TERMS AND CONDITIONS OF SALE General 1. All potential purchasers (herein referred to as the Bidder) must register prior to making any bid. 2. By registering for this online auction, the Bidder is agreeing to all terms and conditions. 3. The Bidder is financially responsible for any and all purchases made via online bidding. Bids may not be cancelled or retracted for any reason. 4. Registration must be in the name that is to appear on the invoice. Company names may be added prior to final payment; however the name of the Bidder who registers will also appear regardless of any request to not have it appear. All invoices are final and will not be changed or altered after the fact in any way. 5. All sales are final and not subject to conditions. Items purchased may not be returned. 6. All merchandise is sold in an "as is - where is" condition without recourse to the vendor. 7. There are no warranties, guarantees, or service plans whatsoever. Robertson Sales is merely performing an auction service and expressly disclaims all warranties as to merchantability, fitness; or any matter whatsoever. 8. Neither Robertson Sales nor proprietor make any representation or warranty that any of the lots conform to any standard in respect to safety, pollution or hazardous material; or to any standard or requirement of any applicable authority, law or regulation; or are fit for any particular purpose; or are of any particular age, year of manufacture, model, make or condition. 9. The Bidder shall be deemed to have inspected the lot(s) to their full satisfaction before making their bid(s). Previewing of the items is available by appointment only by calling (705) 544-8000. Dates for previewing are Wednesday, August 4, 2021 and Thursday, August 5, 2021 from 0900 to 1800 hours on each day. 10. The Catalogue description is merely a guide and may contain errors or incorrect information. No sale shall be invalidated; nor shall the auctioneer or proprietor be liable as a result of defects or inaccuracies in the Catalogue. 11. If the Catalogue description does not match the picture(s), the Catalogue description takes precedence. 12. The highest bidder shall be the purchaser; and the decision of Robertson Sales relating to all matters is final. 13. Robertson Sales may reject a bid at their discretion without reason or explanation. 14. All goods advertised or displayed are subject to withdrawal prior to sale within the discretion of Robertson Sales. 15. Merchandise subject to HST where applicable. 16. Neither Robertson Sales nor proprietor shall be responsible for any accidents or loss in connection with this auction. 17. The Bidder acknowledges that the auction site is a potentially dangerous place. Every person at the auction site for preview or pickup, shall be there at their own risk. 18. COVID protocols will be in effect during preview and pickup times on site. A proper fitting mask must cover both mouth and nose and is mandatory at all times when inside the building. Physical distancing of 2m (6') must be maintained. Hand sanitizer (your own or that which will be provided by Robertson Sales) must be used prior to viewing any items for auction. Those not willing to follow COVID protocols will be asked to leave the premises. 19. All merchandise left on the premises after being purchased is left at the Bidder's risk and the movement of any merchandise is at the Bidder's risk. 20. The Bidder shall have no claim against Robertson Sales if internet service fails to work correctly during the online auction. 21. Robertson Sales will not be responsible for any missed bids from any source. 22. Bidders using the proxy bidding feature should leave their maximum bids on items 24 hours prior to the start of the auction. 23. These Terms and Conditions shall be governed and interpreted under the laws of the Province of Ontario. Any action arising from or related to these Terms and Conditions, or any bid or purchase shall be filed in a Provincial registry in Temiskaming Shores, Ontario, and the Bidder irrevocably consents to the exclusive jurisdiction of such courts. Vehicles and Trailers 24. All motor vehicles and trailers are being sold "AS IS" and are not represented as being in road worthy condition, mechanically sound or maintained at any guaranteed level of quality. Vehicles may not be fit for use as a means of transportation and may require substantial repairs at the Bidder's expense. It may not be possible to register the vehicles to be driven in their current condition. 25. Motor Vehicle Dealers must supply a copy of their Ontario Motor Vehicle Dealer License or Salesperson License. 26. You must be a duly registered Motor Vehicle Dealer to purchase more than one (1) vehicle in this auction sale. 27. All items have Ontario ownerships and will be transferred into the Bidder's name by Robertson Sales. All paperwork associated with the transfer must be completed during the scheduled pickup time of the unit. An original signature is required on all documents. 28. All vehicles are subject to a Registration Fee consisting of the following: a. License Fee - $37.00 b. Administration Fee - $20.00 plus HST c. Ontario Motor Vehicle Industry Council Fee - $10.00 plus HST 29. If you are the final purchaser of a motor vehicle, registration for this online auction and successful purchase of the motor vehicle, is deemed as consent to the disclosure of your name, address, and the sale price of the motor vehicle to the Consignor. Payment and Item Removal 30. All successful Bidders will receive an email of their unpaid invoice. Successful bidders must then contact Robertson Sales to arrange for payment and pickup of their items. 31. The Bidder must make an appointment to pickup all items by calling (705) 544-8000. Pickup dates are Tuesday, August 10, 2021 and Wednesday, August 11, 2021 from 0900 to 1800 hours. 32. All merchandise must be paid for no later than Wednesday, August 11, 2021 at 1700 hours. 33. A 1.5% Internet Fee is applicable for all purchased items. This fee is subject to HST. 34. All merchandise shall be paid for by Interac E-Transfer (to auction@ntl.sympatico.ca), Cash or Debit. VISA or Mastercard is accepted with a 3% Buyer's Premium (which is subject to HST). 35. No items are to be removed until full payment has been received. The seller retains ownership until payment has been made. 36. Unless other arrangements have been expressly approved by Robertson Sales, purchased items must be removed by Wednesday, August 11, 2021 at 1800 hours. 37. Any purchased items not picked up by 1800 hours on Wednesday, August 11, 2021 will be considered abandoned and become the property of Robertson Sales for disposal. 38. The Bidder assumes all responsibility, cost, and risk for the removal of purchased items. Email Communications 39. As per Canada's anti-spam legislation of July 11, 2014, we need your consent to communicate with you electronically. By registering for this online auction, you are opting to receive auction notices from Robertson Sales for this online auction ONLY. You may withdraw your consent at any time by replying to our email with UNSUBSCRIBE in the subject line.
