HiBid Auction | Auction Terms and Conditions By registering to bid, placing a bid, or purchasing any item in this auction, you (the “Bidder” or “Buyer”) unconditionally agree to be bound by these Terms and Conditions. 1. AS-IS, WHERE-IS SALE – NO WARRANTIES ALL LOTS ARE SOLD “AS-IS, WHERE-IS” WITH NO WARRANTIES WHATSOEVER. • No warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, condition, quality, title, or non-infringement are made. • All items are sold in their present condition and location with all faults, defects, and imperfections, whether known or unknown. • Bidder acknowledges that they have had full opportunity to inspect items before bidding (via photos, or in-person inspection during preview day) and rely solely on their own inspection and judgment. • While we do our best to take photos and describe each piece, the Auctioneer and Seller disclaim any responsibility for the accuracy of descriptions, photographs, lot counts, or any other information provided. 2. PICKUP LOCATION & MANDATORY PICKUP DATES Location: 1807 Shallcross Ave, Wilmington, DE 19806 • Wednesday, November 19, 2025 • Thursday, November 20, 2025 • Saturday, November 22, 2025 Pickup Hours: [Wednesday – Noon -6pm, Thursday 10am -4pm, & Saturday 11am-3pm • Buyer is solely responsible for the removal of all purchased items during the above dates and times. • SHIPPING provided on select lots. Buyer is responsible for all shipping charges/fees and will be invoiced accordingly. Buyer must arrange and pay for any third-party shipping, packing, or crating. • Items not removed by 2:00 PM on November 22, 2025, will be considered ABANDONED and the title will revert to the Seller without refund. • No storage will be provided. Late pickups, rescheduling, or “holding” items are NOT permitted. 3. PAYMENT TERMS • Full payment due within 24 hours of auction close via HiBid’s payment system. • Cash Payment is available at pick-up. Please notify the seller if you plan to pay with cash day of pickup. • Accepted: Credit/Debit Card (subject to HiBid processing fees). • An 18% Buyer’s Premium will be added to the hammer price. • Non-payment will result in a permanent ban from future auctions and possible legal action. 4. BIDDER REGISTRATION & RESPONSIBILITY • Bidder must be 18+ and provide a valid ID at pickup. • Bidder is responsible for all bids placed under their account. • Auctioneer reserves the right to reject any bid or cancel any registration without liability. 5. TITLE & RISK OF LOSS • Title passes to Buyer upon full payment. • Risk of loss passes to Buyer at pickup (or upon abandonment if not picked up). • Seller/Auctioneer not liable for damage, theft, or loss after title passes. 6. NO REFUNDS, RETURNS, OR CHARGEBACKS • ALL SALES ARE FINAL. • No refunds, returns, exchanges, or chargebacks for any reason, including non-pickup, buyer’s remorse, or post-purchase discovery of defects. 7. REMOVAL & SAFETY • Buyer must bring help, tools, and equipment for safe removal. • Buyer assumes all liability for damage to property or injury during removal. • Children/pets must be supervised. No unauthorized access to non-auction areas. 8. DEFAULT & REMEDIES • Failure to pay or pick up = Default. • Defaulting Buyer forfeits items, payment, and future bidding rights. • Seller/Auctioneer may resell items and charge Buyer for deficiency, costs, and 25% re-auction fee. 9. LIMITATION OF LIABILITY • Auctioneer/Seller’s maximum liability shall not exceed the purchase price paid for the lot. • In no event are they liable for incidental, consequential, or punitive damages. 10. GOVERNING LAW & VENUE • Governed by laws of the State of Delaware. • Exclusive venue: New Castle County, DE. 11. HI BID PLATFORM • Use of HiBid is subject to HiBid’s separate Terms of Service. • Technical issues with HiBid do not relieve Bidder of payment/pickup obligations. 12. AMENDMENTS • Auctioneer may amend these terms via posted notice on HiBid before auction close. BY BIDDING, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO THESE TERMS IN FULL.
