Terms: 1. Successful bidder will sign a standard Offer to Purchase form directly following the auction. Offer will be an offer with no contingencies of any kind. 2. Earnest money shall be $50,000 per parcel and will be collected immediately following the auction (within 24 hours for online bidders). If the high bid is accepted, the earnest money will be applied toward the purchase price. If the bid is not accepted, the earnest money will be returned to the buyer. 3. There will be a 4% Buyers Premium added to the high bid to determine the final sales price. 4. The offer is subject to approval of the owners, who will have until June 4, 2026. The seller may accept, reject, or counter today's high bid. 5. This offer may not be rescinded prior to Midnight of June 4, 2026. 6. In the event of a counteroffer, today's high bidder will be given the first opportunity to accept any counteroffer. 7. A Real Estate Condition Report has not been and will not be provided. Interested buyers may do any inspections prior to the auction, buyers shall rely entirely on their own inspections of the properties and records. The buyer is purchasing the property in it's AS IS condition. No warranties are made as to any aspects or uses regarding the property. 8. If the offer is accepted, closing will take place on or before July 15, 2026. 9. Real estate taxes will be prorated at the time of closing based on the 2025 taxes. 10. Tillable acreages were derived from FSA maps but are not guaranteed. 11. Tillable grounds have been rented for the 2026 growing season, the first half of the rent will go to the seller, the second half will be payable to the buyer directly from the renter at the end of the growing season. 12. All parcels, with the exception of tract #9 - Wachter Farm, have been surveyed and will be sold by the surveyed acre. The Wachter farm will be sold by the tax legal description and by the dollar. 13. A preliminary title policy has been provided by NEW Title and is available for review. Buyers are accepting the policy as it reads. 14. Tract #1 - Schneller Farm 282.79 acres will have an ingress/egress access easement to allow access to the feed bunk on the adjoining parcel to the Northwest. There is a PRD easement area consisting of approximately 111 acres on the South side of this tract as shown on maps available for review prior to the auction. There is an existing ingress/egress/utility easement crossing the property to the North giving access to this tract & adjoining landowners from County Highway E in Witwen. Buyer accepts this tract with the easements and PRD area. There is a gas line crossing the southeast corner of the property. The gravel field drive from Hwy O on the southeast corner of the property is partially on the neighboring property. An irrigation pivot is included in the purchase of this tract. $100,000 will be allocated for the irrigation system and well pump. 15. Tract #2 - Schneller Farm 69.89 acres. There is an easement from 1930 shown on the title commitment. The legal description of the easement is very loosely defined. To the best of our knowledge this easement at one time granted access across parcel 2 somewhere near the Western property line giving access to a parcel to the back of Parcel 2. There is no evidence of use of this easement. 16. Tract #4 - Reisinger Farm 91.88 acres has a PRD easement (Doc #1166517) area consisting of approximately 23 acres as well as an access easement (Doc 869719) on the East corner of the property. There are slight encroachments of fences, gravel, and a roof along the West property line near Blackhawk. These are all shown on CSM 6851. 17. Tract #9 - Wachter Farm 217.03 +/- acres has not been surveyed and is being sold by the tax legal description. This farm is subject to a conservation easement Doc 892071 with the Wisconsin DNR and a Life Estate for Terry Wachter for the Northern house at E9974 State Road 60 Prairie du Sac, WI. Copies of both documents are available for review prior to the auction. The larger house is vacant. Both homes are sold AS IS. 18. Tract #10 - Gasser Farm 77 +/- acres. There is a deed restriction (Doc #898697) on this property stating that no animal confinement building or feedlot may be constructed within 1,000 feet nor any building for storage or repair of farm machinery may be constructed within 500 feet of the house shown on CSM 5204, No manure may be hauled on lands during the months of May through August within 500 ft of the house shown on CSM 5204 without permission of the homeowner. 19. Tract #12 - Anderson Farm 149.85 acres. Some fences, particularly the fence along the Northern 40 of the West property line, do not follow the property line.
