NO SHIPPING IS OFFERED!!! PICKUP DATES (WITH APPOINTMENTS): After the auction ends, you will only have from Monday to Friday to pickup your items. Please book an appointment on our website to do so. If you require a different date or time, please send us an email and we will arrange a different appointment for you. REGISTRATION & IDENTIFICATION: At the time of registration, we collect information about you to verify who you are before you can bid. We collect credit card information to ensure that you are a qualified buyer. All bidders must be of legal age to bid. By registering you agree to receive emails sent to registered bidders for the auction you register for and any 2nd, 3rd parts etc. Registered bidders are not able to opt out of these emails but you will only receive emails for the auction you registered for or any related auctions. You may opt out of general emails by clicking on the "Unsubscribe" link found at the bottom of the email. If the link is not at the bottom, it is an email you cannot unsubscribe from. You give your consent to receive these particular emails by registering. PAYING FOR YOUR PURCHASES: There is no cost to register for an auction (Up to $1 may be charged to validate your card by Auctionflex the first time you register). Your credit card will not be charged unless you win and do not pay within the pick up period. When an auction closes, if you are the winner, you must attend during the allotted pick up time frame where you may pay EXACT cash, Visa, Mastercard or Debit (card must be physically present and pin used). We will not charge cards over the phone, online or entered manually). We DO NOT accept etransfers, certified cheques or money orders. If you cannot pickup during the alloted time, please call us or email us at samytraders2024@gmail.com or 647-219-1840. If you do not pick up during the allotted time and do not contact us, we will charge your card a 25% restocking fee (or $20, whichever is greater), your items will NOT be held for you and your account will be suspended. There will be a $50 admin fee to reinstate your account. By registering, you give SAMY Traders permission to charge these fees to the credit card you have registered with. If we are unable to charge the restocking fee the amount will be reported to the Credit Bureau. To reinstate your account there will be a $100 admin fee plus the outstanding restocking fee and BUYERS PREMIUM AND HST: ALL items will be charged a 15% Buyer's Premium + $1 handling fee and 13% HST REGARDLESS of the item. If an item is in any part tax exempt, bidders may keep their invoice and claim the exemption on their income tax. Full buyer's premium and full HST will be charged on all items. Bidders should factor this into their bid price. REVIEWING YOUR BIDS: During an auction you can check the status of your bids at anytime. Note that no bids can be withdrawn after they are placed for any reason including accidental bids and bidding on the wrong item. Be careful when bidding, ensure you have selected the correct item before clicking "bid". All items that are listed as sold as is, or untested are sold AS IS where is, with all faults with no guarantees that any item is fit for a particular use. All bids are legally binding and enforceable in Ontario, Canada. REMOVAL: All items are sold in place. Buyers are responsible to remove items properly and on time. Removal cannot take a long time, and everything has to be removed in one trip. Any plumbing must be shut off before being disconnected and any electrical that is disconnected must be capped. You must be bring any and all tools, equipment and labour required to disconnect and remove any items you purchase. We will only have security onsite that will not assist in any way with removal. Please plan ahead and come prepared. Any items not removed by the times shown will be deemed abandoned regardless of the price. WINNING NOTIFICATION & INVOICING: All winning bidders will be sent an e-mail invoice the day following the auction's closing. If you do not receive an invoice please check your junk mail and give us a call or email if you haven't received it. Even if you do not receive an invoice, you are still responsible for payment and pick up as stated in the auction. You can verify winning bids by logging into your account after the auction closes and checking each lot. If the lot says "Status", you have won. If it says "Outbid" you have not won. PICKUPS & REMOVALS: Dates and times for pickup will be posted on our website. We do not ship. Do not bid if you are unable to have your items picked up. Any item not picked up during the posted pickup times will be considered an abandoned item. Items are sold as is, where is, with all faults. If you abandon an item, your credit card will be charged a 25% restocking fee. CONDITIONS OF ITEMS SOLD & OUR ONLINE CATALOGUE: Our best efforts are made to represent all items accurately in descriptions and photographs; however, all items are ultimately sold on an 'as is, where is' basis, with all faults. No responsibility is assumed by SAMY Traders for any errors or omissions. Prices referenced are MSRP (Manufacturers Suggested Retail prices) and can be discounted significantly on the open market so do your own due diligence in researching values. All items are sold AS IS, however SAMY Traders may return an item at our discretion if there is an error in the listing. To be considered for a return, customers must email samytraders2024@gmail.com WITHIN 7 DAYS of picking up the item, describing the reason for requesting the return. If approved, the item MUST be returned in its orginal packaging, with all orginal accesoires and papers, and orginal product. If found that the product has been tampered with or switched with a defective item, you WILL NOT get a refund and will be charged a 25% restocking fee and will be reported for theft. to the stated location by appointment only, by 12pm on the Friday of the week the item was picked up and a credit will be placed on your account (no refunds will be given in any circumstance). SAMY Traders WILL NOT return an item after 12pm on the Friday of the week of pick up. There will be NO EXCEPTION to this. Customers who are unable to return by Friday or live too far away to make another trip must inspect their items THOROUGHLY before leaving the building when picking up to avoid having to make another trip. Returning the product to the stated location is at the cost and the responsibility of the bidder regardless of the item. CREDIT: By allowing you to bid we are extending you credit with the condition that you agree to pick up and pay for your items during the times posted using the payment terms specified. Failure to do so is a breach of the credit terms we have entered and can result in negative credit reporting and collections. By registering, you give SAMY Traders permission to charge the credit card you gave when registering as per the payment terms stated within the auction. We experience real costs when a customer fails to pick up their items as per the agreement and accordingly will pursue the terms of the agreement. Bids are not revocable and legally binding agreements between the seller and the buyer. MISSING LOT: Unfortunately with large online sales, items can go missing or be damaged from time to time. In the event that an item you had a successful bid on can't be located, your sole remedy is a refund of that item. No additional costs or expenses whether direct or indirect can be claimed for that item. No other items from your bill may be cancelled as a result of the missing or damaged item. SITE OUTAGE: In the event of a outage that affects bidding at any time during the closing on a sale, SAMY Traders at our discretion may extend the auction in it's entirety or in part (including lots that may have already closed) for a period of up to 24 hours. This decision will be made based on the severity of the outage. Previously closed items may be extended as there is no 100% way to determine that they closed prior to the outage and that all bidders who intended to bid were able to bid . This is an extremely rare occurrence but in the event that it happens we need to be fair to all bidders (including those who may not have been able to bid) as well as our consignors. CLAIMS: Claims can only be made on items that are not being sold 'as is' or 'un tested' or similar. You will have 7 days warrenty which is ONLY for if item is not the one you bidded on, the item does not match description, and is not fucntioning or missing key components. All claims are ultimately only approved by us by email. PERSONAL & PROPERTY RISKS: We will not be liable for damage or injury to individuals or their property. ADDITIONS & DELETIONS: We reserve the right to remove and/or add lots and/or items to the sale at any point during the auction. BUYERS: As a buyer, you agree to protect and hold SAMY Traders harmless from any claims, losses, expenses, damages, or liabilities that arise directly or indirectly from your actions related to the auction. This includes any negligence on your part or the part of anyone acting on your behalf during the auction. All bidders/buyers must be of legal age. RESERVE: Items are seldom sold with a Reserve. A "reserve" means there's a minimum price the seller will accept for the item. AUCTION RECORDS: In the unlikely event of a dispute, you agree to accept as true the information that we have in our records. SOFT CLOSE: Items close at regular intervals. To prevent a bidder from 'sniping', all bids made in the last minute of the auction will force an item to stay open for an additional 60 seconds. This will continue until all bidding has ceased. STRATEGY: Bidding is similar to Ebay type auctions, we recommend that ALL BIDDERS put in their maximum bid when placing a bid online. This does not mean you will have to pay the amount you bid; you only pay one bid more than the next highest bid, and only up to your maximum bid. The software system will play out the bids as you would at a live auction and only uses the funds required to beat out the under-bidder at the prescribed bid increment. CATALOGUE ERRORS & OMISSIONS: If a description does not match a picture in a lot, the description takes precedence. In the event an item was listed in error or an item can't be located during pick up for any reason, the bidder agrees that their maximum recourse is a full refund of the item in question and that all other items bid on remain binding. Items approved for a refund are returned at the buyers expense. IT IS THE BUYERS RESPONSIBILITY TO CHECK THEIR ITEMS BEFORE LEAVING THE PARKING LOT. LIMITATION OF LIABILITY You expressly understand and agree that SAMY Traders shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if SAMY Traders has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; or (v) any other matter relating to the service. By participating in our auctions and purchasing items, you acknowledge and agree to the returns and warranties terms and conditions: AS IS Sale: All items that are mentioned AS IS, UNTESTED, DEFECTIVE, FOR PARTS/REPAIR, DAMAGED (to the product), INCOMPLETE (missing key componets), EXPIRED, USED AS IS, NO WARRENTY, NO RETURNS. Or any others related to these in anyway are all classified as AS IS WHERE IS CONDITON AND ARE FINAL SALE. Returns at Our Discretion: SAMY Traders may, at its discretion, consider returning an item if there is an error in the listing. To be considered for a return, customers must email samytraders@gmail,com and return items within 7 days of originally picking up the item. Return Policy Pertaining to Electronics: It is your responsibility to thoroughly test all electronics before leaving the pickup location. Warranty Information: A 7-day warranty is provided for electronic items in specific situations. This warranty applies if the item received does not match the description provided, if an item described as working is found not to be functional, if an item listed as complete is missing components or accessories, or if an item described as brand new or sealed is received damaged or in a different condition. The warranty does not apply to items sold "AS IS" or "UNTESTED," nor does it cover returns due to buyer preference or dissatisfaction. The warranty period begins from the date of pickup. We are not an authorized dealer for any company, and as such, no warranties are honored through manufacturers. Return Timeframe and Process: SAMY Traders may accept returns after 24 hours of pick up, and there will be NO EXCEPTION to this policy. This includes all items regardless of their size, weight, or packaging. This policy applies uniformly to all items, including those that may require additional configuration or assembly. If the return request is approved, the item must be returned to the stated location by appointment only (if the return occurred after the time of pickup). Refunds will be processed back to the method of payment used for the purchase if the item is returned during active pick-up hours. If returned outside posted pick-up hours, there will be no cashier available, and the refund will be issued as AUCTION CREDIT ONLY. Inspection and Responsibility: Customers who do not want auction credit MUST inspect their items before leaving the parking lot. Customers unable to return within the stated time frame or living too far away to make another trip must thoroughly inspect items before leaving the building during pick-up to avoid additional trips. In the event of an offsite location or a return outside posted pick-up hours, SAMY Traders may determine whether the item must be returned to our location (This will be decided by SAMY Traders when approving the return). Refund Approval and Costs: Buyers are responsible for covering the costs and/or expenses associated with returning the approved item(s) to SAMY Traders. 7-Day Return Policy (Limited): You have a 7-day window for returns ONLY if: The product is not what you ordered. The item was listed as "new," "new open box," "tested," or "working," but you received it broken or damaged. If you meet these conditions, you are eligible for a return for in-store credit, provided the item is returned with its original packaging. Conditions for Ineligibility: You will NOT be eligible for the 7-day return policy if: The sticker or seal on the product has been removed or damaged. The product was opened (if we taped it shut). This also applies if the item was broken or damaged but was not described as such in the listing. By bidding you are acknowledging agreement with the terms above.
