ALL SALES ARE FINAL – NO RETURNS/REFUNDS!! Big Bang Auction assumes no responsibility for any missing or incorrect listing information. Big Bang Auction has put forth every effort in listing items for this auction to provide an accurate description of all items. All information is gathered from sources believed to be reliable, but is not guaranteed to be accurate. Item descriptions by staff are provided in good faith and are matters of opinion. Item descriptions can be edited or cancelled at any time without notice. It is the bidder’s responsibility to determine the condition of each item. Bidders are encouraged to attend scheduled inspection/preview days and times. All bidders agree that it is his or her own decision to bid and the amount he or she bids has been solely based on his or her own independent inspection and evaluation of items. Big Bang Auction, at it’s sole discretion, reserves the right to cancel this auction or remove any item or lot from the auction prior to the close of the auction. Photographs and Descriptions: Big Bang Auction regularly posts item descriptions and photographs to aid bidders in the bidding process and makes every effort to ensure that the descriptions and photographs posted accurately represent the items being offered for sale. In some photographs, multiple items may appear to be joined as a single unit, however, you should not assume that a lot consists of more than one item simply because various items appear connected or are featured in the same photograph. Also understand that, on occasion, the wrong photograph may be displayed for a given time. At all times you are bidding on items as they are described on this website, not as they appear in any photograph. Technical Difficulties: In the event that there are technical difficulties related to the server, software or any other online auction-related technologies, Big Bang Auction reserves the right to extend bidding, continue the bidding, or close the bidding. Neither the company providing the software or Big Bang Auction shall be held responsible for a missed bid or failure of the software to function properly for any reason. Payment: a) All purchases will automatically be charged to the buyer’s credit card on file with HiBid the morning following the close of the auction. If you do not wish to have your credit card charged for your purchases, please contact us at least 24 hours before the end of the auction to make other arrangements for payment. If we are not notified at least 24 hours before the end of the auction the credit card on file will be charged. b) Sales tax will be charged and collected on all purchases, as required by appropriate state/local laws. Please see information list for pick-up date(s) and location. Winning Bidder Responsibilities/Liability: Your winning bid represents an irrevocable contract. You are responsible for paying for all items in which you were the high bidder. If you cannot pay for items or do not agree to the Auction Terms, including the Buyer’s premium, please refrain from bidding. Winning bidders are responsible for repairs, if damage is done to the auction building upon loadout. Big Bang Auction does not lend out any equipment for loading items. Winning bidder is responsible for removal of all items won. Please plan to bring packing materials and boxes, if needed, as well as assistance to move heavy items to your vehicle and any tools that may be needed to dismantle. Big Bang Auction assumes no responsibility for your purchases. The winning bidder assumes and does agree to indemnify and hold Big Bang Auction and seller harmless from any future claim that shall pertain to fitness or use of the item being purchased. Persons attending during inspection, sale or removal of items assume all risks of damage or loss to person and property and specifically release and indemnify Big Bang Auction from liability. Neither Big Bang Auction or the seller shall be liable by reason of any defect in or condition of the premises in which the sale is held. Pickup & Shipping: Items are to be picked up on the arranged pick up days. If you are not able to pick up on the arranged pick up days, you must contact Big Bang Auction immediately to make other arrangements. All items not picked up within 7 days of the auction’s end date, when an alternative pick up arrangement has not been made, will be forfeited back to Big Bang Auction and subject to be reauctioned. No refunds will be issued and bidder will be subject to permanant removal from future bidding privleges. Big Bang Auction will ship items, at Winning Bidder’s Expense, that are small enough to be shipped in USPS Priority Mail or Flat Rate Boxes. Fragile items and items that weigh over 20 pounds will need to be picked up or Winning Bidder can arrange for shipping through a professional packing/shipping service at Winning Bidder’s expense. Winning Bidder is responsible for making shipping arrangements and all associated costs. Shipping and handling charges incurred by Big Bang Auction will be charged to the credit card on file upon completion of packaging and shipping. All packages being shipped by Big Bang Auction will be shipped with insurance no less than the price of the winning bid. All packages being shipped will have a minimum of $15 shipping and handling charge. Please allow 10-15 business days after the last scheduled pick up date for items to be shipped. No furniture will be shipped. Winning bidders of furniture must make their own shipping arrangements (including palleting) or take delivery of the furniture items at the auction house. Consignors & Bidders: a) All consignors must fill out a contract with Big Bang Auction, sign forms and abide by our terms listed. b) No consignor, seller, or agent for seller has the right to bid on their consigned goods. c) Any employee of Big Bang Auction may bid at any auction if they wish to purchase an item. d) All items become the sole responsibility of the winning bidder when the auctioneer confirms your bid as the successful winner. We are not responsible for lost or stolen items. e) If there is any dispute between two or more bidders, the auction company or its’ auctioneer, may decide the successful bidder. The decision of the auction company, or its’ auctioneer, shall be final and absolute. Reserves: Any and all items that Big Bang Auction agrees to sell are subject to a reserve as per Indiana State Auction Law. Documents: a) All documents must be completed in full by buyers and sellers. For Example: Death Certificates, Letters of Authority, Creditor Leins, and UCC's when purchasing vehicles, firearms, etc. b) All gun buyers will be required to fill out a 4473 form and pass a background check. Out of state buyers will be required to have any and all guns shipped to an FFL (Federal Firearms License) Dealer. Compliance: Big Bang Auction is in complete accordance with Indiana statutes and Indiana Administrative codes, Title 25, Title 812, Department of Revenue Tax Bulletin #20, and Reference IC 6-2-4. Currency USD Buyer Premium 15% Payment Terms All winning bidders must use the credit card on file with HiBid for payments, unless other arrangements have been made. All credit cards will be charged the morning following the close of the auction.
