All bidders agree to pay the buyer's premium. Bidder hereby grants Ostrosky Auction & Realty the authority to charge his or her credit card on file the full amount due for Bidder's purchases or partial amounts at any time until Bidder's invoice is paid in full. A credit card authorization will be required a time of registration. The credit care will not be automatically charged. It is a security feature to deter fraudulent bidding. You are solely responsible for the accuracy of your bidder information and you hereby warrant that your bidder information: (a) is true and accurate; (b) is not fraudulent; (c) does not infringe on any third party copyrights, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy; (d) does not violate any applicable law, statute, ordinance or regulation; (e) is not defamatory, obscene or libelous; (f) does not contain any viruses, code, files, or programs that may damage, disrupt or interfere with data or personal information. You agree to indemnify and hold Ostrosky Auction & Realty harmless from and against, loss, cost, expense or damage arising out of a breach of any of the foregoing representations and warranties. All items are sold AS IS with no warranties or guarantees given or implied and make no authenticity of any item being sold or auctioned. ALL SALES ARE FINAL. It is the sole responsibility of the bidder to use due diligence and all available resources to verify for themselves what the item is they are bidding on. We post all contact information on the auction to easily communicate with us. 2. Bids cannot be removed unless it is an obvious typographical error. Make certain what you are bidding on before you bid. 3. Ostrosky Auction & Realty is providing internet only bidding for this auction. Bidder acknowledges and understands that this service may or may not function correctly at any time, including the auction closing time. Under no circumstances shall the Bidder have any kind of claim against Ostrosky Auction and Realty or anyone else if the internet service fails to work correctly before or during the auction closing time. Ostrosky Auction and Realty will not be responsible for any missed or failed bids from any source. Internet bidders who desire to make certain a bid is acknowledged should place their maximum bids at least two hours prior to the auction closing time. Ostrosky Auction & Realty reserves the right to withdraw or re-catalog items in this auction. In the event of any software problem, mistake or other issue, Ostrosky Auction & Realty reserves the right to extend the closing times, change the extension time, stop, restart or cancel this auction at its sole discretion. Even though an item may display as "sold" on the internet, no sales are final until they are certified by Ostrosky Auction & Realty and Bidder receives an invoice. Ostrosky Auction and Realty reserves the right to cancel any or all sales and resell the items in whatever manner it chooses. 4. The bids are advanced at pre-set increments available on the bidding web page which may be changed at any time in Ostrosky Auction & Realty's sole discretion. Ostrosky Auction & Realty may accept items with secret reserve prices. The seller and Ostrosky Auction & Realty reserve the right to bid on behalf of the seller on items on which there may be a reserve price. Ostrosky Auction & Realty may reject or cancel any bid for any reason. The record of the auction made by Ostrosky Auction & Realty shall be conclusive. This is a public auction and as such, all qualified bidders may bid including Ostrosky Auction & Realty owners, family members and employees. 5. All property shall be removed from the premises by the Bidder at his/her own risk and expense within the time period announced. Bidder should arrange to pick up their purchases within this time. There will be NO SHIPPING of any items. 6. Ostrosky Auction & Realty may refuse registration and bidding privileges to anyone for failure to pay previous auction invoices, failure to provide a valid credit card or any other reason. Bidder hereby agrees that Ostrosky Auction & Realty may share information about Bidder's non-payment of auctioneer invoices or shipping charges with other parties and may pursue collection of balance due by any legal means. Bidder agrees to provide any identification Ostrosky Auction & Realty may request including but not limited to: driver's license, Social Security card or Passport. Bidder agrees to comply with any stated additional terms or conditions associated with items.
