Wildfire Auctions - Terms & Conditions These Terms & Conditions apply to all sales conducted by Wildfire Auctions, whether held in-person or online. By registering to bid, you agree to these terms in full. Please read carefully. Online Bidding Disclaimer: Auction Company utilizes third party bidding platforms (herein “bidding platform”) to facilitate the collection and recording of online bidders. By agreeing to these terms, bidders agree to hold harmless Auction Company and all Bidding Platform providers for technical errors and mistakes that may arise from connectivity issues on the part of the Auction Company and the bidder. Errors may occur. ALL GOLD COINS AND JEWELRY: The Auction Company does not accept credit payment for the purchase of gold coins and any gold jewelry with purchase price over $250. If your invoice includes gold coins or jewelry, you will be required to tender payment by cash, money order or certified check (items are not released until check clears bank), or wire transfer. 1. Registration & Bidding All bidders must be 18 years or older and provide valid identification and contact information. - Online bidders must register and be approved prior to bidding. -Wildfire Auctions reserves the right to refuse or revoke bidding privileges at any time. -Bids are binding. Once placed, bids cannot be retracted or canceled. Sales Tax Exemption Requirement All claims for sales tax exemption must be submitted no later than eight (8) hours prior to the scheduled start of the auction. Any exemption documentation received after this deadline will not be accepted, and applicable sales tax will be assessed on the invoice. To claim a sales tax exemption, purchasers must submit a fully completed West Virginia Streamlined Sales Tax Exemption Certificate (SSTGB Form F0003). No other exemption forms will be accepted unless otherwise required by applicable law. The required form may be obtained here: ?https://tax.wv.gov/documents/sst/f0003.pdf Failure to timely submit a properly completed exemption certificate will result in the collection of all applicable sales tax. (?tax.wv.gov) 1. Payment: The credit card on file with your online account via HiBid will be charged automatically at the conclusion of the auction. If your card on file is declined or cannot be processed for any reason, you will be contacted within 24 hours to arrange alternate payment. Your invoice must be paid in full before taking possession of the items. You have 12 hours from the time Wildfire Auctions attempts to contact you to make payment. If you fail to make payment, you will be blocked from future auctions and a negative review will be left. All purchases must be paid in full at the auction’s end unless otherwise stated. - Accepted forms of payment include cash, credit/debit card, or approved online payment gateway. -Buyer’s Premium: A 15% buyer’s premium will be added to all winning bids made online and 10% for all bids made and accepted in person. A 4% surcharge will be added for all credit card charges - Sales tax may apply where required by law. Tax-exempt buyers must provide a valid resale certificate prior to bidding. -Unpaid invoices after 48 hours may result in forfeiture of items and suspension of bidding privileges. - All purchases over $1000 must be sent via wire transfer, cash, certified check/money order (items will not be released until payment clears bank) or zelle. - Chargebacks by credit cards are known to be a form of scams/fraud and will be treated as such, and criminal charges filed and prosecuted to the fullest extent. All items are sold as-is and represented to the best of the auction house’s ability and photos provided. If there are problems, the auction house must be notified in writing and can be emailed at WildfireAuction@gmail.com. By placing any bid, buyer agrees to all terms and conditions. Any bidder making a chargeback will be automatically blocked and incur a fee up to $1000. 1. Pickup, Shipping & Handling - Pickup: All items must be picked up during scheduled pickup time and location unless prior arrangements are made. Pickup date will be listed in individual auction for all online winning bids. Items left for 24 hours after auction close or pickup date will revert to ownership of auction house and all rights will be forfeited from buyer. Items may be re-sold without any refund to buyer. If anyone representing Wildfire Auctions or a seller must meet for any additional pickup then a charge of $75 plus $25/hour will be charged. - Shipping: Available on select items. Buyer is responsible for all shipping and handling costs. Shipping is handled by our 3rd party professional shipping partner, Goin Postal. As a full-service shipping provider, their pricing may be higher than standard carrier rates due to packaging, handling, and service. Within 14 days after auction pickup, Wildfire Auctions delivers all items to be shipped to Goin Postal. At that time, any inquiries must be made to Goin Postal in Hurricane, WV. They can be reached at: 681-235-2657. Wildfire Auctions releases all liability upon buyer purchase and transfer to the shipping provider. A separate charge will appear on settlement and credit card on file once packages are packaged and weighed and shipping calculated. An email will be sent directly from the carrier (USPS, UPS, FedEx). In some circumstances, Jewelry may be shipped from our WV and Colorado locations. - Wildfire Auctions is not responsible for damage or loss once items have been transferred to carrier or pickup has occurred. ? 1. Item Descriptions & Authenticity -All items are sold AS IS, WHERE IS, with no warranties or guarantees expressed or implied. -Descriptions and photographs are provided in good faith, but errors or omissions may occur. -Jewelry and gemstone descriptions are based on visible characteristics and standard testing; no laboratory certification is implied unless stated. -Bidders are encouraged to inspect items in person during preview (one hour prior to auction start, in person if provided by auction listing) or contact us with questions prior to bidding. All bids are a legal binding contract and buyer understands that by placing a bid that they forfeit all rights for legal action against any person associated with Wildfire Auctions LLC and the auction house. 1. Equipment & Vehicles -All equipment and vehicles are sold as-is with no guarantee of condition or operability. -Buyer assumes full responsibility for testing, inspection, and safe transport. Auction Format & Disputes 1. Wildfire Auctions reserves the right to: -Add or remove items at any time -Reject any bid - Set or alter bid increments -Cancel or reschedule an auction as needed -In case of a bidding dispute, the auctioneer’s decision is final. 2. All sales are considered final once declared “SOLD.” Liability Wildfire Auctions, its owners, and staff are not liable for any injury, loss, or damage resulting from participation in the auction or the purchase/use of items sold. 1. Premises Liability and Assumption of Risk By entering any property owned, rented, or otherwise utilized by Wildfire Auctions, all individuals acknowledge and agree that they do so at their own risk. Any person entering the premises is responsible not only for themselves, but for all members of their party, including but not limited to children, guests, and individuals who are not registered bidders. All persons on the premises agree to hold harmless Wildfire Auctions, its owners, employees, agents, and the property owner(s) from any and all liability, claims, demands, damages, or causes of action arising from personal injury, property damage, theft, or loss of any kind, whether caused by negligence or otherwise. By entering the premises, individuals acknowledge and accept that there may be animals present on the property. All persons assume full responsibility for any and all interactions with animals and agree to hold harmless Wildfire Auctions and property owner(s) from any injury, damage, or incident resulting from such interactions. Shipping: Shipping is done by a 3rd party. They will contact buyer directly to get shipping info. There is no in-house shipping. Consignors -Consignors must have a signed consignment agreement prior to auction. -Payment to consignors is typically made within 30 business days after buyer payments are collected and cleared. -Wildfire Auctions reserves the right to photograph and advertise all consigned items. By entering auction house grounds, you are agreeing to be videoed and photographed and images used at Wildfire Auctions, LLC discretion. Governing Law These terms are governed by the laws of the State of West Virginia. Any disputes shall be settled in Mason County, WV, Or the city in which the auction is held, unless otherwise agreed. By registering to bid in any auction conducted by Wildfire Auctions, LLC, you consent to receive communications from Wildfire Auctions, LLC, including text messages, emails, phone calls, and printed mail related to auctions, bidding, account activity, promotions, and other business communications.
