______________________________TERMS & CONDITIONS_____________________________ In the following, AuctionHouse Algarve (AHAlgarve), provides the services of auctioneers subject to these Terms and Conditions. Introduction to Auction. The Auctioneer acts only as agent for the Seller (unless otherwise specifically declared). Accordingly Sellers need not be paid until payment is received from the buyer. Lots sold are likely to have been subject to wear and tear caused by use or the effects of age and may, therefore, have faults and imperfections. Buyers are given ample opportunity at viewing times to examine lots to be sold and will be assumed to have done so. They must rely on their own skill and judgement as to whether lots are fit for any particular purpose, and as to compliance with the description or illustration. BUYERS These conditions, together with any additional conditions appearing in the catalogue, are the terms and conditions subject to which AHAlgarve as agents for the vendor shall sell goods to the purchaser, (The Bidder), and all other conditions, whether express, or implied at common law, or by statute, as are capable of lawful exclusion are hereby excluded. By participating in this sale all vendors and purchasers agree to be bound by these conditions and are deemed to have read and have full knowledge of them. The highest bidder shall be the buyer at the hammer price except in the case of a dispute. If during the auction the auctioneer considers that a dispute has arisen, he has absolute discretion to settle it or to re-offer the lot. The Auctioneers have the right to divide any lot, to combine any two or more lots together or to withdraw any lot or lots from sale, regulate the bidding, refuse bids or cancel the sale without giving any notice or reason whatsoever. The Auctioneers have the right at their discretion to refuse entry to their premises or attendance at their auctions of any person. Whilst The Auctioneers make every effort to ensure the accuracy of their catalogue and description of any lot they do not accept responsibility regarding authenticity, attribution, genuineness, origin, authorship, date, age, period, condition or quality of any lot. All goods are sold with faults and imperfections and errors of description. If they have been instructed in writing by the vendor to certify a lot, The Auctioneers do so as agents of the vendor and are not themselves responsible for such claims. All statements whether printed in the catalogue or made orally are statements of opinion and are not to be taken as being or implying any warranties or representations of fact. All Bidders should rely on their own judgement as to matters affecting any lot. The Auctioneer shall only accept bids from the purchasers who have, to the auctioneers’ satisfaction, registered and obtained a bidding number. Persons attending the auction site and premises do so at their own risk. The Auctioneers shall not be responsible for any loss or damage that may occur on the auction site or premises. COMMISSION shall be charged AT A RATE OF 20% on the hammer price. The commission value will also be SUBJECT TO an IVA charge, calculated at the prevailing rate. Immediately prior to the auction the Bidder shall: give to the Auctioneers his name and address, and, if requested, proof of identity. At the end of each auction the Bidder shall pay to the Auctioneers, as a minimum, the total amount of commission and taxes due to their purchases in respect of such lots, unless specific arrangements have been made, either by cash or cheque or by multibanco payment. The due balance must be paid in full within 3 days of the auction and the items must be removed from the Auction House immediately. Failure to do so may result in the forfeit of the lot(s) and any deposits paid. In all cases lots shall remain at the risk of the Vendor save that lots shall be at the sole risk of the Bidder from the fall of the hammer, and such lots shall be taken with all faults, defects and errors of description, of any nature whatsoever. Neither the Auctioneers, nor their servants or agents shall at any time be responsible for any loss or damage to lots whether caused by negligence or otherwise. No purchaser shall be entitled to remove any lot until he or she has paid for the whole of the lots purchased. All lots shall be removed within 3 days of the sale, or, on any of the advertised open hours (see Home Page for current hours of opening) If the Bidder fails to comply with these conditions, any deposit paid by the Bidder shall be forfeited to the Vendor of the lot and the lot shall be resold by public auction or private sale and the deficiency (if any) arising upon the resale together with the expenses of it shall be due as a debt from the Bidder in default upon the first sale. Ownership in each lot shall not pass to the Bidder until full payment has been made (in cleared funds) of all sums due to the Vendor and the Auctioneers pursuant to these Conditions. Pre bids will only be accepted by The Auctioneers on completion of a pre bid form by The Bidder, clearly stating the maximum bid. Bidders are requested to contact us by telephone or in person as soon as possible after the auction to obtain details of the outcome of their bids. You, the Bidder, understand that The Auctioneers provide the service of pre bids for its customers and that The Auctioneers are not responsible for failing to execute bids or for errors relating to the execution of bids. The Auctioneers will endeavour to purchase these lots for the lowest possible price, taking into account any reserve or other bids. If identical pre bids are taken for the same lot, the written bid first received by The Auctioneers will take precedence. Bids made in-house always take precedence over out-of-room bids or pre-bids or commission bids. VENDORS The Vendor warrants to the Auctioneer and to the Bidder that he/she is the true owner of the lot or is properly authorised to sell the lot by the true owner and is able to transfer the goods and marketable title to the lot free from any third party claims, liens or encumbrances. The Vendor warrants to the Auctioneers and the Bidder that the goods as described and in particular as to the provenance and condition. The Vendor further warrants that any damage or non working parts have been fully declared to the Auctioneers and that the Vendor has provided the Auctioneers with all the information the Vendor has concerning the provenance of the property. The Auctioneers act throughout as agents only and are not responsible for any default by either the Vendor or the Bidder. The Auctioneers shall not be liable for paying the Vendor until they have received settlement in full (in cleared funds) of all sums due from the Bidder. The Vendor must acknowledge and accept that goods are left entirely at their own risk. The Auctioneers do not accept any responsibility for loss or damage whilst in their possession. No goods will be insured whilst held by The Auctioneers for sale. The vendor shall be entitled to place prior to the sale a reserve on any lot, being the minimum hammer price at which the said lot may be treated as sold. Where a reserve has been placed the auctioneer may bid on behalf of the vendor. Commission shall be charged at a rate agreed between the vendor and AHAlgarve. The Vendor hereby authorizes the Auctioneers to deduct all commission payable from the hammer price and acknowledges the Auctioneers right to retain the premium payable by the Bidder.The Auctioneers shall remit the proceeds of the sale to the Vendor (subject to the deduction of all sums due from the Vendor to the Auctioneers) The Auctioneers do not undertake the collection of goods but shall however if desired instruct a contractor on the Vendors behalf and at his expense. The Auctioneers shall not be liable for any damage, loss, or unauthorised removal of goods and for any damage to premises by such contractors. All goods which remain unclaimed will be disposed of at the Auctioneers discretion. The Vendor will be liable for any costs incurred in disposal of unclaimed goods. _____________________________TERMOS E CONDIÇÕES_____________________________ A leiloeira AuctionHouse Algarve exerce a sua actividade de leilão, regendo-se pelos Termos e Condições que se seguem. Introdução O Leiloeiro actua exclusivamente como agente do Vendedor (salvo excepções devidamente declaradas). O Vendedor só receberá o pagamento a que tem direito, depois do comprador ter saldado o devido pagamento. Os lotes para venda em leilão são de 2.ª mão, apresentando sinais de uso e do tempo. Portanto, ligeiros rasgos, faltas ou imperfeições poderão ser encontrados. É do total interesse do comprador conhecer os artigos contemplados no catálogo. Para tal, esperamos e partimos sempre do princípio que todo o potencial comprador usufruiu dos dias de exposição. É nestas alturas que a apreciação dos lotes deve ser feita, para só então se poder avaliar se se adequam ou não à expectável finalidade. É ainda conveniente certificar-se de que os artigos correspondem às respectivas descrição e imagem. O consulta do catálogo não dispensa a apreciação física dos lotes e averiguação da descrição. COMPRADOR Estas condições, bem como quaisquer condições adicionais relativas ao catálogo, são no seu conjunto os Termos e as Condições do leilão, com base nos quais o AHA, enquanto agente do vendedor, processa a venda de bens ao comprador (apostador). Quaisquer outras condições, quer expressas, ou implícitas na legislação, estão excluídas. Ao participar nesta venda, tanto o vendedor como o comprador aceitam agir em conformidade com estes Termos e Condições, declaram tê-los lido e entendido na totalidade. O preço de martelo deverá corresponder à aposta mais alta, logo à aposta vencedora, salvo situações de disputa. Sempre que se assiste a uma competição durante o leilão, o leiloeiro tem total discrição para concluir ou reiniciar a licitação do lote. O leiloeiro tem não só o direito de separar lotes, como o de juntar dois ou mais lotes, ou retirar qualquer lote ou lotes do leilão. O leiloeiro pode ainda regular as apostas, recusar apostas ou até cancelar a venda, sem qualquer aviso ou justificação. A leiloeira reserva-se do poder discricionário de recusar a presença, a inscrição ou admissão de quem tenha faltado com as normas do estabelecimento. Apesar do esforço feito no sentido de garantir a precisão do catálogo e a descrição de cada lote, todavia o Leiloeiro não assume responsabilidade no que respeita a autenticidade, a atribuição, a singularidade, a origem, a autoria, a data, a idade, o período, o estado ou a qualidade de qualquer lote. Os artigos são vendidos com falhas, imperfeições, ou mesmo erros de descrição. Enquanto representante do vendedor, o Leiloeiro segue as indicações que aquele lhe sugerir para a descrição dos lotes, demitindo-se da responsabilidade do que escreve. Todas as informações, impressas no catálogo ou proferidas oralmente são apenas sugestões e, como tal, não devem ser tidas como garantia. O comprador deverá analisar os lotes pessoalmente. A leiloeira só aceita licitações por parte de compradores devidamente inscritos no leilão, e com um número de licitação próprio. O comprador inscrito no leilão actua em seu nome e de forma livre, pelo que a leiloeira AHA se demite de responsabilidades relacionadas com qualquer perda ou estrago provocados e/ou ocorridos no local. Sobre o valor de martelo, acresce uma COMISSÃO DE COMPRADOR no valor de 20%, sujeita a IVA à taxa legal em vigor. No registo de inscrição, são de preenchimento obrigatório por parte do comprador: - o nome e a morada completos, e, se solicitado, prova de identidade Terminada a licitação, é obrigação do comprador pagar à leiloeira no próprio dia de leilão o valor correspondente à sua comissão + IVA. O pagamento pode ser efectuado em numerário, cheque ou multibanco. O restante montante e o levantamento dos bens adquiridos têm de ser regularizados no prazo máximo de 3 dias úteis após o leilão. O incumprimento destas normas resulta na anulação da(s) compra(s) e na perda da garantia anteriormente paga. Em qualquer situação, os lotes arrematados são sempre da inteira responsabilidade do Vendedor, que os deixa no leilão por sua conta e risco, até ao momento em que, vendidos sob o preço de martelo, se constituem então responsabilidade única do Apostador vencedor. Nessa altura, os lotes deverão ser levados com quaisquer falhas, defeitos ou erros, sejam eles de descrição, sejam de que natureza forem. Tanto o Leiloeiro, quanto a sua equipa e agentes não deverão, em momento e contexto algum, ser responsabilizados por qualquer perda ou danificação de lotes, mesmo verificando-se negligência, ou qualquer outro factor. Nenhum comprador tem autorização para retirar os lotes, até que a liquidação total do seu valor seja regularizado Todos os lotes devem ser levantados nos três dias úteis seguintes ao leilão, durante o horário de funcionamento da leiloeira (Veja a Página Principal para aceder ao horário Em caso de incumprimento dos presentes Termos e Condições, por parte do Apostador, a caução, por este deixada, será atribuída ao Vendedor lesado. O Comprador repõe com o valor da caução todas as despesas do Leiloeiro. Consequentemente, o lote deverá ser sujeito a novo leilão público, ou a venda privada. O prejuízo (se o houver) decorrente da revenda e dos custos envolvidos dever-se-ão ao Apostador faltoso, aquando do primeiro leilão. O Considera-se que a titularidade do bem passa a ser do Comprador, apenas depois de paga a quantia total da venda à leiloeira AHAlgarve, conforme ditam as nossas condições. Ordens de Compra/Apostas por escrito só serão aceites pela leiloeira, mediante o preenchimento completo do formulário de Ordem de Compra, indicando o comprador por escrito o valor máximo a que está disposto a dar por determinado lote. É do interesse e obrigação do comprador contactar a leiloeira por telefone, pessoalmente, ou via email imediatamente a seguir ao leilão, a fim de apurar o sucesso das suas apostas. O AHAlgarve efectuará esforços para a sua correcta e efectiva execução, ao melhor preço possível. Porém, trata-se de um serviço gratuito, prestado aos seus clientes a título de cortesia , não podendo a AHAlgarve ser responsabilizada por eventuais erros no seu cumprimento. Sempre que se verifiquem várias ofertas de valor igual num mesmo lote, recebe sempre preferência a primeira ordem de compra recebida. VENDEDOR O Vendedor garante à Leiloeira e ao Comprador ser o legítimo proprietário do lote; ou ser o representante legal do proprietário, com poderes plenos para vender, estando livre, portanto, de futuras reclamações por parte de terceiros, e isento de penhoras ou dívidas O Vendedor assegura à leiloeira e ao comprador os bens tal como são descritos e, em particular, confirma a proveniência e o estado dos mesmos. O Vendedor garante ainda que toda e qualquer danificação ou avaria foram declaradas à leiloeira. O interessado compromete-se a facultar ao Leiloeiro toda a informação que detiver, relativamente à origem dos seus bens. O Leiloeiro age exclusivamente como agente, demitindo-se das responsabilidades que decorrem de qualquer incumprimento praticado, tanto pelo Vendedor, como pelo Comprador. O Leiloeiro apenas e só efectuará o pagamento ao Vendedor, após a liquidação total (depósito de valores reais) de todos os valores em dívida pelo Comprador. O Vendedor deve compreender e aceitar que os bens depositados são da sua inteira responsabilidade. A leiloeira não se responsabiliza, portanto, por quaisquer estragos ou perdas de artigos, nem assegura os mesmos durante a sua permanência nas instalações. Previamente ao leilão, há sempre a possibilidade do Vendedor acordar uma reserva em determinado lote, passando então esta a constituir-se como o valor mínimo, a partir do qual a venda é, pelo vendedor, autorizada. Ao haver uma reserva estipulada pelo/com o Vendedor, o Leiloeiro pode licitar em nome daquele, até ao valor mínimo acordado. A Comissão será cobrada à taxa acordada entre o Vendedor e o AHA. O Vendedor autoriza a Leiloeira a deduzir a respectiva comissão do preço de martelo e reconhece-lhe o direito de receber o valor pago pelo comprador. A leiloeira pagará ao Vendedor os lucros da venda (sujeitos primeiro à dedução de todos os valores devidos). A Leiloeira não executa recolha directa de bens. Contudo, se necessário, poderá, em nome do Vendedor, indicar profissionais para a consecução da tarefa. Os custos deste trabalho ficam sempre a cargo do vendedor interessado. A leiloeira não será responsabilizada por qualquer estrago, perda, ou remoção não autorizada de bens, e ainda por qualquer danificação de bens cometida por tais profissionais. Todos os bens não reclamados serão entretanto removidos pela leiloeira, à sua discrição. O Vendedor será responsável por todos os custos incorridos na remoção dos bens, que não reclamou dentro dos prazos.
