All Items are Sold As Is, Where Is, and in the condition at the time item is sold with any and all faults. By placing a bid you agree to pay in full within 2 days. Must be a Texas resident to purchase firearms. Must be legally eligible to purchase firearms. Must present a valid TX ID or TDL at checkout and pickup. Winning bidder must pick up firearm purchases in person. PAYMENT: Cash Pre-approved Check, Visa, MC, and American Express accepted. On Saturday follwoing the auction, we will send an invoice to all winning bidders. Full payment must be made in person between the hours of 10 a.m. and 2 p.m. on Saturday or Sunday following the auction. Payment and pickup at auction site. Pre-approved checks may be held until they clear prior to merchandise pick up. If payment has not been received by the 2nd day, I agree & give permission for Balboa Auction Company, LLC to charge my credit card I used to register for the full amount. As stated above, auctioneer reserves the right to cancel bids for items not picked up during scheduled checkout days and times. If I pay by credit card, I understand & agree that all sales are final & credit cards charges cannot be reversed for any reason. There will be a 15% Buyers Premium added to each item purchased. All applicable sales tax will be charged. There will be no sales tax charged to out of state bidders. Sales tax will be charged for Texas buyers unless the buyer has a dealer's resale certificate that is directly related to the industry that is being sold. Prospective buyer should present their resale information at the time of registration. SHIPPING: No shipping is available at this time. Local pickup at location and scheduled times listed in auction description. Balboa Auction Company, LLC is not responsible for the performance of online bidding platform. If a bid is not received by the auction house, the bid cannot be executed. Balboa Auction Company, LLC is not responsible if a bid is not executed due to technical or human error. The winning bidder is the bidder designated by the auctioneer. Auctioneer's word is final in all disputes of this matter. BUYER'S RESPONSIBILITIES: Your bid is your contract. Buyer agrees to all terms and conditions by registering to bid. Buyer assumes full responsibility for all items purchased when the auctioneer declares it sold. Buyer picks items up at auction site. If item has not been picked up, within 2 days of purchase, then item will be considered abandoned. Abandoned items will be sold at owner's expense including commission & storage fees Unless prior storage arrangements have been made with Balboa Auction Company, LLC in writing. If Buyer pays by credit card, buyer agrees to not reverse charges FOR ANY REASON. In the case a refund is due, Balboa Auction Company, LLC will issue the refund directly to you. Balboa Auction Company, LLC reserves the right to accept or refuse any bid or service to anyone, for any reason. Tax exempt bidders must email a current Texas Sales and Use Tax Resale Certificate Permit Number to ruben@balboaauctioncompany.com. Please include your name and company name in the email. If we do not have an accurate Tax Exempt Number on file, taxes will appear on your invoice. The buyer hereby assumes and does agree to indemnify and hold harmless the auctioneer and sellers from any current or future claim which shall pertain to the fitness, use, damage, safety, injuries to persons or property that may have occurred during the auction or that may have been caused by or during removal or use of items purchased, or any other claim regarding the use of that asset as purchased. All Applicable Federal Firearms Regulations Apply To Any Firearms Sold. All Firearms must be shipped to an FFL licensed dealer/receiver of your choice, in your area. Buyer is responsible for all shipping & transfer fees. Do not bid on firearms prohibited in your area. We will NOT ship any firearms, modern or antique outside of the United States.
