Preview and Inspection time: Tuesday and Wednesday, June 22nd and 23rd, 2021 9 AM to 5 PM. All items are located at 3523 US Hwy 95 Homedale Idaho 83628. Loadout to happen Thursday and Friday, June 24th and 25th, 9 AM to 6 PM, June 26th from 9 AM to 1 PM. Payment of cash, credit card or check is accepted. ALL PAYMENT IS DUE AT LOAD OUT TIME, unless special arrangements have been made. IF you have not paid or contacted our office to make special arrangements by the end of load out, your credit card on file will be charged for your invoice total. There is an additional 3% fee for credit/debit card. A 10% buyer's premium will be charged. 6% Idaho sales tax will apply to all purchases. All items will go to the highest bidder. Rod Fivecoat Auctions,LLC reserves the right to notify third parties, credit bureaus, collection agencies, and others about bidder's fraudulent bidding or failure to pay invoices. All uncollected amounts will be turned over for collection. All purchased auction items must be removed within 7 days after the close of the auction. All items left over 15 days will be considered abandoned and become the property of Rod Fivecoat Auctions, LLC. Purchaser must make prior arrangements with Rod Fivecoat Auctions, LLC if an item will not be removed within 7 days. All online buyers register to bid through the website. A credit card authorization will be required at time of registration. The credit card will not be used for payment. An invoice will be emailed to you after the conclusion of an online auction with invoice total and any specific instructions necessary. By registering to bid or placing a bid you agree to be bound by all of the terms and conditions of the sale. Bidder agrees to comply with any additional terms or conditions associated with particular items. We encourage you to preview items or call with questions as we want you to be happy with your purchase! No returns are allowed. NO BIDS WILL BE REVERSED OR REMOVED. Titles are processed in accordance with the Idaho DMV. In state buyers: titled merchandise purchasers will recieve a 3 day permit and a bill of sale. New title will be mailed to you by the DMV. No sale shall be invalidated by reason or any defect of the lot or inaccuracy in any of the lots by reason of their being incorrectly described in the catalog or elsewhere and no liability shall be by the Auctioneers in respect of any such faults or errors. Catalogs have been prepared ONLY as a guide based on information from sources generally believed to be reliable and from the consignor, but the accuracy thereof cannot be guaranteed or warranted by the Auctioneers. BIDDER ACKNOWLEDGES THAT IT IS HIS RESPONSIBILITY TO INSPECT ALL AUCTION ITEMS AND MAKE HIS OWN INQUIRIES. The highest bidder shall be the purchaser and no bidder shall retract his bid. ALL SALES ARE FINAL. All buyers must register and agree to the Terms and Conditions of this auction prior to bidding. Any dispute arising as to any bid shall be settled by the Auctioneers at their discretion and at the Auctioneer's discretion, the Auctioneer may immediately put the lot in the dispute up again for sale with the original purchaser responsible for sale fees, and no sale fees. THE AUCTIONEERS SHALL HAVE THE RIGHT TO CONSILIDATE OR BREAK DOWN LOTS AS THEY DEEM BEST. The Auctioneers retain the right, without notice, to withdraw any lot or lots, prior to sale of said lots. The Auctioneers assume no responsibility for any liability once bid is accepted. Merchandise sales "as is" with all faults. Purchasers are advised to pre-arrange for insurance coverage of their purchases. Ownership title passes upon the fall of the Auctioneer's gavel and/or ending of online bid and thereafter the property is at the risk of the buyer and neither the seller , nor the Auctioneer shall be responsible for property loss or damage. All applicable sales tax will be added to the purchase price of all taxable items unless the buyer has proof of exemption and files an ST-101 form with the Auctioneers. If there is a buyer's premium, the sales tax is applied after the combined total. The purchaser shall not be entitled to possession of any of his purchases until total purchase price of all his purchases has been fully paid and in the event the purchaser fails to pay the full purchase price for any lot within the prescribed time or fails to comply with any other terms of sale, the Auctioneers shall retain the possessory lein and all lots of the purchaser and have the right to resell such lots by public or private sale without notice of any kind to the Purchaser. LOAD OUT: Rod Fivecoat Auctions, LLC will provide staff and SOME equipment to load your auction items. They are intended to ASSIST you ONLY. It is the purchaser's ulitmate responisbility to load out their items. Please plan accordingly. And, please be KIND to the staff, as they are provided as a COURTESY to the purchaser. All cost and responsibillity for auction item removal shall be borne by the purchaser. The Auctioneers reserve the right to require proof of adequate insurance coverage from any purchaser of lots requiring dismantling, rigging or hot cutting. Purchaser agrees to hold harmless both the Consignor and Auctioneers against any damage caused by the act of Purchaser and/or his agents in connnection with the dismantling or removal of any lot. All lots must be removed within the time announced or posted at sale. At Purchaser's sole cost and risk, and only in a manner approved by the Auctioneers. If for any reason the purchaser fails to remove any lot within the time specified, the lot shall be deemed abandoned and the Auctioneers, at their sole decretion, may resell at any time at the Puechaser's expense. We do not ship firearms or ammunition. If for any reason whatsoever, the Auctioneer is unable to deliver any lot, or any necessary documentation required in respect of any lot, the Auctioneers' sole liability, if any shall be the return of any monies paid on such lot. There shall be no guarantees of warranties expressed or implied, statutory or otherwise of any nature whatsoever. Each and every item will be sold "As is, Where is", with all faults. ALL SALES ARE FINAL. CONDITION OF LOTS: Bidders are responsible to examine or inspect items prior to the day of the auction. ALL ITEMS ARE SOLD "AS IS, WHERE IS AND WITH ALL FAULTS. Rod Fivecoat Auctions, LLC MAKES NO WARRANTY, EXPRESS OF IMPLIED, AS THE NATURE, QUALITY, VALUE OR CONDITION OF ANY ITEM. No allowance will be made for errors in cataloging, genuiness, defects or imperfections not noted. Bidder acknowledges that the internet bidding service MAY NOT FUNCTION CORRECTLY on the day of the auction and no bidder shall have claim against Rod Fivecoat Auctions, LLC if the internet fails to work correctly during the auction. Bidders acknowledge that an auction site is a potentially dangerous place. Every person enters the auction site at his or her own risk. No person shall have claim against Rod Fivecoat Auctions, LLC, sellers, or employees for any injuries or damages to or loss of property that may occur at the auction site. All sales are final.
