5% BUYERS PREMIUM 1.) All items are offered “AS IS and WHERE IS”, in units of measure as announced. Bidders shall rely upon their own inspections. 2.) Auctioneer will receive bids from any responsible and registered bidder. 3.) Upon award of bid, title and all risk of loss, damage to or destruction of the purchased item passes to purchaser. Auctioneer, their agents, and or client will have no liability whatsoever for any personal injury or accident that may occur. 4.) Bidders will be identified by number. Bidders are strictly responsible for any items which are sold to their bidder number. 5.) All purchases are to be paid in full on the day of the auction prior to removal from premises. All items must be removed within the time announced at the auction, at the purchaser’s sole cost and risk. 6.) When required by law, and applicable, sales tax will be added to the purchase price of all taxable items. 7.) All rights, privileges and powers reserved or granted to Auctioneer in these Terms shall be deemed reserved and granted to the Auctioneer’s employees, representatives, and all owners for whom the items are being sold. 8) Payment by cash, Visa Master Card or Discover No Checks unless you have been pre-approved by auctioneer. 9) All items must be picked up at the scheduled time or said items will become the property of The Gallery of London. 10.) Announcements made day of auction may take precedence over these Auction Terms or other printed material. 4707.022. Reserve Auction; disclosure; agency. (A) An auction shall be a reserve auction unless explicitly stated otherwise in the contract for the auction and in the terms and conditions governing the auction. For purposes of a reserve auction, there need not be an announcement or indication that the reserve is attained. 4707.01. Definitions (F) "Reserve auction" means an auction in which the seller or an agent of the seller reserves the right to establish a stated minimum bid, the right to reject or accept any or all bids, or the right to withdraw the real or personal property at any time prior to the completion of the auction by the auctioneer.
