Auction Terms & Conditions By bidding on an item in this sale you agree to the following terms. No "Buyer Premium" of any kind. Credit Card Sales will be subject to a 4% processing fee. "All Sales Final" EVERYTHING selling "As-Is" without warranty of any kind. No statement regarding condition, kind, value, or quality of a lot, whether made orally or in writing in our catalog or elsewhere, shall be construed to be an expressed or implied warranty or representation. Any such warranty is waived. Inspect before you bid. Jax Auction Services reserves the right to withdraw any property before the sale and shall have no liability whatsoever for such withdrawal. Preview Dates/Times: Auction can be previewed February 15th and 16th from 9 am to 5pm at Jax Auction Services 138 S Chicago Street, Hot Springs South Dakota 57747. We will be happy to provide any additional photos or videos you may request. If you have questions or need more details on items call 605-745-4360. Auction Dates/Times: Online bidding opens Thursday February 11th. Bidding will begin to close on Thursday February 25th, 2021 at 6:00 PM MDT. Starting with lot #1, items will close at 3 lots per minute until all items have sold. Any bidding on a lot within the final minute will extend the bidding on that lot by an additional minute until no further bidding occurs. ---PAYMENT--- We accept cash, check, or credit card (Visa, Master Card, Discover and American Express) 4% swipe fee on credit card payments. Cash and check payments accepted on settlement day during scheduled hours. After that time, only payment by credit card will be accepted. 6.5% South Dakota sales tax charged on all items. If you have a tax-exempt license, you must have a current (within the preceding 12 calendar months) South Dakota Certificate of Exemption form on file with Jax Auction Services or sales tax will be collected. Be prepared to fill one out at checkout. No refunds for tax collected if Certificate of Exemption form received after the scheduled settlement. Please plan accordingly. You must contact Jax Auction Services by phone, email, or in person during the scheduled onsite settlement if payment is other than the credit card used for registration. You authorize Jax Auction Services to charge your credit card if no contact has been made by the end of the scheduled settlement. Please note the buyer will also be responsible for a 4% credit card transaction fee, and handling/storage fees incurred by Jax Auction Services. ---REGISTRATION--- A credit card is required for auction registration to verify the identity of our bidders and to protect the integrity of our bidder's pool. Thank you for your cooperation. If you believe you have registered but have not been asked to enter your credit card information YOU HAVE NOT FINISHED THE REGISTRATION PROCESS. The first lot you bid on will prompt you to enter your credit card information. Please bid early to ensure you are completely registered. ---SETTLEMENT & TRANSFER OF POSSESSION--- Property to be settled for and picked up Friday February 26th, 2021 from 10 AM till 5 PM. Cash and check payments accepted on settlement day during scheduled hours. After that time, only payment by credit card will be accepted. Shipping services available at buyer's risk and expense. Jax Auction Services is not responsible for any acts or omissions in regard to handling, packing or shipping. As a successful bidder, it will be your responsibly to remove all your items or have them shipped at buyers expense. Please plan accordingly and bring the necessary assistance and vehicles/trailers required to load and haul your items. All items must be paid in full prior to loading. You will be required to provide a copy of your paid in full receipt before you will be allowed to remove any items from the property. ---ADDITIONAL FEES & EXPENSES--- Please note that we do not charge a buyer's premium. As a result, we do charge fees for any additional services that are required. Those services include payment by credit card, handling, & shipping. Buyers can avoid all additional fees by paying with cash or check in person at the scheduled onsite settlement, and removing all items. If you are unable to attend the scheduled onsite settlement the following fees will apply. 1.) 4% credit card swipe fee. Cash and check payments only accepted on settlement day during scheduled hours. 2.) Minimum $10 handling fee per bidder. Additional handling expense incurred depending on size and/or volume of items. 3.) If shipping is required. Actual cost of shipping (USPS), packaging, and insurance (if requested) will be charged in addition to any handling fees. *ADDITIONAL NOTE* Buyer must take possession of all items no later than Friday February 26th unless shipping arrangements have been made. If the buyer has not taken possession of all items by this time the property will be considered abandoned and ownership will revert back to the seller. At the discretion of Jax Auction Services, any bidders who fail to pay in full (including additional fees), or who abandon any items may have their bidding privileges revoked. ***ONLINE AUCTION DISCLAMER*** When using our online auction services, you are making firm commitments to purchase said item(s) and are entering into a legal and binding contract. Bids may not be cancelled or retracted for any reason. Nonpaying bidders or fraudulent bidding will subject you to legal recourse and possible criminal charges including any fraud and/or interstate commerce violations. You also acknowledge that the Internet may be an unreliable and error prone network. Jax Auction Services will not guarantee that bids placed online will always be transmitted to or received by the auctioneer in a timely fashion. You agree to hold Jax Auction Services and their employees harmless for any interruptions in online bidding. Further, the auctioneer has the sole discretion to accept or refuse any bid. Jax Auction Services retains the right, at our sole discretion, to add, delete or change some or all of our online services and the terms and conditions governing their online auctions at any time without notice. Jax Auction Services in further reserves the right to cancel and/or reopen the auction in the case of system failures.
