Auction Terms & Conditions AUCTION TERMS AGREEMENT OF TERMS By registering for this auction, you agree to the terms of the auction. This is an on-site, on-line, pick-up only auction. Items must be picked up on location at the designated times. If not your card will be billed. Items not picked up within 7 days will be considered abandoned and become property of the auction company. Do not bid if you or a representative cannot be there at designated pickup times. REGISTRATION All bidders must register for each auction, whether on-site or on-line, in order to receive a bidder number. In order to register for the auction, the registrant must provide a picture identification showing their current name and address. Registrant must also provide contact information which includes telephone number and email address. BUYER'S PREMIUM A 15% Buyer's Premium will be added to the bid price for all purchases made on-line, absentee, or live. SALES TAX Indiana state sales tax will be charged. No sales tax on coins or paper money. PAYMENT Payment is due at the conclusion of the auction. Cash, Indiana checks, and credit cards will be accepted at pick up. 3% cash discount. DEFAULT OF PAYMENT Payment is due at the conclusion of the auction. Any invoices remaining outstanding after the payment due time, may be accessed a collection fee as well as all other remedies allowed by law. The auction company may retain any monies received as deposit as liquidated damages. Lots not paid for within the time specified may be resold at public or private sale, without further note. Any resulting deficiency together with all expenses and costs of re-sale will be the responsibility of the defaulting purchaser. BIDDER NUMBER Once registrant has completed the necessary requirements; they will be issued a bidder number. Bidder is responsible for payment of any items purchased on this bidder number; whether it be by them or by any party they have allowed to use their bidder number. CONDITION AND WARRANTIES All items are sold "AS IS, WHERE IS" .Great effort is given to providing the description and condition of each item; when known. Auction Company will not be held responsible for errors in the description or condition of any item. It is the buyer's responsibility to determine the authenticity or condition of any item prior to bidding. No refunds will be issued on any item sold due to errors, omissions or condition of items sold. The buyer agrees to indemnify and hold the auction company, auctioneer and staff and seller harmless from any future claim that shall pertain the fitness or use of that asset as being purchased. BIDDING Bidding may be available on-site, on-line or in conjunction with each other. Lots may be offered in various ways including a single lot, multiple lots, split lots, etc.; which will be at the discretion of the auctioneer and auction company. Bidding will continue until the highest bid has been obtained; the auction company will have rights to refusal if the bid does not meet their requirements. Upon approval from the auction company the highest bidder will be the winning bidder; all other bidders will be considered null. The auctioneer, at their discretion, may offer additional lots to the "back-up" bidder(s) at the winning bidder's price; back-up bidders have the right to accept or decline the offer. The Auction Company, its employees and contractors, and the seller have rights to bid during the auction. Auction Company and auctioneer have the right to reject any bids that are merely nominal bids; if in their judgment it may adversely affect the sale. DISPUTE BETWEEN BIDDERS Disputes between bidders determining the winning bidder will be handled as follows: the auction company or its' auctioneer may decide the winning bidder, or may resell the items immediately. The decision of the auction company, or its' auctioneer, shall be final. CHANGES TO AUCTION LOTS The auction company reserves the right to change any lot whether it be number order, content, grouping, division, addition or withdrawal of lots at any time. Once the auctioneer says sold the lot can no longer be changed. TECHNOLOGY DISCLAIMER On-line auctions and bidding rely on modern technology. Occasionally this technology fails. Auction company reserves the right to cancel an on-line auction in the event of failure of on-line technology. Auction company may relist auction at their discretion. SECURITY All items become the sole responsibility of the buyer once auctioneer has said sold and has confirmed you are the successful bidder. It is your responsibility to secure your items, no refunds or adjustments will be given for lost or stolen items or for shortages. SHIPPING Shipping may be available on smaller items. Please call, text, or email to ask about shipping BEFORE bidding. REMOVAL Removal of purchased items shall be at the expense, liability, and risk of the purchaser. Purchases may be removed upon presentation of a paid receipt to the Auction Staff. Purchases may only be removed during the allotted pick-up period. Removal dates/times will be announced at each auction. Any item(s) not removed during this period may be considered abandoned and no refund will be given. Abandoned items may be resold without notice at public or private sale or otherwise be disposed of at purchaser's expense. No refund will be given for abandoned items. Please bring own help, boxes and packing material for pickup of online auction items. PERSONAL AND PROPERTY RISK Persons attending during preview, sale, or removal assume all risks of damage or loss to person and property and specifically release and indemnify the auction company and staff from liability therefore. All announcements made the day of sale take precedence over other advertisements, notices, terms and other published information relating to the auction. ONLY BID IF YOU INTEND TO PICK UP ITEMS DURING SCHEDULED PICKUP TIMES WE WILL NOT MAKE COUNTLESS PHONE CALLS OR SEND ENDLESS EMAILS HUNTING YOU DOWN.
