ACCEPTANCE OF TERMS: By registering to bid, you accept all terms, conditions, fees, and other buyer requirements set forth by this auction. By registering for this auction, you are testifying that you are responsible and of sound mind to place financial bids and to be held financially accountable for the purchases of the lot(s) won. All bids are legally binding contracts under these terms. BUYERS PREMIUM: Our BP is 20% for this auction. If you bid $50.00USD on an item, your invoice will indicate $60.00USD. SALES TAX: Michigan 6% sales tax will be added to purchase amount for non-exempt Michigan buyers, and for those out-of-state buyers opting to pick up in person. REGISTRATION: All bidders must be at least 18 years of age and have all information be true and accurately filled out in order to register. Cash only applicants must be backed by a credit card at registration. We reserve the right to refuse any registration for any reason and will report any suspicious activity immediately to the authorities and bidding services. BIDDING: All bids are binding. If you are outbid on an item, but the winning bidder does not pay or pick up, we reserve the right to offer the lot to the runner-up bidder. (We believe in second chances!) AUCTION ITEMS: All items in our auctions are bid on with the understanding each lot is sold AS IS/WHERE IS, and your registration and bidding is an acknowledgement of it. Please study item photos carefully before bidding, as photos supersede written descriptions of items. However, you are bidding on what is described - there may be items in the background which are not included in the lot (unless stated otherwise). All non-shippable items must be picked up in person, at pre-scheduled times/dates, at the location which will be provided to you after the auction closes. SHIPPING: If you want your items shipped, please ensure that you are bidding ONLY on shippable items (there is an icon on each lot to indicate this). Shipping can be requested on lots marked "shippable" - smaller items will be handled in-house as expediently as possible, and larger items will be shipped by a third-party professional shipper. Please note that while we will diligently work to optimize shipping costs, transportation fees in general are quite!!! expensive. For in-house shipping, we charge for labor (if exceeds 30 minutes), packing supplies, insurance, and price of the shipping label (postage). On designated lots (as noted in the lot description) shipping will be through a "White Glove" delivery provider - this is a premium service and priced accordingly but ensures careful transportation for your items. PAYMENT: All cash payers must request to pay cash when they register for the auction - when payment has been made after the auction by credit card, we WILL NOT refund the credit card and let the bidder pay cash at pickup. For credit card payments, you agree that you will not charge back any amount that we charge to your credit card legitimately under this agreement and further agree that this provision applies equally to amounts charged in connection with any items you have won and any costs or fees discussed in these Terms and Conditions. We reserve the right to direct any buyer to pay via wire transfer only, at our sole discretion. AT PICKUP: All successful bidders will be expected to present a paid invoice (sent via email after payment) with a valid I.D. at pickup. If you need to have an agent pick up for you, simply contact us and supply the name of the person picking up. They will need your invoice and their own identification to verify before the items will be released. Pickup will be scheduled via ShippingSaint after the auction closes. You will receive a notice to select an appointment date and time. You must remove the items safely, and you agree to pay all costs associated with damages that may happen when you and/or your helpers are moving items. In the event that you damage anything while removing the items, your credit card on file will be charged for all costs associated with fixing said damages. If you request our help to load or pack up an item, you agree not to hold us liable for any damage to the items or property of any kind. ABANDONMENT: If you choose not to pick up your items after 5 business days and fail to contact us regarding alternate pickup arrangements, they will be considered abandoned and forfeited with no refunds given. You agree to not conduct a credit dispute in the event your card is charged for a partial or full payment for abandoned items. In the event that you proceed with a credit dispute anyway, you agree to pay us a $200 fee to cover the cost of the dispute and time associated with fighting it. AS SELLER: We reserve the right to reject bids for any reason. Also, we reserve the right to close any auction at any time for any reason. BIDDER AGREES: By registering and bidding, you agree to complete the transactions without issue and absolve us of any impulse purchases you may have committed to. In addition, you promise to assume liability of any damage to property you may create while on pickup premises. You also assume liability of your own safety and health while on pickup premises, and absolve us of any fault in your personal injury should you sustain any for any reason while picking up on premises. You agree also to not hold us liable for any damages or injury that results from the items that you won at auction. TEXTS: We may send ONLY reminder and informational texts to bidders at the registration's phone number. (We will not use your information to send promotional or advertising texts.) You are responsible for your carrier charges and data. INFO UPDATES: You agree to inform us of any changes in your contact and/or payment information as soon as it is known. MALFUNCTIONS AND BID ERRORS: You must contact us immediately if you bid in error (say, $900 rather than $9.00). Bidding errors CANNOT be fixed after the bidding has closed on those items, and we really can't assume any bid is an error. In the event there is a malfunction within the software and/or bidding for this auction, you agree that you will not hold us accountable. WINNING NOTIFICATION: We will invoice you via email listing the items you have won and amount you owe, with a payment link. Full payment for items is due within 48 hours. Please check your email after the auction has closed, and your SPAM folder if you do not see it. In the event that you won an item at the auction and do not receive this email, contact us ASAP at (833) 380-7996. LEGAL DISPUTES: You must take all disputes to mediation rather than litigation for resolution. The bidder must choose a venue located within Monroe County, Michigan, and bidder agrees that the dispute cannot be combined with a dispute from any other person/party. The bidder agrees to pay for all mediation costs, regardless of the outcome. The seller reserves the right to use all legal means, including but not limited to, small claims court, to receive monetary damages resulting from actions of the bidder. CHANGES: These Terms and Conditions can be changed at any time without notice. Please read these terms and conditions each time you register for one of our auctions. Invoices containing a payment link will be sent to the bidder's email upon auction close and must be paid within 48 hours. If you are planning to pay with cash at pickup, you must notify us prior to the end of the auction. Please study our terms and conditions for items that are won and not picked up. No checks accepted. Any purchase over $500 must be paid via wire transfer, WesternUnion, Zelle, or cash at pickup. All items must be paid in full before they will be released.
