HiBid Auction Terms & Conditions Auction Terms & Conditions Bidder agrees to comply with these Terms & Conditions as a prerequisite for the Harrison Auction and Realtor (“Auctioneer”) to accept the Bidder's Registration and to issue a Bidder Number. The Payment Due will be the final 'hammer' price plus the internet premium (3%). Payment Due in full within 48 hours from the conclusion of the auction unless you are financing it into loan or have made prior arrangements. Invoices over $5,000 must be paid by wire transfer unless previous authorization is granted by the auctioneer. If Auctioneer agrees to accept a payment via credit card, a 4.25% credit card fee may be assessed. Bidder agrees that insufficient available funds to pay the full Payment Due shall not be a valid defense for non-payment. An Auction Lot that calls for financing will require the Bidder to formally enter into a Contract for Deed with complete terms and conditions. By placing a bid, Bidder thereby agrees to be bound by the terms of the Contract for Deed, regardless of whether the bidder formally executes the Contract for Deed thereafter. If the Payment Due is not received within 48 hours after the conclusion of the auction, the bidder unconditionally authorizes the Auctioneer to charge any credit card on file for the amount due. Bidder authorizes the Auctioneer to send text messages to Bidder’s mobile phone and to send emails to bidder about other land buying opportunities. IF A WINNING BIDDER FAILS TO MAKE THE PAYMENT DUE IN THE STIPULATED TIME FRAME, BIDDER CONSENTS TO GRANT TO AUCTIONEER ONE-THIRD OF THE PAYMENT DUE (INVOICE AMOUNT PLUS ANY AMOUNT BEING FINANCED BY AUCTIONEER) AS LIQUIDATED DAMAGES OR SPECIFIC ENFORCEMENT, PLUS 150% OF AUCTIONEER’S LEGAL AND COLLECTION COSTS. UNLESS OTHERWISE SPECIFIED, TAXES OR FEES WHICH MAY BE OWED ON ANY PROPERTY IN THE AUCTION ARE THE RESPONSIBILITY OF THE BUYER. Bidder authorizes Auctioneer to act as Bidder’s agent to complete any closing documents, or any corrective documents thereafter. For each Lot, Bidder must specify the Deed Information: the name of the grantee and the address for the grantee. If Bidder fails to specify Deed Information within two weeks after payment of the Payment Due, Bidder authorizes Auctioneer to convey each Lot via deed using the Bidder’s name and address as registered in the auction. NO CREDIT CARD CHARGEBACKS: Each Bidder agrees to NOT, under any circumstances, initiate a credit card chargeback with respect to any charges. Bidder further agrees that if Bidder initiates a credit card chargeback, upon Auctioneer’s demand (1) Bidder shall withdraw such credit card chargeback and request the credit card issuer to re-credit all amounts to the account of the Auctioneer; and (2) Bidder shall be responsible for all costs and expenses, including but not limited to any attorney fees incurred by or on behalf of the Auctioneer, in challenging the credit card chargeback. BIDDER’S RESPONSIBILITY: Each bid is an irrevocable offer to purchase the assets included in the Auction Lot. Bidders are responsible for all bids made using the Bidder’s account and Bidder Number. If Bidder believes that an unauthorized person has placed a bid on the Bidder’s account, Bidder must notify the Auctioneer immediately by sending an e-mail to harrisonauctionrealtor.com. Bidders must also promptly report the incident to the relevant law enforcement authorities and send the Auctioneer a copy of any resulting police report; otherwise, Bidder will be held personally responsible for all purchases.
