Terms & Conditions
1. Auction Overview
• This is a privately owned and operated auction. The Auctioneer reserves the right to refuse admittance or bidding privileges to any person(s). No transfer of winning bids will be recognized.
• All announcements made up to the final close of bidding take precedence over any prior written or oral communication.
2. Property Details
• The Property is sold “as is, where is”, with no warranties or representations, expressed or implied.
• The sale includes real estate only; no personal property is included.
• Property will be conveyed by Warranty Deed.
• The Seller will provide an Owner’s Title Insurance Policy at closing.
• Real estate taxes will be prorated up to the date of closing, as taxes are paid in arrears.
3. Due Diligence
• Bidders are encouraged to inspect and investigate the Property at their own risk before bidding.
• Failure to inspect the Property shall not be grounds for cancellation, refund, or chargeback.
• All marketing materials (PIP, plats, drawings) are deemed reliable but are not guaranteed. They are for informational purposes only and should not be solely relied upon.
• Viewing the Property is at the viewer’s own risk. The Seller, Auctioneer, and Listing Agency are not responsible for accidents or injuries on the premises.
4. Bidder Registration
• All Bidders must register and provide full identification and establish credit with the Auction Company at least 48 hours prior to the auction start.
• By bidding, Bidders acknowledge and agree to these Terms & Conditions.
5. Bidding Process
• All bids are irrevocable once placed. No bid retractions will be allowed.
• Online bidding is fast-paced and may not provide confirmation messages.
• A Bidder is deemed to have accepted the Property upon placing a bid.
• Should a dispute arise, the Auctioneer’s records are final.
• In the event of technical difficulties (server, software, or platform issues), Equity Realty Group (ERG) reserves the right to extend, pause, or cancel bidding. Neither ERG nor the software provider is responsible for missed bids or technical malfunctions. Registered Bidders will receive updates via email as needed.
6. Winning Bidder & Contract Execution
• The successful Bidder will be notified via email within 24 hours of the auction ending.
• The successful Bidder must immediately sign a Real Estate Auction Sales Contract and Purchase Agreement upon acceptance.
• The Seller reserves the right to cancel the auction at any time prior to the final bid closing.
7. Payment Terms
• A non-refundable $5,000 down payment is due within 24 hours of Seller acceptance, via Trust Funds or wire transfer to Community Title. A nominal convenience fee will apply.
• A 5% Buyer's Premium will be added to the final bid to determine the total purchase price.
• The balance, including the Buyer’s Premium, is due via wire transfer at closing.
8. Closing & Possession
• Closing will take place at Community Title within 45 days of the accepted bid.
• Possession of the Property will be granted at closing.
• The sale is not contingent upon financing. Bidders must have funds or financing in place prior to bidding.
9. Legal & Liability
• Failure to complete a purchase is illegal and may result in prosecution and suspension of future bidding privileges.
• Bidders agree to indemnify and hold harmless the Auctioneer and Seller from any claims, damages, or injuries occurring before, during, or after the auction.
• Equity Realty Group and its representatives act as exclusive agents for the Seller.
