Terms:
Auction Conducted Under and In Accordance with These Bidder Terms and Conditions: These Online Auction Terms and Conditions constitute a legal, valid and binding contract between Metro Auctions LLC and each bidder. The Auction is conducted under and in accordance with these Bidder Terms and Conditions and applicable law. By registering to bid, each Bidder agrees to be bound by these Terms and Conditions.
1. All prospective bidders must register to bid on hibid.com. You must agree to all auction terms and conditions before you are approved to bid.
2- All property is being sold and delivered "AS IS" "WHERE IS", "WITH ALL FAULTS", without any representations, covenants, guarantees or warranties of any kind or nature whatsoever, and free and clear of all monetary liens, claims and encumbrances of whatever kind or nature, such liens, claims, interests and encumbrances, if any, to attach to the proceeds of Sale in such order and priority as they existed immediately prior to the Sale Date, and subject to, among other things, any state of facts a physical inspection may show. No refunds or chargebacks will be granted due to the condition of the item. By Registering to Bid, All bidders acknowledge that they have had the opportunity to review and inspect the Assets, the state of title thereof and laws, rules and regulations applicable thereto, and will rely solely thereon and on their own independent investigations and inspections of the Assets in making their bids. All bidders acknowledge that they have conducted their own due diligence in connection with the Assets, and are not relying on any information provided by the Trustee, Auctioneer, or the Trustee's retained professionals. The Auction Company is not responsible for lease negotations on behalf of the winning bidder. All property is being sold as is, where as, with all faults and without any contingencies to secure a commercial lease on behalf of the winning bidder.
4- All persons inspecting or removing merchandise assume all risks or damage or loss to persons or property. The Auctioneer, Seller, Landlord, Trustee and/or Agent shall be released from all liability. The auctioneer shall not be liable for any defect in condition of the merchandise on the premises of which the sale is held.

6- PAYMENT TERMS:
We accept Cash, Mastercard, Visa, Discover, and AMEX. We also accept Wire Transfers and Cashier's Checks - made payable to Metro Auctions, LLC. We do NOT accept personal checks; company checks or money orders.
Full payment is due on the scheduled removal day regardless of shipping, delivery or storage arrangements made. If no contact has been made before the end of the scheduled removal day, the credit card on file will be charged. If the total invoice amount cannot be collected at once, partial charges will be made until total balance has been paid.
Buyer's Premium: A 20% buyer's premium will be added to each purchase. If you bid $100.00 and are the winning bidder, you will be charged $120.00 at checkout plus local Sales Tax.
Sales Tax: Applicable Sales Tax will be added to all purchases, unless the purchaser has a valid resale certificate and is purchasing for resale or export with proper documentation.

NO CREDIT CARD CHARGEBACKS: Each bidder agrees to NOT, under any circumstances, initiate a credit card chargeback with respect to any charges.
Each Bidder further agrees that if, in violation of these Terms and Conditions, a credit card chargeback is initiated by the Bidder, these Terms and Conditions shall be conclusive evidence of the Bidder's (i) agreement to not initiate a credit card chargeback and (ii) waiver of any rights to initiate a credit card chargeback. Each Bidder acknowledges and agrees that on the Auctioneer's presentation of these Bidder Terms and Conditions to the bank, the credit card company, payment processor, or other financial institutions that issued the credit card on which the disputed chargers were made, such bank, credit card company, payment processor, or other financial institution shall deny credit card chargeback and shall re-credit amounts to the account of the Auctioneer.
If a Bidder initiates a credit card chargeback, such Bidder, even if successful, shall remain liable for all purchases made at the auction and shall be responsible for all costs and expenses, including attorneys' fees, storage fees, packaging and handling fees, transportation fees, and/or disposal fees, etc., incurred by or on behalf of the Auctioneer or Seller in challenging the credit card chargeback. Each Bidder agrees that the agreement to not initiate a credit card chargeback is a condition to the issuance of a Bidder Number and is being made as an inducement for the Auctioneer to accept the Bidder's Registration to issue a Bidder Number.
7- Full payment required by date and time specified in Terms of Sale. Nothing can be removed from the premises before payment of invoice balance is PAID IN FULL.
8- Checkout/Removal Times:
Any purchases not removed by the date and time indicated in terms of sale will be abandoned. Total responsibility for removal of purchases is that of the Purchaser, financially and physically. The Auctioneer cannot be responsible or liable for any moving, on or off-site. Purchasers must supply their own equipment, boxes and labor as applicable for removal. METRO AUCTIONS WILL NOT HANDLE SHIPPING, PACKING OR MOVING OF ANY PURCHASES. Please make arrangements with truckers or third party shippers in advance.
9- The Auctioneer reserves the right to group, break or withdraw lots. The Auctioneer shall have absolute discretion in case of a disputed lot.
10- Return/Refund Policy: ALL SALES ARE FINAL. NO REFUNDS OR EXCHANGES.
11- All items are sold per piece times the bid price. Buyer must take the entire lot and pay for overages or be reimbursed for shortages, if applicable. No claims or shortages of any nature will be recognized after removal.
12- 20% Buyer's Premium will be added to all purchases.
13- We reserve the right to pause, cancel and/or reopen the auction in the case of system failures.
14- Extended Bidding (Anti-Sniping): To prevent last-second bids from unfairly winning, we reserve the right to extend the auction time if a bid is placed in the final moments. Specifically, any bid made within the last 2 minutes adds an additional 2 minutes to the auction. This process continues until no new bids are received, ensuring all interested parties have a fair chance to respond.
15- WE WILL NOT HANDLE SHIPPING, PACKING OR MOVING OF ANY ITEMS. Please make arrangements with truckers or third party shippers in advance.
16- Permanent Ban or Suspension: We reserve the right to suspend or permanently ban bidding privileges of any bidder that breaches these Terms and Conditions, engages in improper conduct, and/or for any other reason that Metro Auctions LLC deems appropriate.
