Spendwise Liquidations – Terms & Conditions Welcome to Spendwise Liquidations. By registering for and bidding in our auctions, you agree to the following Terms & Conditions. Please read them carefully before bidding. Questions: SpendwiseAuctions@gmail.com Payment Payment is due immediately upon auction close. Your invoice will include: Winning bid amount 15% buyer’s premium North Carolina sales tax, unless exempt Sales tax exemption requires a valid North Carolina resale certificate submitted before bidding. Certificates must be emailed to SpendwiseAuctions@gmail.com . Late submissions will not be accepted. Accepted payment methods: Automatic charge to the card on file Credit or debit card at pickup Cash at pickup by prior arrangement only Cash payments must be requested by emailing SpendwiseAuctions@gmail.com within one (1) hour of auction close. Failure to arrange cash payment will result in automatic card processing. Unpaid Invoices All unpaid invoices result in immediate and permanent ban. All unpaid invoices must be paid in full to settle the account Partial payments and payment plans are NOT accepted Payment of an outstanding balance does not guarantee reinstatement Management reserves the right to permanently deny future bidding privileges Non-payment constitutes a breach of contract Outstanding balances remain due regardless of account status. Breach of Contract – Non-Payment & Enforcement By placing a bid, the bidder enters into a legally binding contract with Spendwise Liquidations. Failure to remit full payment and comply with pickup requirements constitutes a material breach of contract. In the event of non-payment or non-compliance, Spendwise Liquidations will pursue enforcement, including but not limited to: Immediate account termination and permanent ban Public notation as a NON-PAYING BIDDER within auction platforms and industry databases Submission of the unpaid balance to collections Legal action, including Small Claims Court or civil proceedings, to recover unpaid amounts and associated costs The bidder agrees to be held personally liable for all amounts owed. Any delay or decision not to enforce rights in one instance does not constitute a waiver of enforcement rights. Forfeited Items (Non-Payment & Missed Pickup) Items associated with unpaid invoices or missed pickup deadlines are forfeited. Forfeited items will not be released No credits, substitutions, or exchanges Payment made after forfeiture settles the debt only Disposition of forfeited items is at the sole discretion of Spendwise Liquidations There are no exceptions. Pickup Policy (ID REQUIRED) All items are local pickup only from: 136 W Academy St, Randleman, NC 27317 Pickup dates and hours are announced for each auction. Items not picked up by the stated deadline are considered abandoned and forfeited with no refund. Storage is not offered. Identification Requirement Valid government-issued photo ID is required for ALL pickups Items will be released only under the registered bidder’s invoice Third-Party Pickup (ID REQUIRED) Items may be picked up by the registered bidder or any individual presenting valid government-issued photo ID. No prior notice or authorization is required ID must be presented at pickup Items are released only under the registered bidder’s invoice The registered bidder remains fully responsible for payment, pickup, and compliance regardless of who retrieves the items. Individuals attempting to pick up items for banned or non-compliant bidders may be denied release and restricted from future auctions. Shipping We do not ship. No exceptions. Inspection & Preview (Highly Recommended) Preview appointments may be scheduled during business hours prior to bidding and are highly recommended, as all items are sold AS-IS, WHERE-IS. Listings include photos and descriptions for buyer review; however, previews provide the best opportunity to verify condition, completeness, and suitability. Failure to inspect items prior to bidding does not relieve the bidder of responsibility after purchase. No refunds, returns, or adjustments will be made for condition, missing parts, or functionality. All questions must be submitted before bidding. Item Details & Condition Items are sourced from major retailers and distributors and may include: Overstock Shelf pulls Undeliverable packages Customer returns Refurbished goods Listings may include stock photos for reference and actual photos of the item being sold. Only items shown in the actual photos are included. If it is not pictured, it is not included. Actual photos override stock photos and descriptions. Condition descriptions represent our best assessment but may not identify every flaw. Minor wear, marks, stains, odors, residue, scratches, scuffs, or signs of handling may be present. All items are sold AS-IS, WHERE-IS, with no warranties or guarantees. Mobile Devices & Activation Disclaimer All phones, tablets, and cellular-capable devices are sold as liquidation items and may be subject to: Carrier restrictions Manufacturer restrictions Enterprise or MDM locks Account, software, or activation limitations Carrier status, eSIM functionality, activation, MDM status, and compatibility are NOT guaranteed unless explicitly stated as tested in the lot description. Devices may power on and function on Wi-Fi while remaining restricted from cellular activation. Definition of “Unlocked” “Unlocked” refers only to carrier lock status at the time of testing and does not guarantee absence of manufacturer, enterprise, software, or account restrictions unless explicitly stated. Additional Condition Disclaimers Untested items are sold strictly as-is and should be assumed for parts or repair Electronics may be locked to prior user accounts Tools and gas-powered equipment are tested only for brief power-on “Works” means powers on only — not full functionality or completeness Buyers assume all risks related to repairs, missing parts, cosmetic condition, software restrictions, or functionality. Item Condition Guide New: Unopened, may show packaging wear Excellent: Light use possible; minor cosmetic flaws may exist Used: Visible wear expected For Parts or Repair: Non-functional or incomplete All Sales Final All sales are final. No refunds, returns, or exchanges. Bids cannot be withdrawn once placed. Spendwise Liquidations is not responsible for missed bids, internet outages, or platform errors. Third-Party Statements Statements by manufacturers, carriers, retailers, or third parties do not alter item condition or these terms. Only the written lot description and these Terms & Conditions govern the sale. Liability Waiver Buyers are responsible for loading and removing purchases. Spendwise Liquidations is not liable for injuries, accidents, or property damage during pickup. Chargebacks & Disputes By registering and bidding, you waive the right to initiate chargebacks or payment disputes.
