All items are sold as is, where is, no guarantees expressed or implied. Buyers rely exclusively on his/her own expertise when bidding. Bidders/Buyers shall make final determination and satisfy themselves as to actual size, value, authenticity, condition and all other aspects of item(s) prior to bidding. Cash will not be accepted unless approve by Auctioneer PRIOR to bids being placed. 3. Address will be provided to winning bidders after payment is completed. 4.16% buyer's premium will be added to each purchase. There is a 3.5% fee for credit/debit card transactions. Example: If you bid $100.00, you will be charged $118.50 at check out. 5. If you purchase any fragile items and/or large lots, please bring your own packing material and boxes when picking up those items. We cannot supply boxes or packaging. 6. Our staff will gather the lots you purchased. However, PLEASE BRING HELP for loading what you buy. Our staff will not be available to assist in loading your vehicle OR removing furniture or appliances from house. 7. WE ARE NOT RESPONSIBLE FOR DAMAGES OR INJURIES DURING LOADING WHETHER OR NOT WE ARE ASSISTING. NO EXCEPTIONS. YOU ENTER , EXIT AND LOAD AT YOUR OWN RISK. You agree to indemnify, defend, and hold harmless Buffalo Creek Auctions LLC, its employees, officers, owners, affiliates, agents, and representatives from and against any claims, losses, damages, liabilities, judgments, fees, costs, and expenses, including reasonable legal fees and costs, related to, arising from, or associated with you, your agents or representatives including, but not limited to, personal injury or property damage caused or received at any sales site or during removal or transportation of items won at auction, any dispute with another bidder, or any violation of these Terms and Conditions. 8. In all cases, the Auctioneer's liability, and the liability of the seller of the items in this auction, will be limited to the refund of your purchase price and ONLY at Auctioneers sole discretion. There are no refunds for any reason regarding any shipped items, including shipping and/ or handling costs. All items are sold as is, where is with no guarantees expressed or implied, regardless of description. Bidder inspection is strongly encouraged to examine item(s) to his/her satisfaction prior to bidding. No refunds, all sales are final. 9. Bidder acknowledges the auction may be extended, cancelled or postponed if necessary, in the sole judgment of the auctioneer. In the rare event Buffalo Creek Auctions LLC must remove any item or lot from this auction due to unforeseen/ unexpected circumstances or other reasons, bidder understands that under no circumstances will Buffalo Creek Auctions LLC be liable for lost profits or any special, incidental, or consequential damage arising out of or in connection with this auction or any related sale or transaction. 10. The Auctioneer is not responsible for any action taken by any seller, bidder, or other third party before, during, or after this auction. 11. No Liability for Site Malfunction: Bidder understands that this auction relies on software, computers, electricity, and other factors to bring this auction to commencement and completion. Bidder agrees that the Auctioneer will not be liable for any errors, inconvenience, or loss of income that may result from any malfunction or issue, regardless of cause or effect. You further understand and agree that the Auctioneer MAY void or suspend any sale, or resell any item, if the Auctioneer determines a transaction(s) to have been affected by any site malfunction. 12. ALL ITEMS MUST BE PICKED UP ON THE DESIGNATED DAY ONLY. ANY ITEM NOT PICKED UP ON THE DESIGNATED DAY WILL BE CONSIDERED ABANDONED AND DISPOSED OF WITHOUT REFUND. IT IS BIDDER’S RESPONSIBILITY TO MAKE SURE THEY KNOW THE SPECIFIC DATE AND TIME TO PICK UP THEIR ITEMS AND TO DO SO ON THAT DAY. BIDDER WAIVES ALL RIGHT(S) TO DISPUTE CHARGES RELATING TO SUCH PURCHASES. 13. In the event of a dispute, auctioneer's decision is final. 14. Regarding bidding on any item, you are accepting full and complete financial responsibility for any and all items won using your username, and waive financial dispute regarding all related charges. 15. We reserve the right to reject any bid or or bidder registration, at our sole discretion before or after bids are placed. 16. Taxes are not included in bid. Taxes will be added to the total due if applicable. 17.By placing a bid you affirm that no bid(s) are retractable, and understand that no bid will be cancelled. 18. Buyer's premium of 16% will be adding to winning total. 19.Participation in auction requires registration approval and acceptance of Terms and Conditions of auction. Bidders with negative or no HiBid score may be restricted from participation. Failure to pay for any item(s) won may result in negative scores and may prohibit participation in future auctions. 20. Auctioneer reserves the right to cancel any/all bids from any bidder(s) with a history of not paying their invoices in full. 21. By registering to bid in this auction, you are accepting ALL Terms and Conditions contained herein without exception, and accept responsibility for ALL bids placed under your user name. 22. We reserve the right to cancel bids at any time at Auctioneers sole discretion. Reasons for cancellation include but are not limited to :registering with fictitious or false information, history of non-paying or not picking up items, suspicious bidding activity and more. 23.
