Terms and Conditions:
" By registering for this auction, you agree to all terms and conditions presented when registering.
" Failure to read these conditions is not the fault of The 6IX Auction.
" PLEASE BE SURE TO READ LOTS 1,2,3 in full prior to bidding. Click on auction information tab to learn more about auction opening, closing, curbside pick up, and shipping services.
" ALL items will be charged a 10% Buyer's Premium and 13% HST regardless of the item.
" ALL SALES ARE FINAL. ALL ITEMS SOLD "AS IS WHERE IS", no returns, no warranty, no refund,
no retraction of bids and no exchange accepted.
" By registering for this auction, you agree to all terms and conditions presented when registering.
" If payment isn't made before pick up, the transaction may be canceled with a fee of 20%
" of the auction lot price or $200, whichever is greater, and your account may be suspended.
" Soft Close of 2 minutes in effect.
" You need to register with a valid credit card.
" All items must be paid for and picked up no later than Sunday, May 23, 2021 at 5pm.
after this time, any items that are not collected will be considered abandoned and placed
back up for auction.
" If you fail pick up for your item(s) your credit card will be charged a $80 restocking fee.
" Items from this auction are from liquidation, closeouts, shelf pulls, customer returns,
and consignees. Condition ranges from Brand New, Open Box, Used, Distressed and/or missing parts.
" Buyers are responsible to remove items in a good workmanlike manner.
" Any item not picked up during the posted pickup times will be considered an abandoned item.
" We experience real costs when a customer fails to pick up their items as per the agreement
and accordingly, will pursue the terms of the agreement. Bids are not revocable and legally
binding agreements between the seller and the buyer.
" We reserve the right to remove and/or add lots and/or items to the sale at any point
during the auction.
" Please plan ahead and come prepared. Any items not removed by the times shown will be
deemed abandoned regardless of the price.
" Our best efforts are made to represent all items accurately in descriptions and pictures; However, all items are ultimately sold on an "As Is Where Is" basis with all faults. No
responsibility is assumed by the sellers for any errors or omissions. Please see all the pictures of
every lot before you bid.
" No streaming technology is perfect, so it is always a good practice to refresh your screen once
in a while during the closing minutes.
" Max bid is available to all bidders. This feature allows bidders to enter the highest bid they
are willing to go on an item and the system will bid on their behalf. For example, Lot 101
is currently at $50. You enter a bid of $200. The system will bid $55 for you. The lot will stay at
$55 until someone else bids $60. At that time, the system will bid $65 for you. This will continue until either no one else bids and you win, or your $200 is reached.
" In the event of a tie bid (2 bidders enter the same amount; it is always awarded to the first person who entered it.) So, you enter a bid of $100 and the current high bid is now $100 but it says you are outbid. That means someone else entered a $100 bid before you and the system recognizes them as the high bidder since they entered the bid first.
" We send out email notifications and invoices immediately after the auction close.
" Mail is incredibly unreliable and emails with attachments get blocked, flagged, directed to junk
folders and many other things all the time. It is your responsibility to check your account to see
if you won and attend during the pick up times as posted in the auction details. We have no
way of knowing whether you received our emails or not and they rarely come back
undeliverable. i.e. Hotmail, Live, and Sympatico are notoriously brutal for blocking emails. Stating you did not receive an email will not exempt you from late fees so
please check your account.
" Registered bidders are not able to opt out of these emails, but you will only receive emails for the auction you registered for or any related auctions. You may opt out of general emails by
" clicking on the "Unsubscribe" link found at the bottom of the email. If the link is not at the bottom, it is an email you cannot unsubscribe from. You give your consent to receive these emails by registering.
" All winning bidders will be sent an e-mail invoice following the auction's closing. If you do
not receive an invoice, please check your junk mail. Even if you do not receive an invoice, you are still responsible for payment and pick up as stated in the auction. You can verify winning bids
by logging into your account after the auction closes and checking each lot. If the lot says
"Status", you have won. If it says "Outbid" you have not won.
" Items close at regular intervals. To prevent a bidder from 'sniping', all bids made in the
last minute of the auction will force an item to stay open for an additional 2 minutes.
this will continue until all bidding has ceased.
" The purchaser will not be entitled to possession of any Lot purchased from
" The 6IX Auction until the total purchase price of the Lot, any other lots and any other
Lots from outstanding invoices (due to The 6IX Auction) have been fully paid. In the
event that you fail to pay the full purchased price for any lot(s) within the prescribed time,
or fail to comply with any of the "Terms of Sale", you may be sent to collections and/or sued in
the Small Claims Court and/or Superior Court. In addition, any paid amount for previous
invoices and Lots (by the purchaser and not in their possession) will be
treated as a deposit towards outstanding invoices without notice.
" We will not be liable for any damage or injury to individuals or their property. No warranty on any item purchased. No claims allowed for any property and personal damage, or
" accidents occurred during pick up time.
" In the event of electronic failure for any reason during the auction sale, all items sold will be due
and payable at the time of failure. We reserve the right to cancel the remainder of the auction
sale in the event the electronic failure cannot be rectified in a reasonable time. Items maybe re-
offered in a future auction sale.
" You expressly understand and agree that The 6IX Auction and it's consignors shall not be
liable for any direct, indirect, incidental, special, consequential or exemplary damages,
including but not limited to, damages for loss of profits, goodwill, use, data or other
intangible losses resulting from: (1) the use or the inability to use the service; (2) the cost
of procurement of substitute goods and services resulting from any goods, data, information
or services purchased, obtained or messages received, or transactions entered through
or from the service; (3) unauthorized access to or alteration of your transmissions or data; (4) statements or conduct of any third party on the service; or (5) any other matter relating to the service.
