# TERMS & CONDITIONS
By registering for or participating in this auction, each bidder acknowledges that they have read, understand, and agree to these Terms & Conditions, as well as the published Bidding Notice, Payment Information, Shipping & Pickup Information, and Auction Notice.
## 1. REGISTRATION & BIDDER RESPONSIBILITY
All bidders must register and provide accurate and complete information before bidding.
Each bidder is responsible for all activity conducted under their bidder account or bidder number. **All bids are binding.** Bidders should carefully review their bids before submitting them.
Accidental bids, failure to read the item description, failure to review photographs, or a change of mind do not relieve a successful bidder of the obligation to complete the purchase.
Martin Vintage Sales reserves the right to refuse registration, reject bids, or suspend or revoke bidding privileges when reasonably necessary to protect the integrity of the auction or enforce these Terms & Conditions.
## 2. AS IS, WHERE IS — ALL SALES FINAL
All property is sold **AS IS, WHERE IS, WITH ALL FAULTS**, without warranties or guarantees, expressed or implied, unless specifically stated otherwise in writing.
**ALL SALES ARE FINAL. NO RETURNS, REFUNDS, EXCHANGES, OR POST-AUCTION PRICE ADJUSTMENTS** will be made except where required by law.
Bidders are responsible for determining the condition, completeness, age, authenticity, value, and suitability of an item before bidding.
Inspection is encouraged when available. Bidders who are unable to inspect an item personally should review all photographs and descriptions carefully and contact Martin Vintage Sales with any questions **before bidding.**
## 3. DESCRIPTIONS, PHOTOGRAPHS & CONDITION
Lot descriptions, photographs, measurements, dates, ages, maker information, model information, condition assessments, provenance, attribution, authenticity, and other information are provided in good faith for the convenience of bidders.
Martin Vintage Sales makes reasonable efforts to provide accurate information; however, errors, omissions, or inaccuracies may occur.
Photographs are considered part of the item description. Bidders are responsible for reviewing **all photographs** associated with a lot before bidding.
Wear, scratches, chips, cracks, repairs, discoloration, missing pieces, damage, or other condition issues may be visible in photographs even when not specifically mentioned in the written description.
Condition statements and answers to bidder questions represent good-faith observations and opinions and are **not warranties or guarantees.**
The absence of a condition statement does not imply that an item is in perfect or undamaged condition.
## 4. BIDDING
A bid constitutes a binding agreement to purchase the item if the bidder is ultimately determined to be the successful bidder.
Bidders are responsible for understanding the auction format before participating.
For auctions utilizing **online pre-bidding followed by a live auction**, online bids will be carried into the live auction in accordance with the published Bidding Notice.
**Being shown as the high bidder at the close of online pre-bidding does not necessarily mean the bidder has won the item.** A lot is not considered sold until bidding on that lot has concluded during the live auction and the successful bidder has been determined.
## 5. AUCTIONEER AUTHORITY & BIDDING DISPUTES
The auctioneer has authority over the conduct of the live auction and resolution of bidding disputes.
Martin Vintage Sales and/or the auctioneer reserves the right, as permitted by applicable law, to reject a bid, determine the successful bidder, reopen bidding when appropriate, withdraw a lot, correct an error, combine or separate lots, change the order of sale, or take other reasonable action necessary for the proper conduct of the auction.
In the event of a bidding dispute, the auctioneer's decision will be final to the extent permitted by applicable law.
## 6. TECHNICAL ISSUES & ONLINE BIDDING
Online bidding is provided as a convenience to bidders.
Martin Vintage Sales is not responsible for missed bids or bidding problems caused by internet or connectivity issues, computer or mobile-device problems, browser issues, delayed transmissions, software failures, HiBid or third-party platform interruptions, or other technical difficulties beyond our reasonable control.
Bidders are encouraged to place online bids early rather than waiting until immediately before online pre-bidding closes.
## 7. BUYER'S PREMIUM, PAYMENT, FEES & TAXES
Buyer's premiums, accepted payment methods, credit/debit card processing fees, applicable taxes, declined-card fees, and payment procedures are stated in the auction's published **Payment Information** and are incorporated into these Terms & Conditions.
Successful bidders are responsible for the full purchase price and all applicable premiums, taxes, fees, shipping-related charges, and other amounts due under the published auction policies.
**No merchandise will be released or shipped until all required amounts have been paid in full.**
## 8. CREDIT/DEBIT CARD AUTHORIZATION
By registering and participating as an online bidder, the bidder authorizes the credit or debit card provided at registration to be charged for amounts due in connection with successful purchases in accordance with the auction's published Payment Information and Shipping & Pickup Information.
This may include the purchase price, Buyer's Premium, applicable taxes, processing fees, shipping, packaging, handling, insurance, and other charges authorized by the published auction policies.
## 9. PICKUP & REMOVAL
Successful bidders are responsible for picking up purchases during the **published pickup period** unless alternate arrangements have been approved by Martin Vintage Sales.
Selecting local pickup **does not guarantee that merchandise will be held beyond the published pickup deadline.**
Buyers are responsible for bringing appropriate assistance, vehicles, tools, equipment, and packing materials necessary to safely remove their purchases.
Buyers may not leave unwanted portions of a purchased lot behind without prior approval.
## 10. MISSED PICKUP & AUTOMATIC SHIPPING
If a buyer selects local pickup but fails to pick up purchases during the designated pickup period, **shippable items will automatically be prepared for shipment unless alternate arrangements were approved before the pickup deadline.**
**This applies regardless of how close the buyer lives to the auction location.**
Applicable shipping, packaging, handling, and insurance charges will be charged to the credit/debit card on file in accordance with the published Shipping & Pickup Information.
If the required shipping charges cannot be successfully collected, the merchandise cannot be shipped. Items remaining unclaimed and unpaid for shipping may be considered forfeited or otherwise handled in accordance with applicable law and the published auction policies.
Where legally permitted, **no refund will be issued for forfeited merchandise.**
## 11. SHIPPING
Shipping availability, procedures, insurance, packaging and handling charges, third-party shipping requirements, and other shipping provisions are detailed in the auction's published **Shipping & Pickup Information** and are incorporated into these Terms & Conditions.
Buyers are responsible for providing a complete and accurate shipping address.
Additional expenses resulting from an incorrect address, refused delivery, returned package, or other delivery issue attributable to the buyer are the buyer's responsibility.
Large, oversized, unusually fragile, specialty, or restricted items may require third-party packing or shipping at the buyer's expense.
## 12. NON-SHIPPABLE, UNCLAIMED & ABANDONED PROPERTY
Certain oversized, furniture, machinery, specialty, restricted, or other items may not be eligible for standard shipping.
Buyers of non-shippable merchandise are responsible for arranging timely removal.
Unless alternate arrangements have been approved, property remaining beyond the required removal period may be subject to reasonable storage, moving, transportation, resale, disposal, or other costs or remedies to the extent permitted by applicable law.
## 13. LOADING & REMOVAL LIABILITY
Buyers and their representatives are responsible for the safe loading, removal, handling, and transportation of purchases.
To the extent permitted by law, Martin Vintage Sales, its employees, agents, consignors, and the property owner are not responsible for injuries, accidents, or property damage caused by or arising from a buyer's or buyer's representative's loading, removal, handling, or transportation activities.
Buyers are responsible for damage they or their representatives cause to the auction premises or other property during removal.
## 14. FIREARMS & REGULATED ITEMS
Firearms and other regulated items are subject to all applicable **federal, state, and local laws and regulations.**
Where required, firearms must be transferred or shipped through an appropriately licensed **Federal Firearms Licensee (FFL).**
All applicable firearm transfer fees, background check fees, shipping charges, and other costs associated with the lawful transfer of a firearm are the responsibility of the buyer. Transfer-related costs may vary depending on the firearm, transfer requirements, receiving FFL, buyer's location, or other applicable circumstances.
### OUT-OF-STATE BUYERS
Firearms purchased by out-of-state buyers will be transferred or shipped in accordance with all applicable federal, state, and local laws.
When required, firearms will be shipped only to a valid FFL authorized to receive the firearm.
The buyer is responsible for locating a receiving FFL, ensuring that the FFL is willing and legally able to accept the firearm, providing all required FFL information in a timely manner, and paying all applicable shipping, transfer, background check, and other related fees.
**Martin Vintage Sales does not guarantee that a particular firearm can legally be transferred or shipped to every state or jurisdiction.**
It is the bidder's responsibility to determine **before bidding** whether the firearm can legally be purchased, transferred, received, and possessed in the bidder's state or local jurisdiction.
### BACKGROUND CHECKS & TRANSFER ELIGIBILITY
All required identification, paperwork, background checks, and transfer requirements must be completed before a firearm will be released to the buyer.
A delay in a background check or transfer approval **does not constitute a denial.** The firearm will remain subject to all applicable legal transfer requirements while the transfer is pending.
If a buyer is denied, is legally prohibited from receiving the firearm, or is otherwise unable to lawfully complete the required transfer, **the firearm will not be released to the buyer.**
Martin Vintage Sales reserves the right, subject to applicable law, to cancel the transaction, resell the firearm, return it to the consignor when appropriate, or make another lawful disposition of the firearm.
The buyer is responsible for any applicable transfer fees, shipping charges, return shipping charges, resale expenses, or other costs incurred as a result of the buyer's inability to complete the transfer.
**Bidders are responsible for determining their legal eligibility to purchase and receive a firearm before placing a bid.**
A buyer's inability or failure to legally receive, possess, or complete the required transfer of a firearm or regulated item **does not automatically cancel the buyer's purchase obligation or entitle the buyer to a refund.**
Firearms will not be released or shipped until all applicable purchase amounts, fees, and legal transfer requirements have been satisfied.
Any additional firearm-specific requirements published with an auction or individual lot are incorporated into these Terms & Conditions.
## 15. FAILURE TO PAY
Successful bidders are obligated to complete their purchases.
Failure to make required payment may result in suspension or revocation of bidding privileges, resale or other lawful disposition of the merchandise, and any other remedies available to Martin Vintage Sales under applicable law.
The bidder may remain responsible for amounts lawfully due under the auction's published terms.
## 16. CHARGEBACKS & PAYMENT DISPUTES
Buyers who believe a charge is incorrect should promptly contact Martin Vintage Sales so the matter can be reviewed.
Initiating a credit/debit card dispute or chargeback does not eliminate obligations otherwise owed under these Terms & Conditions.
Martin Vintage Sales reserves all rights and remedies available under applicable law regarding unpaid balances or disputed transactions.
## 17. AUCTION CHANGES & ANNOUNCEMENTS
Martin Vintage Sales reserves the right to correct typographical errors, catalog errors, photographs, descriptions, lot information, or other mistakes when discovered.
Announcements, corrections, or updates made before or during the auction may supplement or correct previously published information.
## 18. RIGHT TO REFUSE SERVICE OR BIDDING PRIVILEGES
Martin Vintage Sales reserves the right, subject to applicable law, to refuse or revoke bidding privileges for legitimate business reasons, including nonpayment, repeated declined payments, failure to retrieve purchases, violation of auction rules, fraudulent activity, abusive or disruptive conduct, or misuse of the bidding platform.
## 19. GOVERNING LAW
The auction and these Terms & Conditions are governed by applicable federal law and the laws of the **State of North Carolina.**
If any provision of these Terms & Conditions is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
## 20. ACCEPTANCE OF TERMS
**BY REGISTERING, BIDDING, OR PURCHASING AT THIS AUCTION, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO THESE TERMS & CONDITIONS AND ALL OTHER PUBLISHED AUCTION POLICIES.**
If you do not agree to these Terms & Conditions, **do not register or place a bid.**
