These are our terms and conditions. If you do not agree with them, please do not bid. 1. By bidding on this auction, buyers understand that this is an online only auction and all sales are final, 2. Buyer agrees that by bidding on the items in this auction, that they've had the opportunity to inspect the items, and that they have found all items acceptable, in working order, and exactly as described in the listing. 3. Buyer further agrees that they will not cancel any checks or issue any chargebacks once they have received the items into their possession. The buyer acknowledges that he/she has been given plenty of opportunity to inspect the items prior to taking possession of them by calling 636-936-9100 and setting up either an in-person or a virtual viewing appointment for the items of interest. 4. Buyer further understands that acceptance and taking possession of the items warrants their acceptance of its condition and use. 5. Buyers understand that all items are sold as is, where is, without any warranties expressed or implied, and that they are expected to do their own due diligence to verify authenticity of brands, and condition of merchandise. 6. Buyers are allowed to pickup their items after the sale by paying with cash, debit, or credit card. Debit and credit cards will incur a 5% usage charge. We DO NOT accept personal checks or money orders. If buyer wishes to pay with an e-check, or by mailing in a cashier's check, items will be shipped to the buyer, or buyer can pickup their items only AFTER payment has cleared our bank, otherwise, the transaction will need to be paid for in cash, by debit/credit, or with a wire transfer. ***(Due to fraudulent chargebacks on high dollar items, we will only accept cash, cashier's check, or wire transfer for these items, and this includes any single item totaling $100 or more.)*** 7. You may call 636-936-9100 in order to receive wiring instructions. Acceptable forms of payment and their hold times are as follows: Cash at pickup-Buyer gets items immediately. Cashier check, items ships within 3-5 days of verification of funds by our bank. Wire Transfer-Buyer's items get sent as soon as wire payment has been received by our bank. Credit/debit card transactions-online payment-5% usage charge and items go out immediately for individual items won up to $100 or less, any individual items totaling over $100 must be paid with certified funds using either cash, cashier's check, or a wire transfer. e-Check- 16-30 day hold time for checks to process and clear before we ship merchandise. 8. By bidding on this auction, buyer agrees that they will be responsible for any shipping costs, insurance costs, sales tax if they are residents of the state of Missouri, customs if bidding from outside of the United States, as well as any duties or tax occurring as a result of being an international bidder. 9. By bidding on this auction, bidder understands that all items shipped will be shipped with tracking numbers, signature confirmation, and insurance to ensure a safe/ secure delivery of their items. Insurance amount will be equal to the winning bid amount and final sale price of the item. 10. By bidding on our auction, bidder understands that it is up to the buyer to contact Half Past Treasures: Something Old, Something New, LLC and request a shipping quote by calling 636-936-9100 before bidding. Shipping quotes given out after the auction has already ended that are "too high" will not be accepted as a means to cancel bids to auctions already won, and bidders will still be responsible for paying for their items and arranging pickup. 11. All auction items won and paid for will need to be picked up within 180 days. Pickup is by appointment only by calling 636-936-9100. On the 181st day, leftover property will be considered abandoned and will be relisted on another auction. Any money paid for that item will be forfeited as storage costs for housing the abandoned property. 12. By bidding on this auction, buyer understands that not all items can be shipped due to the high cost or fragility of an item. (For instance, a $25 couch that was won at auction may cost $700 to ship to you by freight, or a $10 mirror may cost $175 to ship.) In these instances, the items that are too large or too frail to ship will be marked under lot description as Freight/PICK UP ONLY. If the item is marked as a pick up only item under the lot description, buyer will be responsible for moving and transporting the item including providing their own boxes, straps, tools for dismantling/breaking down of the items, and extra help if the item needs more than one person to move it. Buyer is also welcome to hire their own moving company to move it. The moving company will need buyer's auction invoice number and buyer's phone number that matches the one we have on file before we will release any items to them on the buyer's behalf. We will also call the buyer to verify the pickup. 13. By bidding on this auction, buyer agrees to not hold Half Past Treasures: Something Old, Something New, LLC, their officers, organizers, members, employees, or consignors accountable for items that were lost or damaged during shipping in the event that the item is received broken or damaged, but will instead file a claim with the appropriate shipper. Half Past Treasures: Something Old, Something New, LLC will cooperate by any means necessary to assist buyer in receiving their refund from the shipping service. 14. By bidding on this auction, buyer agrees that his/her address is current, and will not hold Half Past Treasures: Something Old, Something New, LLC, its members, officers, organizers, owners, employees, or consignors liable, in the event that a package is not delivered due to a faulty address given by bidder. In that instance, bidder agrees to pay the shipping/handling, and insurance again if we have to reship due to any packages being deemed "undeliverable" in the event that an incorrect address was given or was previously left on file. 15. Bidder agrees to keep an updated address on file or to provide us with their new address upon bidding. 16. By bidding on this auction, bidder agrees to keep all packaging, bubble wrap, and shipping materials, in the event item arrives broken or damaged in order to make a shipping claim, and will release Half Past Treasures: Something Old, Something New, LLC from all liability related to shipping damage, in the event buyer did not keep those materials and shipping service refuses to honor the insurance claim. 17. By bidding on this auction, buyer agrees that there are no refunds for this auction, and that everything sold here is sold 'AS IS' without any warranties expressed or implied. 18. By bidding on this auction, buyer agrees that there will be a 15% buyer's premium plus a 5% credit/debit card convenience fee, as well as any shipping/handling charges, and any tax owed attached to the final sale amount of their auction winnings, unless they are paying with e-check, or cash, in which case the 5% credit/debit card fee will be waived. 19. All e-checks/cashier's checks/money orders/paper checks will require a minimum holding period to process and clear before auction items will be shipped. 20. By paying with e-check, buyer will forfeit the 5% credit/debit card convenience fee, but still pay shipping/handling, and taxes, and by paying with cash in person, buyer will forfeit the 5% credit/debit card convenience fee, as well as shipping/handling charges, but will still be charged tax. This also applies to physical checks, cashier's checks, or money orders that were mailed in. 21. Please ask for signature confirmation, insurance, and tracking if mailing cash, as we won't be responsible for lost or stolen envelopes in the event it didn't arrive. 22. By bidding, bidder understands that these charges are non-refundable unless they opt to pay in cash and pick up the items at our disclosed location. Location for pickup will be given at the end of the auction. 23. By bidding on this auction, buyer understands that UNDER NO CIRCUMSTANCES WILL WE ACCEPT PAPER CHECKS, MONEY ORDERS, OR CASHIER'S CHECKS FOR PAYMENT AT AN IN PERSON PICKUP. If you pay by e-check online, merchandise will not be mailed, shipped, or allowed to be picked up until the e-check has cleared the bank, the same is true for checks, money orders, and cashier checks that have been mailed to us. 24. By bidding on our auction, bidder understands that items may be viewed in person or virtually by calling 636-936-9100 and scheduling a date/time to see the items prior to the end of the auction. 25. By bidding on our auction, bidder agrees that he/she has been given the opportunity to inspect, verify, and look over the items to his/her satisfaction, and will not hold Half Past Treasures: Something Old, Something New, LLC, its employees, owners, members, affiliates, and consignors responsible for any liabilities or problems arising as a result of the bidder not taking the opportunity to do their own due diligence by inspecting the items prior to bidding. 26. By bidding on our auction, buyer understands that there will be no refunds, or chargebacks once the items have been picked up or shipped out, and that if there are any fraudulent chargebacks brought against Half Past Treasures: Something Old, Something New, LLC, after the merchandise has left our possession, that Half Past Treasures: Something Old, Something New, LLC will remediate the situation by any means necessary, including filing criminal and civil charges against the buyer in a court of law and reporting the crime to law enforcement. 27. By bidding on our auction bidder acknowledges that if Half Past Treasures: Something Old, Something New, LLC brings a civil or criminal case against a bidder for fraudulent chargebacks, bidder agrees to pay all damages as a result, including travel expenses, court costs, and attorney's fees. 28. By bidding on our auction, bidder understands that jewelry metal will be tested using a gold testing kit, and also an electronic gold tester. The stones will be tested using a Presidium gem tester. All items are described to the best of our ability. 29. By bidding on our auction, bidder acknowledges that Half Past Treasures: Something Old, Something New, LLC is not a jewelry or antique dealer/appraiser and understands that they only relay the information given to them by the original seller, thereby bidder agrees that they have had the opportunity to inspect and look over all items, either by physical appointment, or virtual appointment and will not hold Half Past Treasures: Something Old, Something New, LLC, their owners, or employees liable for any items that are counterfeit, fake, or otherwise unintentionally misrepresented. 30. Bidder understands that Half Past Treasures: Something Old, Something New, LLC will not be held accountable for inaccurate or misrepresented listings, in the event an item the bidder bid on isn't what bidder believed was described in the listing, but will instead do their own due diligence on items of interest by asking questions, requesting a virtual tour of the item they are interested in, or physically inspecting the item at our location by appointment by calling 636-936-9100. 31. Bidder further agrees that by bidding on this auction that he/she has been given the opportunity to inspect, verify, and look over the items to his/her satisfaction, and will not hold the Half Past Treasures, Something Old, Something New, LLC, its employees, owners, affiliates, members, and consignors responsible for any liabilities or problems arising as a result of the bidder not taking the opportunity to do their own due diligence by inspecting the items prior to bidding. 32. By bidding on our auction, bidder understands that technology complications beyond our control can sometimes arise and cause service interruptions and bidder agrees not to hold Half Past Treasures: Something Old, Something New, LLC, its owners, affiliates, employees, or consignors responsible for any unforeseeable event such as a service interruption caused by an act of God, weather, technical glitch, or any other event outside of our immediate control. The auctioneer reserves the right to restart the auction during such an event; thereby cancelling all previously placed bids. 33.
