Albquerque Area Consignment Auction featuring heavy equipment, cars, trucks, trailers, ATV's, agricultural equipment, attachments, building materials, collectibles, and much more! Now accepting consignments! This is a live web cast auction. That mean it is controlled by an auctioneers and all lots are sold on April 10th at our 7700 Reading Ave SE Albuquerque yard. The auction will start at 8:30 and run until the last lot is sold. On Friday April 9th the auction order is published but for the most part our auction order is vehicles, trucks, trailers, utv, construction equipment, agricultural tractors, aerial equipment, support equipment, attachments, livestock and farm equipment, automotive accessories, miscellaneous. Everything will be sold as is where is with no warranty or guarantee, expressed or implied, statutory or otherwise of any nature whatsoever. Each and every lot will be sold as is, where is, specifically, but not restrict to generality of the foregoing, the Auctioneers make no representation or warranty that any of the lots sold conform to any safety or pollution standard, law or regulation, are fit for any particular purpose, are merchantable, able to be financed, or are of any particular age, year of manufacture, model, make or condition. Bidder agrees that he has satisfied himself as to all matters relating to the items sold and is not relying on the Auctioneers, nor are Auctioneers liable, for any matter in respect of the Above. All sales are final and no sale shall be invalidated for any reason whatsoever. It is your sole responsibility to inspect each piece of equipment you wish to bid on. You must determine the condition of the machine and bid according to your own judgment. This catalog is a guide only. All descriptions in this catalog are believed to be correct, However neither the owner nor the Auctioneers are responsible for any errors in description or conditions. All lots are available to the public for inspection prior to the sale. All purchases are based on your inspection and your inspection only. Lots without photographs will not be available for online bidding. Any announcements made sale day by the Auctioneers regarding the sale of this equipment shall take precedence over any printed matter. Settlement must be made for all items on the Auction Date. We accept cash, major credit cards, and checks (if over 10,000 must be accompanied with a Bank Letter of Guarantee) with proper id. All Purchases $5,000 and greater are subject to a per lot administrative fee of 10% on the 1st 5,000 & 2.5% on the remaining balance and all purchases 4999.00 and less are subject to a per lot administrative fee of 10% per lot. There is an 3% administrative fee that will be discounted/waived for all non electronic forms of payment ie Cash, Check or Wire Transfer. All sales are subject to State Sales Tax Laws. No items are to be removed until complete settlement for all items purchased has been made. Buyer will take immediate possession upon proper settlement. The Buyer is responsible for insuring items purchased from the moment their bid is accepted. Buyers are responsible for breaking down equipment for transport. In the event a Bidder fails to pay for an item, the Auctioneer may at his discretion, treat the purchased articles as property of the Bidder and will hold possession and could resell such items without notice to and at the Bidders expense and recover from the Buyer any loss or cost incurred from the resale. If for any reason the Buyer fails to remove any lot within the time specified, the lots shall be deemed abandoned, and the Auctioneers, at their sole discretion may resell, remove and Store the Said lot at the Buyer's sole risk and expense, in addition, buyer shall be liable for any rent incurred or damages suffered by the Auctioneers because of the buyer's failure to remove any lot. Any dispute arising as to any bidding shall be settled by the Auctioneer at their sole discretion and the Auctioneers may, immediately, put the lot in dispute up again for sale. The Auctioneers reserve the right to refuse any bid, which is considered to be an insignificant advance over the preceding bid. Bidder/buyer is deemed to have accepted a lot when he makes a bid. No titles will be given out on sale day. Titles will be mailed out by certified mail the later of, (1) ten banking days after the auction or (2) ten banking days after payment of your item is received. If, for any reason whatsoever, the Auctioneers are unable to make available or otherwise effect delivery an any lot or clear title to same, or any necessary documentation required in respect of any lot, whether before or after delivery o such lot, the Auctioneers sole liability, if any, shall be the return of any monies paid on such lot upon return of the particular lot. Any lot the subject of this paragraph shall be returned or surrendered to the Auctioneers forthwith upon demand to be the sole option of the Auctioneers. Auctioneers may, at any time, at their sole discretion and without notice or liability to Bidder withdraw or cancel the sale of any lot or offer any lots in groups or with privilege. the Auctioneers reserve the right to refuse any applicant a bidding card, the privilege of bidding at this auction sale, and to revoke such privilege at any time. Bidder acknowledges that an Auction Site is potentially dangerous place. Flammable, noxious, corrosive and pressurized substances are present, heavy equipment is being operated and electric circuits may be live. Every person at the Auction Site before, during and after the auction sale shall be deemed to be there at his own risk with notice of the condition of the premises or the activities on the premises. No person shall have any claim against the Auctioneers, their agents, employees, or principals for any injuries sustained nor damages to loss property, which may occur from any cause whatsoever. Payment Terms
Internet Bidders: Complete Payment is required within 3 business days of the sale, in guaranteed funds: wire transfer, traveler's checks, money orders and/or bank certified checks. Credit card payment will be accepted by Visa, Master Card, American Express & Discover. ADMINISTRATIVE FEE TERMS: All Purchases are subject to an administrative fee of 10% on the 1st 5,000 & 2.5% on the remaining balance. (The Administrative Fee is Taxable in NM). Sales tax will be collected on non-titled items per state regulations, tax rate is determined by the physical location of the item(s). TERMS / CREDIT CARDS: There will be a 3% buyer's fee charged on all items sold. This fee may be waived for payment form of Cash and Check. Credit card payment will be accepted by Visa, Master Card, American Express & Discover. PAYMENT TERMS: Successful onsite bidders will be notified of winning bid on sale day, Invoices will be emailed no later than the end on the 1st business day after the sale. Full payment must be made by the close of business on the 3rd business day after the sale, unless agreed to in writing by J&J Auctioneers. Should Bidder fail to pay for any and all item(s) in full on the sale date, Bidder shall remain fully responsible for the purchase price and buyers fee. In addition to all other rights contained herein, if a default occurs and the full payment is not made by the 3rd business day following the sale, and as long as the default continues to occur, all outstanding financial obligations shall bear interest at the Interest Rate of 2% per month. The default interest rate shall apply from the date of the default through the time any judgment thereon is paid in full. If for any reason a court or arbitrator(s) deems this default interest rate excessive or impermissible, the arbitrator(s) or judge shall impose the maximum default interest rate permitted and all other terms contained herein shall remain valid and enforceable. J&J Auctioneers shall be permitted to resell the item(s) and the Bidder shall be fully responsible for the difference of the purchase price along with the buyer’s fee and any additional cost regarding the resale of the item(s). Bidder understands that Bidder shall be responsible for all reasonable attorneys’ fees, court cost, default interest and other cost incurred by J&J Auctioneers associated with the enforcement of this provision.
April 11th to April16th 8:30 to 5:00pm. Last truck in the yard at 4:30pm Removal after April 10th will be by appointment only. Items are to be picked up at the auction site. All items must be picked up by 12:00 pm on the 1st Thursday after the auction unless prior arrangements have been approved by the main office. See Auction information for exact dates. To schedule pick-up call 575-485-2508. A Forklift will be availble for load out through April 16 th. If you can not pickup during this time please call the office at 575-485-2508. J&J Auctioneers will work with you. A “paid in full” receipt must be presented for removal. Any items left on site by the 3rd Wednesday following the sale will be charged a storage fee! STORAGE FEE / GATE FEE: Storage Fee: $25.00 per item / per day. Fee starts accruing on 5th day after sale date, additional After Hours Fees may apply. All removals are by appointment. Please call and verify hours as each location has different hours of operation. Pickups need to be scheduled a minimum of 24 hrs. prior to arrival. Storage Fees must be paid prior to removal. NO EXCEPTIONS.
