**Terms and Conditions of Online Auction Services** All bidders please understand this is a ONE DAY LOADOUT. You must pick up your items within loadout times or you may be subjected to your items being resold. **1. Acceptance of Terms** By accessing and using the online auction services provided by Downs Realty and Auction, you agree to comply with and be bound by the following terms and conditions. If you do not agree to these terms, please do not use our online auction services. **2. Registration and Account** 2.1 To participate in our online auctions, users must register for an account on our platform. All information provided during the registration process must be accurate, current, and complete. 2.2 Users are responsible for maintaining the confidentiality of their account information and for all activities that occur under their account. If there is any unauthorized use of your account, you must notify us immediately. **3. Auction Listings** 3.1 Downs Realty and Auction reserves the right to determine the eligibility of items for auction and to reject or remove any item listings at our discretion. 3.2 All item listings must accurately represent the condition, specifications, and any other relevant information about the item. Any misrepresentation may result in the removal of the item and potential suspension of the user account. **4. Bidding and Payment** 4.1 Bidders must be registered and logged in to participate in the auction. Bids are binding commitments, and users are responsible for all bids placed using their account. All bidders are subject to payment via card on file with HIBID. 4.2 The highest bid at the closing time of the auction will be deemed the winning bid. The winning bidder will be notified and provided with instructions for payment. 4.3 All payments must be made within the specified timeframe and in the accepted forms of payment. Failure to make payment may result in the cancellation of the winning bid and suspension of the user account. **5. Buyer's Premium** A 13% buyer's premium will be applied to the winning bid amount. The percentage or flat fee will be clearly stated in each auction listing. **6. Reserve Prices** Some items may have a reserve price, which is the minimum amount the seller is willing to accept. If the reserve price is not met, the item may not be sold, and the highest bid will be deemed null and void. **7. Dispute Resolution** 7.1 Downs Realty and Auction reserves the right to intervene and take appropriate action if there is a violation of these terms or if fraudulent or unethical behavior is suspected. **8. Removal of Bidder ** Downs Realty and Auction reserves the right remove or ban a bidder at any time without prior notice. In such cases, no contact with the bidder is required and no reason is needed. **9. Modifications to Terms and Conditions** Downs Realty and Auction may update or modify these terms and conditions at any time. Users will be notified of any changes, and continued use of our online auction services constitutes acceptance of the updated terms. **10. Governing Law** These terms and conditions are governed by and construed in accordance with the laws of Idaho. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in Idaho. By using our online auction services, you acknowledge that you have read, understood, and agreed to these terms and conditions.
