Auction Terms & Conditions NOTICE OF CHANGE IN TERMS
***-Effective March 1st, 2021. Due to the large amount of auctions we are processing and the limited storage space we have available, there will now be a $5 storage fee per day if the buyer does not pick up their items or schedule shipping by the last scheduled pick up date available, Items not picked up within two weeks of the last scheduled pick up date will be discarded. Items that are purchased from an off-site estate location that are required to be moved to our auction facility located in Giddings, Tx will be charged 20% of the invoice price with a $50 minimum in addition to the daily storage fees, Although we understand hardships and situations arise, we simply do not have the man power or storage capacity to accomodate.
***-Effective February 10th, 2021. If a buyers Credit Card declines when billed for the their purchases, there will be a $10.00 charge to rerun the card. We do not accept cash or checks at pickup, No exceptions. If we fail to secure payment for a buyers auction purchases within 24 hours of auction close, we reserve the right to offer those items to the backup bidders. If a buyer fails to pickup their purchases by the last pickup date, they will be charged $5.00/day for storage until the items are remove or surrendered. If a buyer consistantly misses their pickup appointment, the buyer may be charged a $10 rescheduled fee.

DUE TO NEW REGULATIONS ALL PURCHASES WILL BE COLLECTED BY BILLING THE CREDIT CARD ON FILE WITHIN 24 HOURS OF AUCTION CLOSE. IF YOUR CARD DECLINES WHEN CHARGES TO THE CARD ARE PROCESSED A $10 TRANSACTION FEE WILL BE ADDED TO THE FINAL INVOICE AMOUNT IF NOT COLLECTED WITHIN 24 HOURS.

PLEASE NOTE: We no longer offer late pickup for any auctions. By agreeing to these terms you accept and take responsibility that all items purchased through couchbidder.com become the sole property of the buyer upon close of the auction & successful payment. Couchbidder.com assumes no responsibility of delivering your items to any location if you fail to pick your items up on the scheduled pick up dates. No refunds will be issued by Jody Kalmbach Auctioneers if you fail to pick up your items within two weeks after the final scheduled pick up date. Items will not be held for more than 14 days unless you have made a prior arrangment. Please make yourself familier with our shipping policy . You will need to bring packing material, Boxes, and MAN POWER to load your purchases. We do not load or offer assistance in loading your purchases.

Upon sucessful registration and clicking the "Agree to Terms" box below, the buyer agrees and grants permission to Jody Kalmbach Auctioneers to bill the buyers credit card used for this registration for all items the buyer purchases in this auction. The buyer also understands by agreeing to these terms that they will be billed for these purchases regardless if the buyer fails to take ownership of the items at one of the scheduled pickup days. Buyers that fail to take ownership of their items, and refuse to pay for these items, will be blocked from all future online auctions conducted by Couchbidder.com, and legal action will be brought against these buyers to secure payment on the items purchased, at the buyers expense. We will follow these terms.

A 15% BP will be added to the final invoice for all bidders for this auction.
-AS IS WHERE IS-
It is the buyers responsibility to inspect items for defects on preview days. All items are sold as is-where is, no warranty or guarantee of any kind. All sales are FINAL! All descriptions are believed to be accurate, however, all bidding and buying is based soley on bidder's personal inspection and/or opinion of the items.
It is the BUYERS responsibility to;
-perform all inspections of the items and to be satisified as to its description, condition and/or authenticity prior to bidding.
- independently verify any information they deem important including information available.
-verify all information contained in the item description and all promotional materials, including, but not limited to, photographs, dimensions, conditions, etc. These were provided by or on behalf of the seller and are believed to be correct; however, neither the seller or the auction company makes any promise, representation, guarantee, or warranty as to the accuracy or completeness of such information, inspect all items prior to bidding. Failure to inspect the property does not relieve the bidder of responsibility for payment and removal as stated in these terms.
-Seller PO disclosure -
Couchbidder.com discourages that any and all sellers refrain from purchasing their consigned items personally or through a 3rd party through the online auction. We do state that it is hard to monitor all seller activity during the auction close via the online platform and can not guarantee that sellers will not purchase their consigned items. Therfore Couchbidder.com and Jody Kalmbach Auctioneers allows seller PO's (Pullout) at the sellers discretion. The State of Texas does allow Buyers to purchase their items back from auctions so long as the auction company discloses this fact to its buyers. Couchbidder.com & Jody Kalmbach Auctioneers discloses to all buyers and sellers that all sellers are allowed to purchases their own items through the online auction platform at their own discretion. Sellers that wish to do so will be charged for these purchases and full commission plus a 5% P.O. fee will be deducted from the final settlement no exceptions.
-CLOSING DAY SOFTWARE SETTINGS-
On closing day, please make sure you set the auction to auto refresh every 30 seconds to ensure you are always looking at current information. These settings will appear at the top of the auction catalog when the auction starts to close on the last day. Please call if you have questions about the auto-refresh options. This auction will have a Soft closing which gives all current high bidders that are outbid within the last 2 minutes of the auction an additional 3 minutes to place their final bids. Our auction software can also place your bids by proxi if you are not able to watch the auction close. This means that you can leave your maximum bid and the software will automatically bid for you if you are outbid as the auction progresses. After the auction has completely ended, all winning bidders will be billed and emailed auction results within 24 hours of auction close. You will NOT be contacted if you are not the winning bidder. Our software program will automatically bill auction items to the credit card on filewithin 24 hours after auction close. If your card declines, you will be notified, and if you fail to remit payment your items will be sold at the next online auction to cover your charges, and any shortfalls will be pursued in Lee County small claims court.
A bid is a binding contract to buy. Please make sure you have reviewed your bid prior to submitting your bid. Once a bid has been submitted, it can not be retracted or changed. PLEASE NOTE: Bid retractions or changes are not allowed!
Policy for Shipping options (All auctions)
To start the shipping process you must submit the shipping form that is located under the forms tab on our website. WE SHIP IN FLAT RATE PRIORITY BOXES FROM THE USPS- OPTIONS SMALL, MEDIUM, LARGE. We will not ship any item that will not go into a USPS large priority flat rate box. Please visit www.usps.com for details on this size restriction. All items will be shipped USPS priority flat with insurance. A $5.00 handling charge for the 1st box and $2.00 for each additional box will be added to the final USPS Rate and billed to your credit card once shipping has been processed. If you require additional services please include your request on the shipping request form located under the forms tab on our website or email your special request to firstname.lastname@example.org. If you purchase items that are larger than a Large Flat Rate box, you will need to arrange shipping with your own shipper. All shipping is processed on the 1st Saturday of the month for the auctions prior. It could be up to 30 days before your items are shipped. If this is a problem, please refrain from bidding!
