Budget Barn – Online Auction Terms & Conditions
By registering for and bidding in any Budget Barn online auction, you acknowledge that you have read, understand, and agree to be legally bound by the following Terms & Conditions. These terms form a legally binding agreement between the bidder and Budget Barn.
1. Condition of Sale – As Is, Where Is
All items are sold AS IS, WHERE IS, with no warranties or guarantees of any kind, expressed or implied. This includes, but is not limited to, any warranty of merchantability or fitness for a particular purpose.
Bidders are solely responsible for inspecting items prior to bidding. Failure to inspect an item does not relieve the bidder of responsibility for its condition. Descriptions, photographs, and any statements made by Budget Barn are provided as a courtesy and are believed to be accurate but are not guaranteed.
By placing a bid, the bidder agrees to accept the item in its present condition.
Lot Quantities:
Some lots may contain more than one unit. When applicable, the bid price will be multiplied by the quantity listed. It is the bidder’s responsibility to review all lot details carefully before bidding.
All sales are final. Bids may not be canceled or retracted for any reason. Buyers do not have the right of abandonment. Items not picked up may be considered abandoned and subject to disposal fees charged to the card on file.
2. Bidder Registration & Account Responsibility
All bidders must register with accurate and complete information, including full legal name, address, phone number, and email address. A valid credit card (Visa, MasterCard, Discover, or American Express) is required to register and will be verified through a temporary authorization.
The registered credit card may be automatically charged for winning bids, buyer’s premiums, sales tax, shipping, handling fees, or penalties in accordance with these Terms.
Bidders are fully responsible for all activity conducted under their account, including activity by third parties. Securing account access is solely the bidder’s responsibility. No exceptions.
Budget Barn reserves the right to require a refundable deposit from certain bidders when deemed necessary.
3. Payment, Buyer’s Premium & Sales Tax
Payment is due in full according to auction terms and may be automatically charged to the credit card on file at auction close.
Invoices will include:
Final bid amount
18% Buyer’s Premium
Tennessee sales tax (applied to all purchases)
Tax Policy:
Tennessee sales tax will be charged on every purchase without exception.
No refunds, exchanges, or adjustments will be made for any reason. Sales tax exemptions must be submitted prior to auction close via email(support@budgetbarntn.com). Failure to do so will result in tax being added to invoice. No exceptions.
4. Chargebacks & Disputed Payments
By participating in the auction, bidders agree not to initiate chargebacks for any reason, including but not limited to buyer’s remorse, item condition, non-delivery, or misunderstanding of auction terms.
Any chargeback initiated will result in a minimum administrative fee of $500, plus all legal, collection, processing, and attorney fees incurred by Budget Barn. The bidder authorizes Budget Barn to charge these amounts to the credit card on file regardless of the outcome of the dispute.
5. Assumption of Risk & Indemnification
Bidders and their guests assume all risks associated with auction previews, pickups, and removal of items.
By participating, bidders agree to release, indemnify, defend, and hold harmless Budget Barn, its owners, employees, agents, clients, and property owners from any and all claims, losses, damages, injuries, or liabilities, including those arising from negligence.
Participation in the auction constitutes acknowledgment and acceptance of this assumption of risk.
6. Non-Payment, Default & Legal Enforcement
Winning bidders are fully responsible for payment and merchandise once the auction closes. Failure to pay may result in account suspension, forfeiture of items, and legal action.
Budget Barn is authorized to charge any unpaid balances, fees, storage costs, disposal costs, or penalties to the credit card(s) provided during registration.
Any legal action shall be governed by the laws of the State of Tennessee, and venue shall be proper in the courts of Tennessee.
7. Pickup, Removal & Abandoned Property
Buyers are responsible for removing all purchases within the stated pickup timeframe. Items not removed by the deadline may be deemed abandoned, and the buyer forfeits all rights to the merchandise.
Abandoned items may be resold, disposed of, or stored at the buyer’s expense. Storage, labor, and disposal fees may be charged to the credit card on file.
Buyers must bring adequate labor and equipment to load purchases. Budget Barn does not provide loading assistance. Budget Barn is not responsible for lost or stolen items once checkout is completed.
8.SHIPPING POLICY
Shipping Policy – Please Read Carefully
Shipping fees will be automatically charged to the card on file after the auction closes. All items will be shipped to the address on file — please ensure your information is correct before bidding.
Bidders must request shipping during registration. If you did not select shipping at registration, please email support@budgetbarntn.com as soon as possible to request it.
Any unpaid shipping invoice by the following Monday will result in the items being forfeited with no refund issued.
Once items leave Budget Barn and are in the possession of the carrier, we are not responsible for lost, delayed, or damaged packages.
Shipping costs (packing, handling, materials, insurance, and carrier fees) are the buyer's responsibility and are calculated after items are packed and weighed.
Payment
Shipping invoices must be paid in full before items are released. Payment is due before the close of the auction's pickup window, regardless of shipping status.
Failure to Pay
Unpaid shipping invoices result in automatic item forfeiture — no refunds will be issued. Budget Barn may relist, resell, donate, or dispose of forfeited items and may restrict or suspend the bidder's account.
Bundling
Multiple wins may be combined into one shipment when possible to reduce costs, at Budget Barn's discretion.
Liability
Once items are with the carrier, Budget Barn is not responsible for delays, damage, or loss. All claims must be filed directly with the carrier.
By participating in the auction, bidders agree to these terms.
9. Removal, Utilities & Property Protection
Buyers are responsible for proper disconnection and removal of items in compliance with all applicable local, state, and federal regulations.
If professional services are required (electrical, plumbing, gas, etc.), the buyer must arrange and pay for them. Any damage caused during removal is the buyer’s sole responsibility.

Placing a bid in a Budget Barn auction constitutes full acceptance of all terms stated above.
