Currency & Premium All bids are in U.S. Dollars (USD). A 15% Buyer's Premium will be added to all winning bids. Bidding Format Online bidding only. This is a timed auction with soft closing. If a bid is placed during the final minute of a lot's closing window, that lot's closing time extends automatically. Bids are for the entire lot, not per piece. Multi-item lots sell for the bid amount total, not the bid amount multiplied by the quantity. Condition of Items All items are sold AS IS, WHERE IS, with no warranties or guarantees, expressed or implied. Natural stone contains inherent variation. Veining, color, pattern, fissures, pitting, and mineral deposits are natural characteristics of the material and are not considered defects. Slabs, tile, and remnant material may show chips, edge damage, scratches, or prior fabrication cuts. Dimensions, thickness, and square footage are approximate and provided for reference only. Bidders are responsible for verifying size, thickness, finish, and condition before bidding. We make reasonable efforts to photograph and describe items accurately, including visible damage. Not all flaws may be noted or photographed. Slabs stored on A-frames or racking may not be viewable from all sides. By bidding, the bidder acknowledges and accepts the condition of the item. Sales & Payment All items are sold to the highest bidder. All sales are final. No refunds or exchanges will be issued. The Auction House is not responsible for errors or omissions in listings or descriptions. Applicable Texas sales tax will be collected unless a valid resale or exemption certificate is provided. Certificates must be submitted prior to payment. Tax collected on a paid invoice will not be refunded after the fact. Payment is due immediately upon auction close unless otherwise stated. Failure to remit payment may result in cancellation of the sale and loss of bidding privileges. The Auction House reserves the right to charge the payment method on file for any unpaid invoices. The Auction House reserves the right to require wire transfer for any high-value invoice at its discretion. Transport Requirements Buyers must arrange their own transport or freight. No exceptions. Professional transport is required for all slab material. Acceptable transport includes A-frame trailers, slab racks, or commercial flatbed equipment with proper strapping and securement. Individual slabs commonly exceed 600 pounds. The Auction House reserves the right to refuse to load any item onto a vehicle that, in its sole judgment, is not properly equipped, rated, or configured to carry the material safely. This includes but is not limited to passenger vehicles, pickup beds without racking, open utility trailers, box trucks without securement points, and any vehicle showing inadequate tie-down capacity or load rating. A buyer refused loading for this reason remains obligated for payment in full and must return with suitable transport within the scheduled pickup window. No refund or extension will be granted. Pickup Terms The buyer is solely responsible for pickup and removal of items. Loading equipment and an operator will be available on site to load purchased material onto the buyer's transport. Buyers may not operate facility equipment. Buyers and their agents must remain in designated areas during loading and follow all site safety instructions. Securing, strapping, and safe transport of the load is the buyer's sole responsibility once material is placed on the buyer's vehicle. The Auction House and the facility owner assume no liability for damage occurring during or after loading, or for damage to the buyer's vehicle or equipment. All items must be picked up during the scheduled pickup dates and times. Failure to do so will result in forfeiture of the items with no refund, and the buyer will still be charged in full. No packing materials or crating will be provided. Closed-toe shoes are required on site. Personal protective equipment may be required at the facility's discretion. Shipping Shipping is not offered or coordinated by the Auction House. Buyers who require shipping must arrange it themselves with a third-party shipper or freight company of their choosing. The Auction House will work with any shipper or freight carrier the buyer arranges, including releasing material and loading onto the carrier's equipment during the scheduled pickup window. All scheduling, cost, insurance, and communication with the carrier is the buyer's responsibility. All transport requirements above apply equally to third-party carriers. The Auction House reserves the right to refuse loading onto any carrier vehicle not properly equipped for the material. Buyers must notify the Auction House of a third-party pickup in advance and provide the carrier's name and expected arrival time. Carriers arriving outside the scheduled pickup window may be turned away. Liability & Indemnification Buyer agrees to indemnify and hold harmless East Liquidation Co., LLC, its owners, employees, and affiliates, and the facility owner and its personnel, from any claims, damages, or liabilities arising from participation in the auction, presence on the premises, or pickup, loading, and transport of items. Title Transfer / Risk of Loss Ownership of items transfers to the buyer at the time of payment. Risk of loss or damage passes to the buyer at that time, including during pickup, loading, and transport. General Terms The Auction House reserves the right to refuse service to any bidder and to cancel or reopen any lot in the event of disputes or system issues. East Liquidation Co., LLC employees or agents reserve the right to bid on any auction. By registering and bidding, the bidder agrees to all terms and conditions outlined herein. Default / Non-Paying Bidders Failure to pay for won items may result in bidder suspension, reporting to the auction platform, and/or legal action for recovery of fees and damages. Chargebacks By placing a bid, the bidder agrees not to initiate chargebacks or payment disputes. Any disputes must be resolved directly with the Auction House. Internet / Platform Issues The Auction House is not responsible for missed bids, delays, or system errors caused by internet or platform issues.
