Terms and Conditions – By registering for this auction you accept and agree to these terms and conditions. Payments: Immediately after the closing of each auction we will process your payment method on file for any lots you have won. This will include a 10% buyer’s premium and state sales tax. You will receive a confirmation email with a copy of your paid invoice. If you are a cash buyer you will receive an invoice with a balance due. If you do not receive an invoice, please check your junk/spam folder. Pickups and Shipping: Items cannot be paid for or picked up until the auction is complete in its entirety. Once the auction has completed, and the invoices have been created you will receive an emailed copy of your invoice and a text message indicating that you are a winning bidder. You will receive this email and text typically one hour after the auction has concluded. We have 6 days for pickups for each auction. We are closed on Sunday. Returns and Refunds: At DEP Auction Group we stand by our products. We understand that mistakes happen. Our staff from time to time will miss an important detail when inspecting items. Bid with confidence. We take accountability when we make an error. In the unfortunate circumstance that we do make an error in the listing, we will replace when able and refund when necessary. All items have a 3-day guarantee against misrepresentation or manufacturer defects. Due to this being an auction, we do not return or refund for any other reason. Please ensure that the items you are bidding on are the right size, color, shape, and model you are looking for. Please review item descriptions carefully for pertinent information By registering, you acknowledge and consent to receiving communications, including emails and text messages, sent to the registered email and phone number. If an item is labeled as "untested" in the description, this supersedes any other ratings it may have, such as "New" or "Like New." If the item is later found to be non-functional while still carrying the "untested" designation, a credit or refund will not be issued. Customers may receive full credit towards future purchases for any approved returns. Alternatively, if a refund to the original payment method is preferred, please note that a 15% credit card processing fee will be deducted from the refund amount. If you do not notify us to hold your item(s) before 6:00pm Wednesday, corresponding to the current auction, we will not be able to hold your items. Failure to contact us by Friday for the corresponding auction may lead to forfeiting credits for abandoned lots. We may consider a credit with a 15% restocking fee. If both parties agree to delay collecting items, they must be picked up within 14 days from last pickup day(s). Pickup is allowed only on scheduled dates. Items unclaimed by deadline are deemed abandoned and may be disposed or resold. Failure to collect on pickup day(s) may result in charges. This stands unless explicitly communicated and agreed upon by both parties. No credits shall be issued if you neglect to collect items. You're responsible for ensuring you receive all items at pickup and no credit will be issued for missing items after your pickup. Items may not be returned to us if more than 7 days have passed since the auction end date associated with that specific item. No credit or refund will be issued in such instances, regardless of the item's condition or whether the issue is our responsibility or not. Issued credits are deducted from your next DEP Auction Group balance. Use within 90 days. Failure to appear for pickup days and failure to contact us before the end of pickup days will result in forfeiture of lots. Forfeiture eliminates entitlement to a credit or possession. Such lots may be reauctioned or disposed of. The characteristics of items such as colors, descriptions, measurements, and images may not be consistent and can differ. The absence of decimal points, apostrophes, and quotations can cause discrepancies. For instance, a measurement might be presented as 1875 instead of the correct 18.75". Please note that if any misunderstanding arises due to these inconsistencies, our auction house is not to be held responsible, and we will not provide any refunds. Assume warranties and bundled memberships are invalid. Lots and sets may have missing components. Please be aware that in the case of any damages incurred by winning bidders during the removal process, DEP Auction Group cannot be held liable. The responsibility for the safe and proper removal of purchased items rests solely with the winning bidder. While employee assistance may be available, any resulting damages are not the responsibility of DEP Auction Group. Bidders are required to load and collect their purchases, and are advised to bring their own materials, including but not limited to plastic wrap, rope, straps, tape, and tarps, for adequately securing loads. Refunds and credits are at our discretion. “Removal” means attending pickup days or agreed-upon dates. DEP Auction Group functions as a subject-to-confirmation auction. Items listed are subject to final approval by DEP Auction Group before being considered sold. The highest bid at auction closure does not guarantee automatic sale. DEP Auction Group may accept or reject bids, offers, or final sale prices at our discretion, regardless of reserve prices. Items in this auction may have reserve prices set by DEP Auction Group. A reserve price is the minimum amount for an item to be sold. Regardless of the highest bid meeting the reserve price, DEP Auction Group can withdraw the item, rendering it unsold. We may negotiate or reintroduce items. DEP Auction Group can withdraw items before auction closure due to inaccuracies, pre-auction damage, disputes, or unforeseen circumstances. DEP Auction Group assumes no liability for losses, damages, or inconveniences from item withdrawals. Bidders acknowledge this prerogative for auction integrity. Decisions by DEP Auction Group on sales confirmation, bid acceptance, item withdrawal, and disputes are final. Bidders affirm their commitment to these decisions. By participating, bidders accept these terms, reserve listings, and DEP Auction Group right to withdraw items. Carefully review before bidding. All items are sold "as-is" and "where-is." DEP Auction Group disclaims any warranties, representations, or guarantees, expressed or implied, regarding the condition, quality, or fitness of items for a particular purpose. In no event shall DEP Auction Group be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use, misuse, or malfunction of items purchased from us, or from participation in our auctions or service usage.
