The offering and sale of property in this auction by Orwig Auction and Event Center is subject to the following conditions of sale that may be modified or supplemented by announcements prior to or during the sale. By bidding at this auction each purchaser and bidder agrees to be bound by these terms and conditions of sale. 2. This auction is an absentee online auction with a live auction for the final bidding price. 3. All property is sold AS IS, WHERE IS, by lot and all bids are per lot as numbered in the online catalog. ALL SALES ARE FINAL and WINNING BIDDERS MAY NOT RETURN ANY ITEM THEY PURCHASE. All consignors have made written representation that they have good title to the property. No warranty, express or implied is made as to the transference of intellectual property rights. Buyer assumes risk of loss upon being declared the high bidder. 4. PAYMENT BY BIDDERS All bidding and purchases at the auction will be in U.S. Dollars. A buyer's premium of 10% will be added to the successful internet bids. These amounts will be added to the amount of the successful bid price for lots at the auction. All bidders will incur a $1.00 charge to their credit card for auction registration/bidder verification. This will appear on your final billing. An invoice will be emailed to all winning bidders at the conclusion of the auction. Acceptable forms of payment are Mastercard, Visa, or Discover . Purchaser’s Credit Card will be charge for full purchase price of items within 48 hours of the conclusion of the auction. Please contact the auctioneer with any other questions. Buyers will be required to have a paid receipt before loading. Purchasers hereby give irrevocable permission for Orwig Auction and Event Center to charge the credit card that they may have submitted with their request to participate in auctions, for any and all purchases made by them at this auction. 5. Statements and descriptions contained in the catalog, bill of sale, invoice, by auctioneer or elsewhere as to the manufacturer, artisan authorship, period, culture, source, origin, measurement, quality, rarity, provenance, importance, historical relevance or physical condition ARE QUALIFIED STATEMENTS OF OPINION ONLY AND ARE NOT REPRESENTATIONS OR WARRANTIES. Descriptions provided in any printed catalog, Internet catalog or Internet information do not include condition reports. The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear, tear, imperfections or the effects of aging. It is recommended all prospective bidders examine carefully all items in which they have an interest. You are welcome to inspect in person all items during our published inspection hours, and/or by appointment. We will assist you personally or by telephone, providing a physical description and our opinion. If you require absolute certainty in all areas of authenticity and description, we recommend you have an expert of your choice examine and research the item or lot for you OR that you do not bid on the item in question. By placing a bid, either in person, by phone, absentee or by Internet, you signify you have examined the items as fully as you desire to, or, you have chosen not to examine them. ALL SALES ARE FINAL. All lots are sold As-Is, Where-Is. Jewelry items are not returnable for any reason after they leave the auction premises, ALL SALES ARE FINAL. 6. Picking up your items: You, the winning bidder is solely responsible for the safe and timely pick-up and removal of any items you may won at this auction. All paid property shall be picked up at the purchasers expense. If you are unable to safely pick up and remove your items during the item pickup times that have been scheduled for this auction, PLEASE DO NOT BID. Bring help to load your items, boxes/tubs & any tools you may need to disassemble items. The Auctioneer does NOT hold items beyond the published removal times. The Auctioneer will not issue you a refund if you are unable to pick up and safely remove your items during the published removal times. Purchaser does hereby indemnify and hold harmless Auctioneer and Seller from any and all damages, claims or liabilities from injuries to persons or property of any type whatsoever caused during the sale or by the removal of items purchased. Purchaser assumes all risk and liability whatsoever resulting from the use of the item(s) sold hereunder; and shall defend, indemnify, and hold harmless Auctioneer and Seller from any liability. If need to schedule another pick up date and time there will be a $25 Charge of cash or check to meet. 7. Shipping Shipping is available on certain items. It is at the auctioneers discretion if an item can be shipped. Email or call the auctioneer with the lot number that is wished to be shipped to confirm that item is shippable. All shipping costs are at the winning buyers cost. These shipping costs will be charged to buyer’s credit card and appear on the final invoice. Please contact the auctioneer with shipping requests within 48 hours of the closing of the auction. If the auctioneer is not notified and has not agreed upon shipping, it is the buyers responsibility to pick up the item onsite at the designated pick up times. 8. Internet bidding – Online Auctions Joe Orwig , Auctioneer is providing Internet bidding as a service to the Bidder. Bidder acknowledges and understands that this service may or may not function correctly during the auction. Under no circumstances shall Bidder have any claim against Joe Orwig, Auctioneer or anyone else if the Internet service fails to work correctly before or during the auction. Joe Orwig, Auctioneer will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should verify high bid through online interface.
