By registering for the auction, you agree to not initiate any credit card chargeback(s) on winning bid(s). Sellers are prohibited from bidding directly or indirectly on any of their Lots. The bidder assumes all responsibility on bids made from their account and once submitted, bids cannot be retracted. Bidders who believe bidding may have been conducting through fraudulent means will be required to contact their local authority and provide a police report. Unless a reserve is placed on a lot(s), bids will be taken at established increments. Bids will ordinarily be initiated at an opening bid amount or at the next bid increments, which amount may be less than your maximum bid amount. Bids will automatically be competitive up to the hammer price or until the bidding has ended. If a reserve is place on the lot(s), your maximum bid will start at the highest amount within your maximum bid in order to place you either closest to the reserve or at the reserve price. Although information about each item has been deemed reliable, Design Inspirations LLC/ From One To Another (FOTA) or anyone else associated with this sale, make no representations as to its accuracy. It is for this reason that buyers should avail themselves of the opportunity to make inspections prior to sale. All items offered for sale shall be sold "as is" "where is" with all its faults. No item is to be removed until complete settlement is made (see pick up guide). The above mentioned company reserves the right to refuse issuing a bidding number or making a sale to anyone for any reason. INTERNET BIDDING - Due to varying Internet speeds, browser controls, wireless signals, and other communication problems we DO NOT GUARANTEE that your bid will be accepted on any item. Do not wait until the last possible second to place a bid. If an item is not on your invoice, then your bid was not the last and highest bid recorded and there is no recourse. If the bidder is exempt from sales tax, a copy of the exemption certificate must be submitted to fromonetoanother@hotmail.com before placing a bid on any lot. A minimum purchase is required by MD law for Sales Tax Exemption. Purchases must be paid in full by CASH, VISA, Mastercard, or Discover card. Cash Sales will receive a 3% discount off the buyer's premium. YOU MUST CONTACT US BEFORE AUCTION END IF YOU PLAN TO PAY WITH CASH. IF WE DO NOT HEAR FROM YOU, THE CARD YOU USED TO REGISTER WILL BE CHARGED FOR THE ITEMS YOU WON. REFUNDS AND ADJUSTMENTS - Absolutely no adjustments, claims or refunds will be allowed after the item(s) are removed from the auction site. ANY CLAIMS MUST BE MADE WHILE THE ITEMS ARE ON THE AUCTION PREMISES. In no event will auctioneer's or seller's liability to buyer ever exceed the purchase price paid. Closing, Payment, Chargeback: Lot closings will stagger, in lot order, every 30 seconds. Any bids entered on a lot in the last minute will reset that particular lot closure for an additional 60 seconds. All other lots will close as scheduled. A valid Visa, MasterCard or Discover credit/debit card authorization is required for bidding. At the end of the auction, your credit card will be charged for your winning bid(s) and a paid sales receipt will be e-mailed to the winning bidder. ALL SALES ARE FINAL. NO REFUNDS OR RETURNS. By placing the winning bid, the bidder agrees to accept all charges associated with the bid(s) to their credit card and will not initiate a credit card chargeback(s). CHARGEBACKS ARE PROHIBITED. If, in violation of these terms and conditions, a chargeback is successful, the bidder will remain liable for all winning bids and any additional cost and expenses incurred in any attempts to collect, including attorney fees. Auctioneer Discretions: Design Inspirations LLC/ From One To Another (FOTA) reserve the right at any time to: (a) add or remove lots from the auction, (b) split or combine lots, (c) add or remove minimum bids or reserve prices, (d) cancel, reschedule, suspend or extend the auction or a lot, (e) make changes to the auction's closing, inspection or removal times, (f) reopen the bidding, (g) remove bidders, or (h) take any action(s) it deems necessary to effect the fair conduct of the auction. GUIDE FOR ITEM PICK UP: All items in this sale must be removed no later than 72 hours after auctions date. Any items left after this date may be removed and stored by the auctioneers at the expense of the buyer, or resold at the next auction. A printed paid sales receipt and identification must be provided upon request at pickup by the winning bidder or their agent in order to release any lot(s). The bidder is solely responsible for the safe packing, pickup, removal, and transportation of all winning lots at the specific location, date(s) and time(s) posted on the online auction page. **The bidder must arrive with the necessary materials and manpower to disassemble, pack, move, load, secure and transport items purchased. Any lot(s) not removed during published pickup times will be considered abandoned to Design Inspirations LLC/From One to Another (FOTA). The bidder understands and agrees to waive all rights to such lot(s) and that a refund will NOT be issued for the winning bid in connection with the abandoned property. Indemnification: The bidder, their employees, agents, representatives, or independent contractors agree to indemnify and hold harmless the Seller and Design Inspirations LLC/From One to Another (FOTA) and its owner(s), laborers, members or representatives with respect to any claims of damages, loss, liability, personal injury, property damage, judgment, fees and expenses incurred in connection with the conduct of the auction, postponement or cancellation of the auction, item(s) purchased, or during pickup, removal and transportation of the item(s). Design Inspirations LLC/From One to Another (FOTA) is not liable for any action taken by the seller, bidder, or other third party before, during or after this auction. HOLD HARMLESS AGREEMENT - The buyers hereby indemnify and hold harmless the auctioneer and seller from any and all damages, claims or liabilities from any injuries to persons or property of any type whatsoever caused during the sale or during the removal of the items purchased. Buyers remove purchases at their own risk. Buyer's should arrange for professional de-installation of wired, plumbed or built-in items. Many pieces of equipment have potential hazards and should be de-installed and moved by professionals with proper equipment. RECOVERY OF LITIGATION COSTS: If any legal action or other proceeding is brought pursuant to or in connection with these terms or any transaction involving you and Design Inspirations LLC/From One to Another, then, if Design Inspirations LLC/From One to Another is the prevailing party, it is entitled to recover from you its reasonable attorneys' fees and other costs incurred in that action or proceeding, in addition to any other relief to which it or they may be entitled. Design Inspirations LLC/From One to Another have the right to refuse or withdraw a bidders number to or from anyone attending this sale for any reason deemed necessary. Agents: Must register ahead of time (via email) with written approval assigning them as agents to buy on their behalf up to a dollar amount and be signed by an authorized signature. The citizen, organization or company must send a letter of guarantee of funds and follow all other sale conditions and Export Law Assurances as stated in any conditions governing this sale. They must include an address (letterhead) phone number for daytime and after hours that this person or other acting officials may be reached. There must be proof that they are a US company, organization or citizen. WARRANTY DISCLAIMER: ALL SALES ARE FINAL ALL ITEMS ARE BEING SOLD "AS IS" "WHERE IS" WILL ALL ITS FAULTS AND WITHOUT ANY WARRANTIES AS TO MERCHANTABILITY OF FITNESS FOR A PARTICULAR PUPOSE. THE PRINCIPAL, THE AUCTIONEER, THE ADVERTISING COORDINATOR AND ANY OF THEIR AGENTS MAKE NO EXPRESS OR IMPLIED WARRANTIES OF ANY TYPE. IT IS FOR THIS REASON THAT WE RECOMMEND THAT ALL ITEMS BE THOROUGHLY INSPECTED PRIOR TO THE POINT OF SALE.
