Auction and Sales Terms and Conditions 1. Acceptance of Terms By registering for the auction, placing a bid, or purchasing any item, the buyer confirms that they have read, understood, and agree to be legally bound by these Terms and Conditions. 2. Nature of the Sale All products offered in this auction or sale are items consigned or supplied by third-party vendors or suppliers and are sold through the auction platform or store in accordance with these Terms and Conditions. 3. Binding Bids All bids placed during an auction are binding and irrevocable. By placing a bid, the bidder enters into a legally binding agreement to purchase the item if declared the winning bidder. 4. Buyer’s Premium and Taxes A buyer’s premium or service fee may be added to the final purchase price at a rate determined by the seller. Applicable sales taxes and legally required fees will also be added where required by law. 5. Seller’s Rights The seller reserves the right, at its sole discretion, to: • Withdraw any item from the auction at any time before the sale is finalized • Reject any bid considered inappropriate or insufficient • Combine, divide, or reorganize lots or groups of items • Resolve any bidding dispute and determine the final winning bid 6. Condition of Products All items are sold “AS IS, WHERE IS,” and without any warranties or guarantees of any kind, whether express or implied, including but not limited to: • warranties of quality or condition • warranties of merchantability • warranties of fitness for a particular purpose • warranties of authenticity, brand, or origin unless explicitly stated in writing in the item description. 7. Descriptions and Images Item descriptions, specifications, and photographs are provided for reference purposes only. While reasonable efforts are made to ensure accuracy, they may contain errors or omissions. The seller assumes no responsibility for discrepancies between descriptions, photographs, and the actual item. 8. Final Sale All sales are final. No returns, exchanges, or refunds will be accepted once the sale has been completed. 9. Payment Full payment must be received within the time period specified by the seller. The buyer shall not be entitled to possession of any item until payment has been received and cleared. If payment is not received within the required timeframe, the seller reserves the right to: • cancel the transaction • charge applicable penalties • resell the item without notice • pursue legal recovery of any resulting losses. 10. Cancellation and Non-Payment Penalty If a buyer requests to cancel a completed purchase, refuses to complete payment, fails to complete payment within the required timeframe, or initiates a payment dispute or chargeback without valid legal grounds, the buyer agrees that: • the transaction constitutes a legally binding purchase agreement, and the buyer shall be responsible for a cancellation penalty equal to fifty percent (50%) of the total purchase amount, including the item price, buyer’s premium, applicable taxes, shipping costs, and handling fees. The seller reserves the right to charge this amount as liquidated damages, representing a reasonable estimate of administrative costs, lost sales opportunities, and resale risks associated with the cancellation. The seller may also: • resell the item • recover additional losses if the resale value is lower • pursue collection or legal action where necessary. 11. Shipping: We ONLY ship the products to customer address. The preparation and shipping period ranges from 10 to 15 business days from the date of order confirmation. Shipping costs are calculated based on the number of items ordered as follows: • 1 item: $10 shipping fee • 2–5 items: $8 shipping fee per item • 5 or more items: $45 shipping fee The buyer is responsible for paying the applicable shipping fees based on the quantity ordered. Unless otherwise stated, the seller is not responsible for any loss, theft, or damage once the items have been handed over to the shipping carrier. The seller reserves the right to charge storage fees, resell the item, or dispose of the item without refund or compensation. To the fullest extent permitted by applicable law, the seller, auction operator, employees, and agents shall not be liable for any indirect, incidental, or consequential damages arising from participation in the auction or the purchase or use of any item. If liability is established, it shall be limited to the amount actually paid by the buyer for the specific item. These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.
