There are no warranties or representations of merchantability, of fitness, nor of any other kind, express or implied. Written and oral descriptions are our opinions and should in no way be construed as a guarantee of any kind as to authenticity, age, condition, materials or any other feature of items being sold. JDW Uncommons LLC attempts to catalog every lot correctly and will attempt to point out any defects but will not be responsible or liable for the correctness of the catalog or other descriptions of the lot. By placing a bid, you understand and agree that you are buying as-is, where-is with no guarantee or warranty of any kind. No refunds, adjustments or credits will be given. 2. The successful bidder is the highest bidder acknowledged by the auction. In the event of any dispute between bidders, or in the event of doubt on JDW Uncommons LLC part as to the validity of any bid, the auction house will have the final discretion either to determine the successful bidder or to re-offer and resell the article in dispute. If any dispute arises after the sale, JDW Uncommons LLC's auction sale record is conclusive. 3. The purchaser assumes full responsibility for items at the fall of the internet hammer. 4. There will be a buyer's premium for all bidders added to the hammer price of each lot and it will be considered part of the total purchase price. 5. All purchases will be subject to an 8.25% Texas sales tax unless the purchaser possesses a valid and current State of Texas Sales Tax Excemption Certificate. JDW Uncommons LLC must have a valid exemption certificate with resale certificate number and signature on any tax exempt sales. 6. PAYMENT - Purchasers card on file will be charged within 24 hours following auction close and a paid in full email will be sent to the winning bidder. CASH buyers are responsible for notifying JDW Uncommons, LLC prior to auction close or buyers card on file will be charged following auction close. This email will contain the information for the two day pick-up schedule. BUYER IS RESPONSIBLE FOR CONTACTING JDW UNCOMMONS, LLC AT 214-497-1580 TO SCHEDULE A PICKUP DAY AND TIME. All items must be picked up in this time frame. It is not the responsibility of JDW Uncommons LLC to contact the winning bidder from this point forward. If the winning bidder does not pick-up items at the designated day and time, items will be forfeited and will be considered property of JDW Uncommons LLC and may be resold in auction. If the buyer bids on items and does not pay for the winning lots, this buyer may be banned from bidding again on future auctions. It is the high bidder's total responsibility to communicate with JDW Uncommons LLC. By bidding, you accept all Terms and Conditions of JDW Uncommons, LLC as a legal and binding contract. 7. SHIPPING - NO SHIPPING IS PROVIDED BY JDW Uncommons LLC - PICKUP BY APPOINTMENT ONLY. 8. If we are prevented by fire, theft, or any other reason whatsoever from delivering any property to the purchaser, our liability shall be limited to the sum actually paid, by the purchaser for such property. 9. JDW Uncommons LLC reserves the right to withdraw any lot at any time before the auction without liability. 10. The auctioneer reserves the right to reject any bid not commensurate with the value of the property offered. 11. A range of estimates may be given on a lot with either a low and/or high estimate. Estimates should not be relied on as a prediction of the actual selling price, estimates are simply an opinion. 12. If any applicable conditions herein are not complied with by the purchaser, JDW Uncommons LLC at its discretion may either (a) cancel the sale, retaining as liquidated damages all payments made by the purchaser or (b) resell the property at public auction without reserve or minimum selling price, and the purchaser will be liable for any deficiency and costs, including handling charges, expenses of both sales, the commission on both sales at regular rates, all other charges due hereunder and incidental damages. 13. Owners, employees and consigners of JDW Uncommons LLC reserve the right to bid on any items in auction. JDW Uncommons LLC shall not be liable by reason of any defect in or condition of the premises on which the sale is held including but not limited to personal or property injury, fire or theft, or any act of nature. 14. Buyer shall indemnify JDW Uncommons LLC and its affiliates against any claims, damages, or liability (including reasonable attorney's fees) as a result of any injury or other harm suffered by any person and/or motor vehicle stemming from the sale, whether arising before, during, or after the sale. Buyer agrees to indemnify JDW Uncommons LLC for any damages or losses. Buyer will not hold JDW Uncommons LLC, its owners, employees or consigners, liable for accidents, injury, theft, or incidents related to this purchase. * All items sold "AS IS, WHERE IS" with all faults. * All descriptions believed accurate but not waranteed. * Bidder questions are encouraged before bidding. * By placing a bid, bidder signifies that the bid is a legal, binding contract between JDW Uncommons LLC and the buyer and will remit all monies due, including buyers premium and local tax, if appropriate. * JDW Uncommons LLC reserves the right to reject any bid at their sole discretion. * Applicable taxes will be charged unless a valid, current Texas Sales Tax Exemption Certificate of provided to JDW Uncommons LLC. * Buyer's premium rate will be charged to each winning lot. * For internet-only auctions, reserve the right to cancel and/or reopen the auction in the case of system failure.
