Payment / Buyers Premium
Buyers Premium: A 10% Buyers Premium is added to the final bid price to determine the final selling price.
Payment Terms: Payment must be made before items are removed by the specified date in the auction advertisement. All sales are final, with no returns, refunds, or adjustments.
Accepted Payment Methods: Harris Real Estate & Auction accepts Cash, Wire Transfer, Cashier's Check, Money Orders, and Credit Cards.
Auction Ending
Auto-Extend Feature: Auctions have an auto-extend feature. Any bid placed within 2 minutes of closing extends the auction by 2 minutes. This applies to individual lots only.
Outbid Notifications: Bidders will be notified via email if they have been outbid. It is recommended to place a max bid or monitor the auction close, as email notifications may be delayed.
Bidding Increments: Bidding increments vary by auction. The software will automatically calculate the next bid amount.
Auctioneer's Discretion
Modification of Sale: Harris Real Estate & Auction has discretion to modify the sale date, time, or details for any reason, including technical issues or emergencies.
Right to Cancel: Harris Real Estate & Auction reserves the right to cancel, remove, or re-catalog any auction item before the close of bidding.
Bid Rejection: Harris Real Estate & Auction reserves the right to reject any bids for any reason. An accepted bid is a legally binding contract.
Seller and Bidder Liability: The bidder assumes responsibility for items upon payment receipt and agrees to hold Harris Real Estate & Auction harmless for any issues related to the sale, including resale of unpaid items.

Acceptance of Bid Prices
Subject to Seller Confirmation: All bids are subject to seller confirmation unless stated as ABSOLUTE.

Bidder Responsibilities
Confidentiality: Bidders must keep their username and password confidential and are responsible for all account activity.
Age Requirement: Bidders must be 18 years of age or older.
Username Policy: Offensive or inappropriate usernames may be deleted or changed by Harris Real Estate & Auction.
Obeying Laws: Bidders must obey all local, state, and federal laws when using the auction website.
Website Activity Monitoring: Harris Real Estate & Auction may collect information such as the number of page visitors and most visited pages.
Waiver of Jury Trial: Bidders waive the right to a jury trial and agree to resolve disputes before a judge.

Bidder Verification
Identity Verification: Bidders' identities will be verified. Harris Real Estate & Auction reserves the right to reject bidders if verification is not possible.
COVID-19 Waiver: By attending the auction or preview, bidders assume all risks related to COVID-19 and waive any liability against Harris Real Estate & Auction.

Guaranty Agreement
Business Entity Bids: By submitting a bid on behalf of a business, the individual submitting the bid personally guarantees payment for any outstanding amounts, including collection costs.

Default
Default Policy: If purchases are not settled by the pickup day, the bidder is considered in default and may be blocked from future auctions. Unpaid items may be offered to the next highest bidder.
Collection Costs: The bidder agrees to pay all reasonable attorney fees and collection costs.

Limitation of Liability
Liability Limitation: Harris Real Estate & Auction's liability is limited to the return of paid money for undelivered purchases at pickup.

Disputes
Court Jurisdiction: Any dispute will be tried in a court of jurisdiction in Marshall County, Kentucky.

Iran Divestment Act
Certification: The buyer certifies they are not on the list of organizations engaging in investment activities in Iran as per TCA 12-12-106.

Acknowledgment
Agreement to Terms: By registering, bidding, and/or attending the auction, the bidder agrees to all the Terms & Conditions outlined by Harris Real Estate & Auction.
