Real Estate Auction Terms Of Sale: This auction is conducted by Mountain City Realty & Auction, LLC (Auction Company) for and on behalf of the owner(s) of the subject property and herein referred to as the seller(s). Auction Company is not responsible for the acts of the seller or statements made by the seller before, during, or after the auction. All terms or alterations must be in writing. The auction shall be governed by the terms set forth herein and any announcements communicated prior to the auction close. By the action of a registered bidder submitting a bid shall constitute the bidder's acceptance of each and every term. The conditions contained in these terms along with the conditions shall form a binding contract of intent to purchase between the Bidder and the Seller(s). All persons attending the preview and/or inspecting the property assume all risks whatsoever of damage or loss to person and property and specifically release the Seller(s) and Auction Company from all liability. Seller(s) nor Auction Company are not liable by reason of any defect or condition of the property or the premises on which the preview/sale is held. Seller(s) and the Auction Company is hereby released of any claims or actual damage to the subject property being sold and/or consequential damages that may result from the sale of any defects of property whether structural, fixtures or equipment. PAYMENT TERMS: A signed contract and a nonrefundable downpayment of 10% of the total sales price is required from the high bidder(s) immediately (24 business hours) after confirmation of final bid and the balance due at closing on or about 60 days. Downpayment must be in the form of a wire transfer or check drawn on a US bank. The signed contract and nonrefundable downpayment is due within 24 business hours of the auction ending unless other arrangements have been made with Auction Company PRIOR to the close of the auction. Title shall be delivered free of all liens or encumbrances as more specifically set forth in the Sale Contract. All settlement and closing costs will be the responsibility of the buyer and the property taxes will be prorated as of the day of settlement. BUYER'S PREMIUM: A 6% buyer's premium will be added to the high bid to determine the final sales price. Buyer agrees to these provisions and will pay the applicable buyer's premium. Starting Bid is not the sales price. Sold AS-IS with no warranty expressed or implied. All inspections need to be made PRIOR to end of auction. Seller reservers the right to accept or reject any and all bids. High bid subject to seller confirmation of the bid.
