AUCTION TERMS & CONDITIONS
1. Binding Contract?All bids are legally binding. By placing a bid, the bidder enters into a legally enforceable contract and agrees to all terms and conditions of sale.
2. Payment Obligation?Payment in full is required within five (5) calendar days of auction close unless otherwise stated.?Failure to submit payment within the required timeframe constitutes default.
3. No Returns / No Refunds?All items are sold AS IS, WHERE IS, WITH ALL FAULTS.?The Seller makes no warranties or representations, express or implied, including but not limited to merchantability, fitness for a particular purpose, condition, quality, or completeness.?ALL SALES ARE FINAL. NO RETURNS. NO REFUNDS. NO EXCHANGES.
4. Inspection Responsibility?Bidders acknowledge they have had the opportunity to inspect the property prior to bidding and are relying solely on their own inspection and judgment, not on any descriptions, photographs, or statements provided by the Seller.
5. Risk of Loss?Risk of loss transfers to the Buyer immediately upon auction close, regardless of payment status, pickup status, or delivery method.
6. Removal & Liability?Buyer is solely responsible for loading, transportation, and removal of purchased items.?Seller is not responsible for damage, injury, or loss occurring during or after removal.
7. Default Remedies?If Buyer defaults by failing to pay within five (5) calendar days, Seller reserves the right to:?Cancel the sale?Relist the item?Seek recovery of the unpaid balance?Assign the debt to a third-party collection agency
Buyer agrees to be responsible for all reasonable costs incurred in enforcing this agreement, including but not limited to collection agency fees, court costs, and attorney fees where permitted by law.
1. Interest on Unpaid Balances?Any unpaid balance shall accrue interest at the rate of six percent (6%) per annum, as permitted under Virginia law, beginning on the date of default and continuing until paid in full.
2. Collections Authorization?Buyer expressly authorizes the Seller to assign any unpaid balance to a third-party collection agency if payment is not received within the required timeframe.
3. Credit Reporting?Buyer acknowledges that non-payment may be reported to credit bureaus in accordance with applicable law.
4. Governing Law & Venue?This agreement shall be governed by the laws of the Commonwealth of Virginia.?Any legal action arising from this agreement shall be brought in a court of competent jurisdiction located within the Commonwealth of Virginia.
5. Severability?If any provision of these terms is held unenforceable, the remaining provisions shall remain in full force and effect.
