1. Online prebidding available for highlighted items up to Auction day Saturday April 15th followed by webcast and floor bidding starting at 10:00AM. 2. The majority of the tools and equipment will only be available in the live auction. 3. Live Auction bidding starts on Saturday April 15th at 9:00 am 4. For the on line auction items, the current high prebids will be the starting bid for these items in the live auction. 5. A clerk will bid during the live auction for webcast bidders as well as place bids for registered prebidders up to their maximum bids placed if needed. 6. At the close of the bidding for each online item, Hibid will show if a floor (live) or online bidder won the item. 7. Items can be previewed auction day from 8:00AM and on Friday April 7th from 10:00AM to 2:00 PM or with prior arrangements with the auctioneer 8. This auction has a 13% buyer's premium for online winning bids and 10% for on site for winning bids 14. Online winning bids will receive an invoice listing the items won. Payment is due at the time of pick up. Credit cards and cash are accepted. Cards accepted include MasterCard, Visa, American Express and Discover only. 15. A 3% Fee will be charged for CC users. 5% for American Express. 16. If you do not pick up your items on the specified date, the credit card you have on file will be charged. 17. By bidding in this auction, you are agreeing to all of the terms posted for this auction. 18. Shipping is not offered for this auction. 19. Declined credit cards can result in a buyer being banned from participating in future auctions. 20. This is a public auction and not a retail setting. All sales are final. No returns or charge backs are accepted 21. Any item purchased that requires dismantlement, a million dollar insurance certificate must be provided prior to dismantlement. A dismantlement form will be provided to the buyer prior to removal. Removal and rigging are to be at the purchaser’s own expense, risk, and liability. All rigging and delivery arrangements are strictly the responsibility of the purchaser and rigging company. D. Cole Auctioneering LLC and the owner takes no responsibility for these arrangements whatsoever. All purchases are made at the purchaser’s risk and the auctioneer is not responsible if all or any part is lost, stolen, damaged or destroyed from any cause. This information includes but is not limited to written and/or oral descriptions, year, make, model, machine or engine hours, physical condition, options, features, photographs, and other data pertinent to the value of the item. Bidder acknowledges that it is their responsibility to inspect all equipment and to make his own inquires. There shall be no guarantees or warranties, expressed or implied, statutory, or otherwise, of any nature whatsoever. Each, and every, lot will be sold “as is” “where is”. Specifically, but not to restrict the generality of the foregoing, D. Cole Auctioneering LLC makes no representation or warranty on any of the lots which are the subject of the auction. 22. Purchaser enters the property at their own risk and liability and holds D. Cole Auctioneering LLC harmless for any damage to goods during removal. Purchaser also holds them D. Cole Auctioneering LLC harmless and free of any liability whatsoever for any injury or claims of any kind by any person that may arise during the previews and/or removal of any item or while on the premises. 23. The Seller, or any of the Seller’s agents or employees, or D. Cole Auctioneering LLC or any of its agents or employees, shall not be liable to the Buyer or to Buyer’s agents, employees, contractors, or any other persons or entities acting on their behalf in connection with such removal of the Property, for any loss, damage, personal injury or death, of any kind or character to them arising either from the use of the property of the Seller pursuant to the License granted herein, or caused by any alleged defect or condition in any building, structure, equipment or facility, or any condition on the land of the Seller, any of which are alleged to be the cause of or contributing to the aforementioned loss, damage or personal injury or death. In addition, the Buyer agrees to indemnify and hold harmless Seller and D. Cole Auctioneering LLC and their respective agents, servants and employees of and from any and all liability for any loss, damage, expenses, personal injury or death of any person or persons arising out of, or relating to the removal of the above described Property. This indemnity and hold harmless agreement is to extend to Seller D. Cole Auctioneering LLC to the fullest extent permitted by law. 24.
