwise undermine the integrity of the auction will be permanently banned and may be subject to legal action and damages.
3. Auction Close & Soft-Close Policy
Each lot is scheduled to close at a specified time. If a bid is placed within the final two (2) minutes of a lot’s scheduled close, the closing time for that lot will automatically extend by two (2) minutes (“soft close”).
KC Treasures LLC reserves the right to extend, reopen, or cancel any lot at its sole discretion due to technical error, system malfunction, or suspected impropriety.
4. Item Condition, Inspection, and Returns
All property is sold strictly “AS IS, WHERE IS,” without warranty, express or implied, as to the condition, merchantability, fitness for a particular purpose, authenticity, or any other characteristic.
No statement in the catalog, description, or elsewhere shall be deemed a warranty, representation, or guarantee of any kind by KC Treasures LLC or its agents.
The Buyer acknowledges that items are pre-owned and may exhibit wear, flaws, or defects, whether or not described or depicted in photos. Descriptions and photos are provided as a courtesy only; reliance on such is at the Buyer’s sole risk.
NO PREVIEW OR IN-PERSON INSPECTION IS AVAILABLE. Buyers are urged to request additional information or clarification before bidding. All sales are final. NO RETURNS, REFUNDS, OR EXCHANGES WILL BE GRANTED UNDER ANY CIRCUMSTANCES.
5. Payment Policy and Buyer’s Premium
A 15% buyer’s premium shall be added to the final bid price of each lot and is payable by the Buyer as part of the purchase price.
Payment shall be made by the card on file immediately after auction close. Cards will be charged up to two (2) times automatically.
If both payment attempts fail, Buyer will receive an email with a payment link and must complete payment within twenty-four (24) hours of auction end. Failure to timely remit payment constitutes breach of contract and will result in forfeiture of all items won, and permanent ban from all future auctions.
Buyers wishing to pay by cash (for local pickup) or via Cash App must notify KC Treasures LLC in writing before the auction ends.
By paying, Buyer irrevocably waives any right to dispute or reverse charges.
6. Sales Tax
Iowa sales tax will be collected on all items shipped to Iowa addresses, as required by law. No sales tax will be charged for out-of-state shipments unless otherwise mandated by law.
7. Pickup, Abandonment, and Forfeiture
Pickup is strictly limited to the dates and times stated for this auction.
Buyers unable to collect items as scheduled must contact KC Treasures LLC prior to bidding to request alternate arrangements; such accommodations are not guaranteed.
Any items not picked up within the scheduled period shall be deemed abandoned, forfeited by the Buyer, and may be resold or disposed of at the Seller’s sole discretion without refund, credit, or further notice.
Seller shall have no further liability whatsoever for abandoned items.
8. Shipping Policy
Shipping is available only on select, small, manageable lots as stated in the individual lot descriptions. Not all lots qualify for shipping.
All shipments are via USPS. A $3 handling fee per lot applies, in addition to standard USPS shipping charges. Combined shipping may be provided at Seller’s discretion when feasible.
All shipments will be sent to the address registered on the Buyer’s HiBid account. No address changes or rerouting will be accepted after auction close.
Items ship after full payment is processed and cleared.
Risk of loss passes to the Buyer upon delivery to the carrier. Seller is not responsible for loss, delay, or damage occurring during transit. Buyer is encouraged to request insurance in advance if desired.
9. Chargebacks, Disputes, and Governing Law
By bidding, Buyer expressly waives all rights to initiate chargebacks, reversals, or payment disputes of any kind, for any reason, with any financial institution or card issuer.
Any attempt at a chargeback or payment reversal will result in immediate and permanent banning from all future KC Treasures LLC auctions and legal action to recover all funds owed, plus a $50 administrative fee per occurrence and any costs of collection, including reasonable attorney’s fees.
These Terms & Conditions, all transactions, and any disputes or legal actions arising hereunder are governed by the laws of the State of Iowa. The exclusive venue for any litigation shall be the courts of Henry County, Iowa.
The Buyer agrees to indemnify and hold harmless KC Treasures LLC and its agents from any claim, loss, or liability arising out of the Buyer’s participation in this auction.
10. General Provisions
KC Treasures LLC is not responsible for system outages, technical errors, or interruptions in service that may affect bidding, registration, or payment.
KC Treasures LLC reserves the right to update, modify, or amend these Terms & Conditions at any time prior to auction close.
If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
By registering, placing a bid, or making any payment, Buyer affirms that they have read, understood, and agree to abide by these Terms & Conditions without limitation.
