Please read and review the following Terms and Conditions thoroughly before placing any bids. By bidding in this auction, you agree to all terms outlined below and enter into a binding contractual agreement with Haldon Burgener Auction & Realty and the seller.
1. Auction Registration & Participation: This is an online-only auction. All bidders must be 18 years of age or older and provide accurate registration information. (NOTE: PLEASE REVIEW YOUR HIBID ACCOUNT INFORMATION AND MAKE SURE ALL INFORMATION IS CURRENT BEFORE REGISTERING.) Information provided in your account is used to verify and contact you. If the information is not accurate, this can cause miscommunication with the bidder and auction company. Haldon Burgener Auction & Realty will not be responsible for missed communications due to outdated or incorrect registration details. There will be a $1.00 charge to your card for verification before bidding. Haldon Burgener Auction & Realty reserves the right to accept, reject, or cancel any bid or bidder and cancel, reschedule, or remove any item from the auction at any time for any reason at their sole discretion due to all our online auctions being “WITH RESEVE” auctions. Your bid is a binding contract. Do not bid unless you intend to purchase.
2. Auction Closing & Bidding Process: This auction features a soft close. If a bid is placed within the last 2 minutes of a lot’s close, bidding will extend by 2 minutes per bid until no further bids are placed. “Fixed Bidding: The amount entered is placed as-is.” “Max Bidding: The system will automatically bid on your behalf up to the maximum amount entered, only when necessary.”
4. Buyer’s Premium: A 12% Buyer’s Premium will be applied to all lots in this auction. Buyer premium example: if you are the high bidder on an item for $100, the 12% buyer premium will be added onto this total. You will be charged out for $112 at the conclusion of the auction.
5. Sales Tax: No sales tax will be collected.
6. Payment Terms: At the conclusion of the auction, your card on file will be automatically charged for the full invoice amount, including the buyer’s premium. Accepted payment methods include Visa, Mastercard, Discover, cash, or local check (with prior approval for large-ticket items). If the auction company is not notified within 24 hours regarding alternate payment arrangements, your card will be charged. A 5% late fee may apply to unpaid balances. No refunds or chargebacks will be permitted under any circumstances. All sales are final.
7. Default by Buyer: Any bidder failing to pay in full within 5 days will be considered in default. The seller and auction company may cancel the sale, resell the item(s), and seek damages, including storage, legal fees, and resale costs. Defaulting buyers may be subject to legal action in Shelby County, IL. The auction company reserves the right to pursue legal remedies and/or ban defaulting bidders from future auctions.
8. Pickup & Check-Out Pickup Location: Assumption, IL 62510 Pickup Date/Time: October 2th, 2025 – 10:00 a.m. to 2:00 pm Buyers must bring a paid invoice and valid ID. Buyer is responsible for loading their own items. Auction staff will not assist with loading. If you are coming in person to pick up, you will need to bring your own totes, packaging, tools, and labor.
9. Failure to Pick Up: If buyers do not pick up their items by the scheduled date and time, or fail to make special arrangements with the auction company, the buyer forfeits ownership of the items. Ownership will revert back to the seller, and no refunds will be issued. Items may be resold or disposed of at the seller’s discretion.
10. Shipping: No shipping offered unless explicitly stated in the auction listing. Buyer is responsible for all pickup and transportation.
11. Item Condition & Inspection: All items are sold AS IS, WHERE IS, with no warranties expressed or implied. Photos and descriptions are for reference only and may not be accurate. Buyers are encouraged to inspect items prior to bidding. No products are tested. You are bidding on the described item, not just the photo. “No guarantees of authenticity, condition, or completeness are made.”
12. Bidding Errors: All bids are final. Mistakes made while bidding are the bidder’s responsibility. Bids cannot be reversed once placed.
13. Liability & Indemnification: Haldon Burgener Auction & Realty and the seller are not responsible for accidents, damage, or loss during preview, bidding, or pickup. The buyer assumes all risk and agrees to hold the auction company and seller harmless from any claims. Both the Successful Bidder and Seller shall indemnify Haldon Burgener Auction & Realty for and hold harmless Haldon Burgener Auction & Realty from any costs, losses, liabilities, or expenses, including attorney fees resulting from Haldon Burgener Auction & Realty being named as a party to any legal action resulting from either Bidders or Sellers’ failure to fulfill any obligations and undertakings as set forth in this contractual agreement.
14. Disputes: All disputes will be settled at the discretion of Haldon Burgener Auction & Realty.
15. Jurisdiction: This agreement is governed by Illinois law. Any disputes will be handled in Shelby County, IL.
16. Privacy & Communication: Bidder information will not be sold. By registering, you agree to receive auction-related emails and texts. You may unsubscribe at any time. All registered bidders are responsible for checking their texts and emails in order to get auction updates. Please note that some emails can potentially be sent to your junk mail. Haldon Burgener Auction & Realty and their representatives are not responsible for any missed communication.

18. Bidding: Haldon Burgener Auction & Realty reserves the right to bid on behalf of Buyer/Seller/Secured parties. YOUR BID ON THIS AUCTION INDICATES BOTH AN UNDERSTANDING AND AN ACCEPTANCE OF THE TERMS OF THIS CONTRACTUAL AGREEMENT BETWEEN YOURSELF AND BOTH THE SELLER AND HALDON BURGENER AUCTION & REALTY. And that you, AS THE BIDDER, ARE PREPARED TO PURCHASE THE PROPERTY UNDER THE TERMS AND CONDITIONS OF THIS AUCTION.
